a Franklin County RESOLUTION OF THE BOARD OF SUPERVISORS OF ‘THE COUNTY OF FRANKLIN, VIRGINIA REQUESTING THE VIRGINIA DEPARTMENT OF ENVIRONMENTAL QUALITY (DEQ) PROVIDE APPROPRIATE PLAN REVISIONS OF THE MOUNTAIN VALLEY PIPELINE PROJECT TO PROTECT SURFACE AND ‘GROUNDWATER RESOURCES IN FRANKLIN COUNTY ‘#(03-10-2020) OCTOBER 20, 2020 WHEREAS, the proposed Mountain Valley Pipeline (MVP) project is @ natural gas pipeine system that spans approximately 300 miles from north-western West Virgina to southem Virginia with 38 miles located in Frankin County and, as an interstate pipeline is regulated by the Federal Energy Regulatory Commission (FERC); and WHEREAS, sedimentation caused by accelerated erosion from land-disturbing actuities. during construction isa significa contributor to pollation ofthe surface waters of Virginia and the inited States; and WHEREAS, many miles ofthe proposed Mountain Valley Pipeline (MVP) project would traverse highly erodible soils with very steep slopes in Franklin County; and WHEREAS, Franklin County is required by the Virginia Department of Enviconmental Queity (DEQ) to implement a comprehensve stormwater management and erosion and sediment contra program to feduce the environmental mpacts of development projects within tre County; ang WHEREAS, Franklin County has been assigned a Total Maximum Dally Load (TMDL) for sediment in the Roanoke River and is required by the Virginia Department of Environmental Quality to implement an action plan to lower sediment loads to the Roanoke River to meet the TMDL; and WHEREAS, the required amount of lancistutance associated wil Une MVP excavation fat exces the area of al land disturbing activites ina typical year for Franklin Counly and has the potetial to cause severe erosion in the County's steep mountainous terrain and sedimentation in County's lakes, rivers and streams; and WHEREAS, many Franklin County ciizens rely on untreated groundwater from wells or spings for their domestic water supplies; and WHEREAS, the Franklin County Board of Supervisors passed a resolution expressing these concerns in October 2015, and WHEREAS, the previous work resulted in several hundred documented violations to erosion and ‘sediment control regulations by Viginia Department of Enviconmental Quality (DEQ) which utimately ‘ended in a Consent Decree in which MVP agreed to pay $2,160,000 to Virginia; and WHEREAS, FERC has lited a stop-work order on October 9, 2020 for the remaining pipeline workin Franklin County; and a ‘ranklin County WHEREAS, the Blue Ridge Environmental Defense League (BREDL) by letter dated October 6, 2020, has identified a number of continued concerns related to erosion and sediment controls and stormwater ‘management in Virginia and Frankin County; and WHEREAS, without very careful engineering and construction oversight, erosion and sediment from the Construction of the proposed Mouriain Valley Pipeline could have severe negative consequences for the County's lakes, streams, and rivers as well 2 its domestic, agricultural, and business water supplies; and WHEREAS, the outdoor beauty and unspolled nature of Smith Mountain Lake and its tbutavies is integral to the County's ably to attract tourism and recreation tothe region; and WHEREAS, the Virginia Department of Environmental Quality is the state agency empowered with the authority to review and approve pian, and the author to conduc inspections and enforcement of plans during the canstrucon of the Mountain Valley Pipeline: and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Franklin, in consideration of the points made above, request that ‘The Virginia Department of Envinmental Quality review the previous plans approved consider the concerns raised by BREDL and determine whether revisions or project-specific Erosion and Sediment Control and Stormwater Management Plans for environmentally sensiive areas of the proposed Mouniain Valley Pipeline project that meet al Virginia standards, should be required to ensure that the Continued pipeline construction wil not have detrimental impacts to the Blackwater River and Smith Mountain Lake AND BE IT FURTHER RESOLVED that the Board of Supervisors of the County of Franklin, Virginia, hereby directs the County Adminisratr to transmit this resolution to: the Federal Energy Regulatory Commission (FERC), Viginia Goveror Northam, Vigginia Department of Environmental Quality Director David Paylor, Viginia General Assembly Members Byron, Poindexter, Suetterlein and Stanley.
