This warranty is for the tank for 20 years as long as it meets the conditions below. Exclusive Remedy THE EXCLUSIVE REMEDY FOR ANY CLAIM UNDER THIS LIMITED WARRANTY SHALL BE FOR WIESER CONCRETE OR A REPRESENTATIVE DESIGNATED BY WIESER CONCRETE TO REPAIR ANY LEAK OR DEFECT INTHE TANK WHICH SHALL BE DETERMINED TO THE SATISFACTION OF WIESER CONCRETE, UPON WIESER CONCRETE'S EXAMINATION OF LEAK OR PART TO HAVE BEEN DEFECTIVE. WIESER CONCRETE SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, OR DAMAGES TO PERSONS OR PROPERTY RESULTING FROM FAILURE OR ANY DEFECT IN THE TANK OR ANY FAILURE IN ANY OTHER COMPONENTS OF THE SYSTEM THAT USES THE TANK. NOR SHALL WIESER CONCRETE BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC OR INDIRECT DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS, PLANT DOWNTIME, FINES OR PENALITIES, OR LAWSUITES BY THIRD PARTIES AGAINST THE OWNER OF THE TANK. Exclusions, Limitations and Conditions ‘This warranty shall be void if any of the following occur: ‘+ The tank is not installed in accordance with the installation instructions supplied by Wieser Conerete with each tank ‘The tank is not installed by an installer who is certified by any and all state and local regulations to install tanks. Documentation of all tank maintenance does not accompany the warranty claim. Procedures ‘Any claim under this limited warranty must be made in writing. Any claim must be mailed or delivered to Wieser Concrete Products, Inc., W3746 USH 10, Maiden Rock, Wi 54750. Assignment \ ‘This warranty is transferable and is valid if the tank is sold or if the original owner of the tank transfers ownership to a third party. ‘Tank Failure Liability Wieser Concrete agrees that all lability for any tank failure will be the responsibilty of Wieser Concrete in their entirety. Included are replacement of the tank and all excavation and installation costs that are incurred to replace the tank according to current code. This is limited to the tank replacement only and excludes any other part of the total onsite system.
