The ball is set to roll for violation of the copyright when such rights are infringed, which means
illegally reproduced by another person who is not authorised to do so as such rights are the
properties of the Master Designer. However it is necessary for the Master Designer to show:
1) That the original design was known to the person copying (the Defendant).
2) The extent of infringement of copy right cannot be decided unless and until the building is
complete. Hence the owner of the copyright cannot get an injunction to stop the work. It
lays down that where the construction of building or other structure which infringes or
which , if completed, would infringe the copyright in some other work has been commenced
3) The action for copyrights should be taken within 3 years from the date of infringement that
is within 3 years after the building is complete as after the said period of 3 years the case
stands time barred.
If the offence of the infringement of the copyright is proved, the offender shall be punishable
with imprisonment for a term which shall not be less than six months but which may extend to
three years and with fine not less than Rs. 50,000/- but may extend to Rs. 2 lakhs.
