ESSENTIAL CHARACTERISTICS OF COPYRIGHTS


1) It is a right of negative nature.
2) Copyright shall subsist in the work of Architecture located in India and not applicable to
works situate out of the country.
3) It subsists only in artistic character and design and not to extend to processes or methods of
constructions.
4) The owner of the copyright can assign such rights to others, in writing and against
consideration.
5) The normal term of copyright is fixed to be the life of the creator architect and a period of 60
years after his death.
6) The reconstruction of a building or structure in accordance with the architectural drawings
or plans by reference to which the building or structure was originally constructed, will not
be an infringement of copyright provided original construction was made with the
permission of the owner of the copyright.

The ball is set to roll for violation of the copyright when such rights are infringed, which means
illegally reproduced by another person who is not authorised to do so as such rights are the
properties of the Master Designer. However it is necessary for the Master Designer to show:

1) That the original design was known to the person copying (the Defendant).
2) The extent of infringement of copy right cannot be decided unless and until the building is
complete. Hence the owner of the copyright cannot get an injunction to stop the work. It
lays down that where the construction of building or other structure which infringes or
which , if completed, would infringe the copyright in some other work has been commenced
3) The action for copyrights should be taken within 3 years from the date of infringement that
is within 3 years after the building is complete as after the said period of 3 years the case
stands time barred.

If the offence of the infringement of the copyright is proved, the offender shall be punishable
with imprisonment for a term which shall not be less than six months but which may extend to
three years and with fine not less than Rs. 50,000/- but may extend to Rs. 2 lakhs.
