RE: Demand to give support to spouse, Christina Dela Cruz, and their legitimate child

Dear MR. DELA CRUZ:

Our law office was employed to represent Mrs. Christina Dela Cruz in the above-referenced case. We are
writing to you to formally demand that you give support to Christina Dela Cruz, your spouse, as well as
your legitimate child, Joanna Dela Cruz.

You married Mrs. Dela Cruz on March 5, 2017. Due to your job as an Overseas Filipino Worker, you had
to leave a week after your marriage. Despite the distance, you kept constant communication with Mrs. Dela
Cruz. You came back to the Philippines on December 2017 for a month-long vacation, and you eventually
left on January 2017. Around a month after you left, Christina discovered that she was pregnant. You came
back around the time Mrs. Dela Cruz gave birth, but you left again shortly after. You kept in contact and
sent support to Mrs. Dela Cruz up until December 2019 when you eventually stopped sending support and
the communication with her also ceased. Mrs. Dela Cruz tried to reach you, but you made it difficult for
her to reach you. After two months of trying to reach out to you, Mrs. Dela Cruz was left with no choice
but to take action against you to compel you to give support to her and your child since she is unemployed
and she needs the support to provide for her and Joanna’s basic needs.

Under the Family Code provisions on Support, Article 195 states that spouses are obliged to give support
to each other to the whole extent set forth in Article 194. This would mean that Mr. Dela Cruz is obliged to
give support to Mrs. Dela Cruz. This is in line with the Article 68 of the same code which states that the
husband and wife are obliged to live together, observe mutual love, respect and fidelity, and render mutual
help and support. Moreover, Joanna Dela Cruz, being the legitimate child of Mr. Dela Cruz, is entitled to
support receive support pursuant to Article 174, paragraph 2 of the Family Code. The provision states that
legitimate children have the right to receive support from their parents, ascendants, and in proper cases,
their brothers and sisters… You are, without a doubt, obliged to give support to Mrs. Dela Cruz and Joanna
Dela Cruz, your lawful wife and legitimate child, respectively.

For the foregoing reasons, we demand that you resume providing regular support to Mrs. Dela Cruz and
Joanna Dela Cruz in the amount of Php 30,000.00. Should you refuse to do so, we will be compelled to file
a civil or criminal case against you. Should you have any questions, please feel free to come by my office
