AGREEMENT TO CONSTITUTE PERPETUAL EASEMENT

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and entered into this ______ day of

_____________, in the Municipality of _________________, Province of
Quirino, Philippines, by and between:

MICHAEL MAGNO of legal, Filipino citizen and with residence

and postal address at Dibibi, Cabarroguis, Quirino, hereinafter called the
GRANTOR;

and

The PROVINCIAL GOVERNMENT OF QUIRINO, represented herein

by its Governor, the Honorable Junie E. Cua, with business address at the
Provincial Capitol, Cabarroguis, Quirino, hereinafter called the GRANTEE;

WHEREAS, the Grantor is the owner in fee simple of a parcel of land

situated at Dibibi, Cabarroguis, Quirino, which parcel is covered by
Original Certificate of Title No. P- ____) issued by the Register of Deeds
of the Province of Quirino, more particularly described in said titles;

WHEREAS, the Grantee, is by law charged and bestowed with

governmental powers sufficient to ensure and support efficient and
effective governance within its territorial jurisdiction, which among others is
the preservation and enrichment of culture, health, safety, enhance
economic prosperity, maintain peace and order and preserve the comfort
and convenience of its inhabitants;

WHEREAS, the Grantee in relation to its statutory obligation and

function as a subdivision of the state, has programmed the
Construction/road widening of a road artery linking Didipio to the main
public highway;

WHEREAS, there exist no other more convenient place except that

which passes through the estate of herein GRANTOR; and

 WHEREAS, the GRANTOR is willing to grant to herein GRANTEE, a
perpetual easement of right-of-way consisting of a strip of land for a
consideration and under the terms and conditions hereinafter set forth;

WHEREFORE, in light of the foregoing premises, the GRANTOR

hereby grants unto said GRANTEE a perpetual easement of right-of-way
over the above described land of the grantor, said easement to cover and
embrace a strip of land with an aggregate area of ONE THOUSAND
SEVEN HUNDRED NINETY FOUR (1794 sq.m.) running across the
dominant estates as shown in the sketch plan which is attached hereto as
integral part of this document;

That the GRANTEE, for and in consideration of the perpetual use of

the said strip of land herein granted for the purpose above indicated, does
hereby agree to pay the GRANTOR as just compensation the aggregate
amount OF ONE HUNDRED SEVENTY NINE THOUSAND FOUR
HUNDRED PESOS (Php 179,400.00) and both the PARTIES agree to
have this agreement constituting a perpetual easement of right-of-way be
entered as an encumbrance to the title thereof for all legal intents and
purposes.
IN WITNESS WHEREOF, the PARTIES have hereunto set their
hands at the date and place first written above.
