Scope of services
1) It shall be the responsibility of the transporter / service provider to transport coal from
Mines of MCL to the plant premises of BPSL
2) It shall be the responsibility of the transporter / service provider to receive DO from MCL
3) Obtain Mining permit from respective Mining Circle
4) Feeding the DO at Mines area with all the necessary documents
5) Responsibility of the transporter to place the trucks at mines loading point and also ensure
proper quality and quantity loaded from mines to our plant
6) Transporter should directly deal with the transport owners association for availability of
trucks.
7) Entire DO/ Allotted quantity to be delivered within the RDO validity date.
8) Penalty will be levied in case of quantity gets lapsed from the allocated Do/ Allotted
Quantity.
 Weighment
The net weight recorded at the plant shall be considered as final for all commercial purposes.

EMD
After receiving the authorization for lifting the DO/ Allotted quantity. The transporter/ service
provider has to deposit an EMD of Rs. 400 PMT for the given quantity.

Quality
 The GCV will be based on ARB received at plant
 Plant Quality control report would be final for calculation of Bonus and Penalty.
 GCV bonus/ penalty will be calculated on the daily received quantity or the GRN quantity.
1. Request for Bids from interested Service provider subject to acceptance of the
terms and conditions of this RFQ, to be offered during the online negotiation, as per
schedule mentioned in the auction notice.

2. BPSL reserves the right to allow the Service provider to participate in selected
Routes, on online negotiation without assigning any reason whatsoever.

3. Award of Contract: Bids will be invited from interested service provider under
Online Negotiation Process. The lowest offered Bid through the online negotiation
process (as described in details below), will become the accepted rate, for the
particular destination/state. However, being L1 does not guarantee you the Work
Order. The final decision of placing the Order on the service provider lies solely with
BPSL. BPSL Division’s decision will be final and binding. All rates quoted during the
online negotiation shall remain valid throughout the validity period of each of the
Important market. This shall be applicable in case of Non L1 bids also.
1.05 Information for 4. Once the online bidding is over, all participating LSPs must abide by the terms and
online event conditions and respect the bid price quoted by them irrespective of their ranking
(L1, L2, L3, etc.) during the online Auction after the online Auction is conducted.
Failing to do so or in case of any other back out of any other terms and conditions
or any other reason (Inordinate delay in starting the service, etc.) may lead to
forfeiting of EMD of such participants at the discretion of BPSL and shall be
blacklisted in future. Other penalty conditions, if any shall be discussed at the time
of nomination by BPSL.

5. Placement of Lot Confirmation: BPSL shall place the LC within 2-3 days from the
date of online Auction to the nominated service provider. Initial one month service
provider need to accept any intimation coming over mail or other sources from
BPSL for smooth execution of the work without any interruption.

6. Validity of online price: Online quoted price shall be valid for a period of 1 Year
from 1st Aug 2020 to 31st July 2021. Once LC issued/intimation send to
nominated service provider rate will be valid for entire contract period of 3 month.
 1. To participate in the online Auctions, interested Service provider are requested to
submit this RFQ (duly stamped and signed in all pages) along with refundable /
adjustable Earnest Money Deposit (EMD) of Rs. 1,00,000 (Rs. One lakh only) will
be collect from Transporter payable by NEFT in favor of “eBusiness Dot Com Pvt
Ltd” payable at Indore and submit the physical instrument at Steelez as per the
Address & Contact persons mentioned latest by 28th July 2020, failing which the
participation in the bidding will not be allowed or deposit the same in:

Deposit and Bank
Guarantee 2. Existing service provider of BPSL need to submit a declaration in their Company
Letter Head mentioning the equivalent EMD amount to be considered from their
outstanding bills.

3. The successful service provider shall have to submit Security Deposit After
receiving the authorization for lifting the DO/ Allotted quantity. The transporter/
service provider has to deposit an EMD of Rs. 400 PMT for the given quantity in
the name of “Bhushan Power & Steel Limited (BPSL)”. In case, the service
provider cannot submit the Bank Guarantee, they have to give the underwriting
that their bills of the equivalent amount shall stay pending with BPSL. Only
payments above the Bank Guarantee amount shall be paid to the Service
Provider. The Service Provider cannot claim any payment or late payment charges
for these pending Bills.

4. There is will be no interest payable on EMD as well as Security Deposit.

 1. Inbound Transportation from Various Mines as given above to Jharsuguda(Odisha)
Plant .
2. Load Types :
· For Samleswari, Belpahar and Lakhanpur Mines vehicle carrying tonnage
would be 10 Mt to 19 Mt
· For Kulda and basundhara Mines vehicle carrying tonnage 10 Mt to 38 Mt

Scope of Work for Transporter of Coal

1. Transporter is required to collect the delivery order well in time from the concerned
authority of the related mines against which authorization has been issued for lifting.
2. Transporter ensures the timely delivery of the loaded material to the plant.
3. Supervision at the time of loading of trucks shall be done by you with ensuring the
best quality as per the allotted grade.
Scope of Work & 4. The driver should carry all the vehicle related papers, with original driving license

2. 90% payment will be released within 3 days of receiving the bill. Balance after

3. EMD will be forfeited on balance / Lapsed qty.
4. The weighment of BPSL weighbridge shall be final.
5. Bonus / penalty will be account for after completion of entire DO Qty
6. All Taxes and Levies including Service Tax if any, will be borne by us & TDS will be
deducted as per IT Act and at prevailing rate.

2. The Service Provider must have license from Director Mines of Odisha. Details to be
shared with Steelez.
3. The Service Provider needs to give their Lowest Price feedback before 27th July
2020. Only Selected parties will be allowed to participate in the Online Auction on
29th July 2020.
Any delay or failure to perform the contract by either party due to reasons beyond
reasonable control of such party i.e. force majeure events, such as, but not limited to,
acts of God i.e. flood, inundation, typhoon, cyclone, earthquakes, landslides, fire, etc.,
act of Government i.e. war, hostility, embargo, etc., contingencies like strike, lockout, go

slow, sabotage, riot, etc. order of any competent court/Government Authority shall not
be considered as default for the performance of the contract and for claim/damage or
cancellation of the contract. However, occurrence of force majeure events shall be
informed by the affected to the other party within 48 hours of occurrence.

Any disputes/differences arising out of the contract shall be settled by arbitration as per
the Arbitration and Reconciliation Act, 1966 and rules made there under by a sole

Bhubaneswar and the proceedings shall be conducted in English language. The award of
the said Arbitrator shall be final, conclusive and binding.

All disputes under the contract shall be subject to the jurisdiction of appropriate court in

Termination for Cause: BPSL shall terminate order upon 15 days prior written notice to
the Service Provider, if the Service Provider fails to perform any of its material /
fundamental obligations or for any breach of terms and conditions under this request
for quotation (RFQ) as well as the order and BPSL shall be entitled to actual loss /
Termination of damage suffered by it due to such premature termination

Contract
Termination for Convenience: Either party may terminate the agreement for their own
convenience upon serving 30 days prior written notice to other party for any reason
whatsoever. In case of such termination, neither party shall claim any compensation /
damage from the other party towards loss of business / profile on premature
termination.
1.17 Code of Conduct The successful Service Providers shall follow the “Code of Conduct” formulated by BPSL.
 DECLARATION PRIOR TO BIDDING IN ONLINE REVERSE AUCTION

Dear Sir,

 We have understood the auction process to be conducted on the platform of Steelez.net. We have been
provided a valid log-in name and password by Steelez for the On-line Reverse Auction to be conducted for
Bhushan Power & Steel Limited (BPSL)
 We have also been informed that the demo auction for the same is presently running on the site and we
can make bids in this auction for practice.
 We have been informed about the Schedule, Methodology for the Market for the online bidding vide the
Auction Notice.
 We shall abide by all the Terms and Conditions as per the above mentioned RFQ.
 We confirm to provide the last bid confirmation letter after the online reverse auction event.
 We shall give due cognizance to the above during the online bidding.
 We are aware that in case an auction continues beyond 18:30 Hours, then the same will be paused on that
day and will be reopened on the next working day.
