Ref. to: Useful aspects about organizing the work of employees, considering the
COVID-19 context
In the present context generated by COVID-19, in which the employers decide to allow the
employees to work from home or try to implement measures to limit the spread of the virus
among the employees that work from the office/production facilities, please find below some
points to consider in relation to the legal implications of work organization in the following
period:
1. The work from home for a limited period of time in the present epidemiological context falls
under the legal regime of telework regulated by Law. 81/2018.
The employers that choose this form of work should consider aspects such as:
• concluding addenda to the individual employment agreements in order to include the
specific telework provisions;
Note: According to the Decree no. 195/2020 for the setting up of the emergency state, during
the emergency state period the work from home/telework can be decided unilaterally by the
employer
2. Regarding the measures aiming to limit the risks of COVID-19 infection for the employees
that work from the employer’s office/production facility, such measures should consider the
restrictions generated by the legislation on personal data protection.
The data protection regulatory authorities from the EU member states issued points of view
regarding measures involving personal data processing and which cannot be taken by the
employers in relation to their employees. Among others, such measures include
collecting, in a systematic and generalized manner, of data regarding the employee’s health
(e.g. by requesting medical certificates), measuring the body temperature and registering
the results in a ledger/requesting other data regarding the health condition of an employee
etc.
Considering this, any measures that an employer intends to take in order to identify the
employees that could present COVID-19 infection risk should be carefully analyzed in order to
avoid the risk of breaching the personal data protection legislation and the associated pecuniary
risk.

La nivelul autorităților de reglementare din statele UE s-a conturat o listă de demersuri care
implica prelucrarea datelor cu caracter personal și pe care angajatorii nu le pot
efectua. Printre altele, aceste măsuri includ colectarea, într-un mod sistematic și generalizat,
de date privind sănătatea angajaților (exemplu: prin solicitarea de fișe medicale), luarea
temperaturii angajaților și eventuala inregistrare a rezultatelor într-un registru/ solicitarea
altor date privind starea de sănătate a unui salariat etc.
Astfel fiind, orice demers pe care societatea angajatoare intenționeaza să îl întreprindă pentru a
identifica eventualii salariați care pot prezenta risc de infectare cu COVID-19 trebuie atent
analizat pentru a se evita încălcarea legislației privind protectia datelor cu caracter personal și
consecințele pecuniare pe care o astfel de încălcare le poate atrage.
