No. 16-12[47-II.-Wherea& it 15 expedient to regulate
and control the export of potatoes from within tho area
which formerly comprised Kumarsain State and now
forms part of Theog 'l'ehsil.
And whereas by virtue of proviso to Section 5 of the
Government of India Notification No. 185-P, dated the
15th April, 1948, all powers exercisable by the Darbar of
KUMARSAIN t;TATE under the laws that continue in
force therein are exercisable by the Chief Commissioner,
Himachal Pradesh.
Now, therefore, th« Chief Commissioner, Himachal
Pradesh, in exercise of his powers as Darbar conferred
by Rule 81 of the Defence 0£ India Rule as applied to the
aforesaid area, hereby makes the following Order:-
1. (a) This Order shall be called" THE KUMARSAIN
POT.A.TO Control Order, 1948, (hereinafter referred to as
the "Order '').
(b) It extends to the areas of KUMARSAIN SUB-
TEHSIL (hereinafter referred to as " ThP Arca ").
( c) It shall come into force with immediate effect.
2. In this Order, unless there is anything repugnant in
the subject or context:-
(a) "Potato" means all varieties of Potatoes and
includes Seed Potatoes.
(b) "District Magistratc " means the District :Magis-
trate of Mahasu District and includes any officer
authorised by him for all or any of the purposes
of this Order,
(c) "Dealer" _means a person who carries on the
business of buying and selling Potatoes.
3. (1) No person shall carry on business ase, Deal11r
in Potatoes within the area except under and in accord-
snee with tho terms and conditions of a license, in Form.

~fogistrate.
(2) The license shall remain in force as the authority
granting may fix and enter in the license.
4. AJlJ)lication for license under the Order shall be
made to the District Magistrate in Form II in the Sche-

(a) if he is not a bonafide dealer in potaioes;
(b) if he is otherwise considered unsuitable by the
District Magistrate to be granted a license.

6. The District Magistrate shall have absolute discretion
to cancel, revoke or modify any license granted by him
under this Order.
7. A holder of a Jil·ense granted under this Order shall
comply with all directions that may be issued generally
to all holders of Iiccnses iu the area of to him specifically
by the District M agistrate in regard to:-
(a) the place and time of purchase or sale of pota-
toes; and
(b) th11 price at which Potatoes may be bought or
sold.
8. The District Magistrate may
(a) call for any information from any Dealer, and
(b) enter upon and inspect any premises in which he
bas reasons to believe that potatoes are stored
for purposes of sale or that the purchase or sale
of Potatoes is taking place in contravention of
the Iieense granted to the dealers and seize the
Potatoes concerned.
9. No person shall export or cause to be exported any
Potatoes in any manner from any place within the area
except under and in accordance with the terms and concli-
tions of a permit issued in writing by the District Magis-
trate in Form III in the Schodnl« to this Order.
10. Nothing in this Order shall apply to the moving
of potatoes by any person in any quantity not exceeding
5 seers, i£ carried as part of personal luggage for private
consumption.
IL If any person contravenes the provisions of this
Order, or the conditions of the license granted to him
under this Order, then without prejudrca to any other
actiou that may bH taken against him, his liconse may be

addition to uny other punishment to which he may be

12. The Chief Commissioner may exempt any person

be punishable with fl.ne which may extend to one hundred
rupees, and when the breach is a continuing breach, with
a further fine which may extend to ten rupees for every
day after the date of the first convietion during which the
breach is persisted in.
III. Any fixed engine erected or uet used in contraven-
tion of any of the provisions of rule I, may be seized and
removed hy any Fisheries Offieer or other person specially
empowered (by name or in virtue of his office) by the
Chief Commissioner, Delhi, in this behalf.
IV. Any fixed engine erected or net used in contraven-
tion of any of the provisions. of r11 le 1, shall bo liable
by order of any Magistrate. to forfeiture. Any fish taken
by means of any ->ueh fixed engine or net, shall be liable
to forfeiture at the spot,

Delhi District. The said rules having been previously

Rules
1. All fishing is prohibited for ll period of two years
in the waters specified below :-
(1) Escape No. 4 Okhla,
(2) Madan Pur Khadar Pond.
(3) Jhil Khuranja Pond.
( 4) Patpar Pond.
(5) Dhobi. Kund near -Iumua Bridge between Rail-
wav line and P. W. I[). road leading towards
Shahdra.
(6) Dhobi Kuud near Rhahrlra hotween railway line
and P.W.D. road l-ading towards Gandhi
Nazar.
(7) Shamshi 'I'alab at Mehrauli.
(8) Roshanara Garden Tank.

Water.~
1. Jumna river nlonp with its tributaries and flood
channels.
Rules
l. No per-Hin shal] fish in any of the waters specified
above (•xeept under a licence in the prescribed form to
be granted by the Deputy Commissioner, Delhi.
2. Licences shall remain in force from the lRt dav of
April, in each year to the 31st March in the year follow-
ing, But tho period from the Ist ,July to the 30th
Augn'!t each year will br considered a close season dnr-
ing which no flshinz AXePpt with Rod and Line, Hand
Line and long Iine shall be allowed.
3. A Iieence sh» 11 entitle the holder to fish in the waters

4. It sha 11 be coudition of every licence granted under

Proviso.-(i) Provided that no gear except Rod and
litne may be used in river or stream within a distance of
200 yards from any bridge.
(ii) Provided that the licence holder i~ not authorised
to URe at anv one time more than two of either or any of
the kind of gear permitted to him under these rules.

6. Tt shall be further «onditinn of every licence that the

7. It shall be a condition of the licence that every

any person empowered to arrest '\ ithout warrant under
seetion 6 of the Punjab Fi-,}wriP.., Act, 1(!44.

11. All apparatus err>ctecl or n-,pr]_ for fi'>:hing in cnntra-
vRntiou of these rules may be Heized and taken to th<

ser>tion 6 of the Puniab Fisherir>A Act, 1914, to a:-rN1i
without warrant. for offences under the Art, and all ci.uch

13. It Bhall be the further (•onclition of evny Ji~~

(Thaila) shall he ('aught. Any such fish caught shall be
liberated immediately.

Rules
1. Fishing in any of the '··public waters '' in the Dii:i-
trict of Iffllhi i,., prohibited excrpt under a license to be
obtained fr<>m the Deputy C'ummi131:!ioner and Rtrictly in
accordance with the con."liclcrations of such license.
2. On or &fter the 1..,t of April each year the Deputy
Commis.<ifo11er of the Dir,,triC't conccmed or any other offi- ·
cer specially appointPd by him for the purpose shall nut
to aurtion tbr rig-ht of fishing the various '' public
waters '' or portion of i.he '' public wator.'l '' of the di.'l-
trict and shall grant a licPnse to the highest suitable bidder
in respect of Mch '' public water '' on payment of the
amount ofi'erPd by him in full or by instalments as here-
inafter provided.
3. The licensee shall pay thr amount o-ffiereil by him fm
the fl.>1hing rig-htfi in full at the timr of auction or by three
equal instalments (l) at thr· date of tbe auction (2) on
the first Decemher ( 3) on 1st March. In the latter CH<'le
the licensee may al'IO be required to furnish sufficient
~curity for the paymf1nt of future instalments.
(Provided that the lieeru;p f Pf>'I pnid may be refunded to
the licensee or his legal heir on the presentation of a claim
for refund within one week from the date of tbti i~sue of
the licenr,,e if it i.., proved to thPc satisfaction of the nfficflr

from the Ist April in each year to the 31oit March in the
year following. but no flvhing except with Rod and Line,

or by his agents or nominees, who <hall be provided with

6. The following shall interulia hf' the conditions of

(a) That the licensee or }1i'1 agents or nominees shall

Provided that no gear except Rod and Lino may be
used in any river within a distano« of 300 vard« from any
bridge, · ·
(b) That the licensee or l1is agents or nominee" shall

fishing that may come to his 01· their notice.
(c) That the Iieensee or hi-, agents or nominees shall
not be entitled to erect any fixed cngin<"l ( except in the

waters for use in conjunction with drag nets), dans or
wPirs for catching fish, nr to 11<>? poison, line dvnamite or
other noxious or explosive 1>11 bstanc« in catching fish,
( d) It shall be a eondition of tho license that evorv

7. All apparatus erected or used for fishing in co~-

nearest police Station by anv person empowered under
section 6 of tho Art to arrest, without warrant, for the
-breaeh of any rules made under sflrtion 3 of thf' Act and
all such apparatus and all fM1 taken by mean"! of anv

(b) If tho licensee fails to pay the instalment on due
date the Deputy Commi<>sionermay cancel his lieemm.
10. On the cancell'ation of the license all permit<.1 issued
1tlong with it shall al"IO be considered as eanc-0lled, the
amount already paid hy tho licensee shall not be refund-
ed to him, the right of fishing shall be reau!'tioned by the
Deputy Commissioner in the manner herein before pro-
vided, and any deficiency in the original ]lid shall be re-
covered from the first licensee as if it were an arrear of
land revenue.
11. It shall be the further condition of every license
that no fish below thr size of 8 in<'hes of the "Pl'<'i"s ( i)
Re.hu (ii) .M:irgal (iii) Barbus (J.\fahseer) and (iv) Catla
(Thaila) shall be caught. Any such fish caught shall be
liberatod immediatrly.
