either as “RFP” or “tender”) document provided to the Bidders by the Wular
Conservation & Management Authority (WUCMA), Kashmir, hereinafter referred
to as WUCMA, or any of their employees is provided to the Bidder(s) on the
terms and conditions set out in this Tender document and all other terms and
conditions subject to which such information is provided.

The purpose of this tender document is to provide the basic information to


bidder(s) for undertaking the subject work. This tender document does not
purport to contain all the information each bidder may require.

This tender document may not be appropriate for all persons, and it is not
possible for the WUCMA and their employees to consider the
business/investment objectives, financial situation and particular needs of each
Bidder who reads or uses this tender document.

Each bidder should conduct its own project area familiarization tours,
investigations and analysis and should check the accuracy, reliability and
completeness of the information in this tender document and wherever
necessary obtain independent advice from appropriate sources.

WUCMA and their employees make no representation or warranty and shall incur
no liability under any law, statute, rules or regulations as to the accuracy,

SECTION-I

BACKGROUND

1. Introduction

Wular Lake forms a part of river Jhelum basin which is a sub-basin of Indus river.
Wular Lake is one of the largest freshwater lakes of Asia. Wular with its
associated wetlands support rich biodiversity and provides habitat to migratory
birds within Central Asia flyover. Lake is largest fisheries resource in Kashmir
valley supporting livelihoods of large human population living along its fringes.
The Wular and its associated wetlands protect the Kashmir Valley from floods as
well as maintains the flow to support agriculture and hydro-power generation.
Recognizing importance of this wetland for its biodiversity and socio-economic
values, the lake has been designated as Wetland of International Importance
under Ramsar Convention in 1990.

The lake spread of Wular lake as per Toposheets of 1911 has been 217.88 sq
km which included 58 sq km of associated marshes. The area has got reduced
over the period of time mainly due to conversion for agriculture, plantations,
settlements etc. As per revenue records area of lake is 130 Sq Km. The role of
Wular lake to regulate flows has got drastically reduced due to reclamation,
siltation, willow plantation, pollution etc. Estimated 1/5th of the water holding
capacity has got reduced due to these factors.

The main functions of Wular lake are as under:-

(i) The lake acts as a huge absorption basin for flood waters and regulates
water regime of the region.
(ii) The lake is a suitable wintering site for a number of migratory water fowl
species such as the Common Teal, Pintail, Shovellar, Common Pochard,
mallard and others.
(iii) The lake sustains a number of endangered and endemic species of flora
and fauna.
(iv) It is an important habitat for fish and contributes about 60 percent of the
fish yield of the Kashmir valley.
(v) The communities in and around the lake area utilize aquatic vegetation for
various purposes particularly food, fodder and other purposes.
(vi) The lake is important source of water for irrigation, drinking water and
hydro-electric power generation projects.
(vii) Wular Lake with its rich biodiversity and scenic beauty is one of the
important tourist destinations of the State.

2. Management Action Plan

The State Government formally constituted the “Wular Conservation and


Management Authority” (WUCMA) in 2012 vide SRO-311 & 314 of 2012 under
the J & K Development Act of 1970 and the Authority came into existence in the
year 2012. Prior to the constitution of WUCMA, a Comprehensive Management
Action Plan (CMAP) for the conservation and development of Wular lake and its
associated ecosystems was prepared by M/s Wetlands International, South Asia,
New Delhi in 2007 on behalf of the J & K Wildlife Protection Department. The
said management plan for Wular lake was developed through an extended
process involving understanding of all aspects related to Wular development
including consultation with experts, community members and other stakeholders.

2.1 Comprehensive Management Acton Plan (CMAP) was formulated in the year
2007 by M/s Wetlands International South Asia and the plan for Rs.386.00 crores
was proposed by the said consultancy for Wular conservation and management.

2.2 Constitution of Technical Committee: Govt. of Jammu & Kashmir vide order
No. 38 of FST of 2010 dated 02-02-2010 constituted a Technical Committee to
revisit the project report prepared by the consultant (Wetlands International
South Asia) and directed the said committee to examine the report and submit its
recommendations. The Technical Committee on Wular development submitted
its report to the Govt. through its convener (CF Srinagar) vide letter No.
CF/Sgr/Camp/1-2 dated 21/06/2010 and subsequently the state government vide
letter no. FST/lease/07/2012 dt. 06/09/2012 accepted the recommendations of
the said Technical Committee for implementation of different components. The
report after revisiting the original plan reduced the plan by 68% and proposed
following components:-

3. Linkage of Jhelum conservation project and Wular management action
plan.
4. Institutional arrangements.
5. Monitoring and Evaluation mechanism.

2.3 Revised Management Action Plan (RMAP): The original plan under CMAP was
recast in the shape of Revised Management Action Plan (RMAP) for an outlay of
Rs.120.00 crores under 13th FC Award. The GOI approved an outlay of Rs. 120
crores under the 13th Finance Commission Award (with an approved outlay of

Rs. 30 crores per annum for 4-years w.e.f 2011-2012). However, an amount of
Rs. 60 crores only were released by the GoI from 2011-2012 up to march 2016.
The said amount was spent on lake conservation works as per approved
components as given below.

3. Wular Action Plan (WAP)

The Wular Action Plan was formulated by Wular Conservation & Management
Authority (WUCMA) in the year 2018 for Rs 200 crores which has been approved
by J & K Government. The plan is under implementation stage and shall be
completed by ending FY 2021-22. Under Wular Action Plan (WAP), several
activities are to be taken up for conservation and development of Wular lake
which includes dredging for increasing water holding capacity of lake,
afforestation activities in immediate Wular catchment, Biodiversity conservation,
Ecotourism development activities, Infrastructure development and other allied
activities. The approved components of said action plan with financial outlay are

4. Objective of the Proposal

The Comprehensive Management Action Plan (CMAP) which was prepared


by M/s Wetlands International, South Asia, New Delhi on behalf of J & K Wildlife
Department in 2007 for conservation and eco-restoration of Wular lake and its
associated ecosystems is due for revision. Furthermore, there is a need to
carryout latest survey’s and studies to formulate Detailed Project Report to work
out fund requirement and identify potential donors in order to carry out lake
conservation and management activities. The present tender is being floated to
engage a consultant to carry out such surveys and studies so that
Comprehensive Conservation & Management Plan (CCMP) and Detailed Project
Report (DPR) for entire Wular Lake along with its connected water regimes,
associated wetlands and the immediate catchment areas are formulated.

SECTION- III

INSTRUCTIONS TO BIDDERS (ITR)

1. General Conditions

1.1 All information supplied by the bidders may be treated as contractually binding on
the bidders, on successful award of the assignment by the WUCMA on the basis
of this tender.
1.2 No commitment of any kind, contractual or otherwise, shall exist unless and until
a formal written contract has been executed by WUCMA. The Chief Executive
Director, WUCMA may cancel the process at any time prior to a formal written
contract being executed by or on behalf of WUCMA.
1.3 The bidders shall abide by all the conditions laid down in this tender.

2. Definitions
Unless the context otherwise requires, the following terms whenever used in this
tender and contract have the following meanings:

a. “Applicable Law” means the laws and any other instruments having the force of
law in Jammu & Kashmir.
b. “Government” means Government of Jammu & Kashmir.
c. “WUCMA” means Wular Conservation and Management Authority Kashmir.
d. “Authority/Department” shall also mean the Wular Conservation &
Management Authority (WUCMA).
e. “Chief Executive Director (CED)”shall mean the officer in charge of Wular
Conservation & Management Authority.
f. “Coordinator Water Management” shall mean the officer in charge of water
management in Wular Conservation and Management Authority.
g. “Coordinator CAT” shall mean the officer in charge of catchment area
treatment project in Wular Conservation and Management Authority.
h. “Superintending Engineer” shall mean the Officer in charge for the general
superintendence of lake conservation works in WUCMA.
i. “Executive Engineer” shall mean the implementing agency in charge of the
project.
j. "Engineer or Engineer in Charge" shall mean the Executive Engineer Water
Management/ Assistant Engineer/ Junior Engineer or any other officer authorized
by CED WUCMA to act on his behalf and for the purpose of operating the
project.
k. “Range Officer” shall mean the officer in charge of Plantations or the officer
executing/implementing plantation projects of CAT.
l. “Committee” means committee constituted by government for evaluation of pre-
Qualification, technical and financial proposals.

m. “Contract Price” means the price payable to the third party hired by the
Authority under the contract for the complete and proper performance of its
contractual obligations.
n. “Contract” means the Contract signed by the parties along with the entire
documentation specified in this tender.
o. “Day” means Calendar day.
p. “Effective date” means the date on which the contract comes into force and
effect.
q. “FY” means financial year starting from April 1 to March 31.
r. “Personnel” means professional and support staff provided by the agency and
assigned to perform services to execute an assignment and any part thereof in
pursuance of the contract.
s. “Proposals” means offer/documents submitted by bidders in response to this
tender.
t. “Services” means the work to be performed by the agency pursuant to the
contract to be signed by the parties in pursuance of the specific assignment
awarded to them by WUCMA.

3. Request for Proposal (RFP)


The bidder is expected to examine all the instructions, guidelines, terms and
conditions and formats in the RFP. Failure to furnish all the necessary
information as required in this Tender may lead to rejection. Bidders should visit
the area, collect relevant information for documentation and set up the
team/personnel before preparing the proposal. The Bidders should clarify any
ambiguity, omission or internal contradiction, or any feature that is unclear or that
appears discriminatory or restrictive from WUCMA well in advance. However, no
relaxation or exemption shall be provided to the bidder on any term or condition
of the Tender for reasons of non-receipt of any clarification.

Bidders should ensure that they submit a fully responsive proposal including all
the supporting documents requested in the tender. It is essential to ensure
accuracy in the information provided in the proposals. Once proposals are
received and opened, bidders shall not be permitted to change the proposal.

4. Compliance/Completeness of the proposal

4.1 The bidders are advised to study all instructions, forms, terms, requirements,
appendices and other information in the tender documents carefully. Submission
of the proposal shall be deemed to have been made after careful study and
examination of the document with full understanding of its implications.

4.2 Failure to comply with the requirements of this paragraph render the proposal
non compliant and the proposal may be rejected. Bidders must:
a. Comply with all requirements as set out within this tender.
b. Submit the forms as specified in this tender and respond to each element
in the order as set out in this tender.
c. Include all supporting documents as specified in this tender.
4.3 The proposals must be complete in all respects, indexed and bound. The page
numbers must clearly be marked on each page and cross reference be indicated
on the index page.

5. Conflict of Interest

WUCMA requires the agency to provide professional, objective and impartial


report and at all times hold the interest of Authority paramount, strictly avoid
conflicts with other assignments / jobs or their own corporate interests and act
without any consideration for future work.

6. Fraud and Corruption


6.1 WUCMA requires the agency hired through this tender to observe the highest
standards of ethics during the performance and execution of such contract. In
pursuance of this policy, WUCMA defines, for the purposes of this provision, the
terms set forth as follows:

a. "Corrupt practice" means the offering, giving, receiving or soliciting of anything


of value to influence the action of Authority by any personnel of Bidder in contract
execution.
b. "Fraudulent practice" means a misrepresentation of facts, in order to influence
procurement process or the execution of a contract, to WUCMA, and includes
collusive practice among bidders (prior to or after proposal submission) designed
to establish proposal prices at artificially high or non-competitive levels and to
deprive WUCMA of the benefits of free and open competition;
c. “Unfair trade practices” means supply of services different from what is
ordered on, or change in the scope of work which was given by the WUCMA.
d. “Coercive practices” means harming or threatening to harm, directly or
indirectly, persons or their property to influence their participation in the execution
of contract.
6.2 WUCMA would:
i. Reject a proposal for award, if it determines that the bidder recommended for
award, has been determined to having been engaged in practices listed at ‘a’ to
‘d’ above.
ii. Declare a firm ineligible, either indefinitely or for a stated period of time, for
awarding the contract, if it at any time determines that the firm has engaged in

corrupt, fraudulent and unfair trade practice in competing for or in executing, the
contract.

7. Pre Proposal Queries, Clarifications and amendments of tender Document

The prospective bidder, requiring any clarification on tender may contact


WUCMA and seek required clarification. The queries should necessarily be
submitted in the following format:

The bidders shall be responsible for ensuring that the queries have been
received by WUCMA. Any requests for clarifications after the indicated date and
time shall not be entertained by Department.

The purpose of query clarification is to provide the bidders with information


regarding the tender, project requirements, and opportunity to seek clarification
regarding any aspect of the tender and the project. However, WUCMA reserves
the right to hold or re-schedule the process.

However, no relaxation or exemption shall be provided to the bidder on any term


or condition of the tender for reasons of non-receipt of any clarification.

8. Response to Queries and Issue of Corrigendum


8.1 WUCMA will endeavor to provide timely response to the queries by uploading in
the website. No individual response to be given. However WUCMA makes no
representation or warranty as to the completeness or accuracy of any response
made in good faith nor does it undertake to answer all the queries that have been
posed by the bidders.

8.2 At any time prior to the last date for the receipt of proposals, WUCMA may, for
any reason, whether at its own initiative or in response to a clarification
requested by a prospective bidder, modify the tender document by a
corrigendum.

8.3 The corrigendum, if any, and clarifications to the queries from all the bidders will
be uploaded on the official website of https://jktenders.gov.in. Any such
corrigendum shall be deemed to have been incorporated into this tender.

9. Evaluation Process
The proposals received pursuant to this tender will be evaluated as per the
criteria specified in this document and the qualified bidder would sign a contract
with WUCMA which would specify the assignment that the selected bidder is
expected to perform.

Evaluation of the proposals shall be carried out in three stages: Pre-


qualification criteria, Technical bid, and Financial bid. The pre-qualification
criteria, technical and financial bids shall be submitted at the same time as
prescribed in the tender.

No amendment to the submitted documents shall be accepted after the dead


line. Any agency that fails to meet the pre-qualification criteria will not be
considered for further stages. For the bidders who satisfy the pre-qualification
selection criteria, the technical bids will be opened and evaluated in conformity
with the provisions of the tender. The Technical Evaluation Committee shall not
have access to the financial proposals until the technical evaluation is concluded.
Financial proposals shall be opened only thereafter.

The final selection will be based on Quality cum Cost Based System wherein
70% weightage will be given to the technical score and 30% weightage to the
financial score. The bidder with the highest score will be awarded the contract

10. Preparation of Proposal

The bidder shall comply with the following during preparation of the Proposal:
a. The proposal and all associated correspondence shall be written in English and
shall conform to prescribed formats.
b. The proposal shall be typed and shall be signed by the bidder or duly authorized
person to bind the bidder to the contract. The proposal should be accompanied
by a power of attorney in the name of the Authorized signatory of the proposal.
c. Proposals received by fax or email shall be treated as defective, invalid and
rejected. Only duly complete proposals in the prescribed form received prior to
the closing time and date of the proposals shall be taken as valid.
d. Bidders are not permitted to modify, substitute, or withdraw proposals after its
submission. However additional information, if any, may be submitted before the
date of opening of the bids.
e. Pre-Qualification, technical and financial proposals should be prepared and
submitted on e-portal.

11. Submission of Documents

i) Bidders must submit online offers by the date and time mentioned in the website
address stated therein.
ii) Each e-tender will provide access to Technical as well as Financial part of
tender. Along with the Technical part, Bidders will attach the required documents
with the bid in line with the Tender.
iii) The successful bid submission can be ascertained once acknowledgement is
given by the system through bid submission number after completing all the
process and steps.
iv) The bid have to be submitted online only. WUCMA shall not be responsible in
any way for failure on the part of the bidder to follow the instructions. Physical
Bids will not be accepted. All such physical bids shall be considered as invalid
offers and shall be rejected summarily without any consideration.
v) Financial Bid shall contain only price (in form of an excel sheet) without any
condition. The lump sum rate along with tax and other components shall be filled
up in figures and the total amount shall be automatically calculated and rounded
off to the nearest rupee. It is to be noted that the Financial Bid shall contain only
PRICES and no conditions whatsoever.
vi) It is advised that the bidder upload small sized documents (preferably upto 5 MB)
at a time to facilitate in easy uploading into e-tendering site. WUCMA does not
take any responsibility in case of failure of the bidder to upload the documents
within specified time of tender submission.

12. Validity of Proposals

Proposals shall remain valid for a period of 90 (ninety) days after the date of
proposal opening prescribed in tender. WUCMA may solicit the consent to an
extension of proposal validity.

13. Eligibility Conditions

Eligible participating agencies should follow the eligibility conditions as laid down
below, otherwise bids will be considered as non-responsive:-

a) Each proposal must be accompanied with a non-refundable fee of Rs. 1000/=


(Rupees one thousand rupees only) as document fee in the shape of e-challan
deposited in Government Treasury under major head Forest 0406 and e-
challan/receipt of the treasury must be uploaded

b) Each proposal must be accompanied with an EMD of Rs. 10,00,000 (Rupees


Ten Lakh Only) pledged to Coordinator Water Management WUCMA, O/O Chief

Kashmir in the form of CDR/FDR drawn from any Nationalized/Scheduled Bank.

c) The Participating Agency eligible for participating in the qualification process


shall have to be a Single Business Entity. A consortium of Business Entities
and Joint Venture Entities shall not be allowed.

d) For the purpose of this RFP, the participating agency has to be registered under
either of the following Acts:

a. Societies Registration Act, 1860, or respective State Act.


b. Indian Trusts Act, 1882, or respective State Act
c. Companies Act, 2013
d. University incorporated under State or Central Act
e. Or any other relevant act.

Additionally, autonomous bodies under central or state government are


also eligible to apply for this tender.

e) The participating agency should be registered at least five years before


applying for this tender. The participating agency has to submit Registration
Certificates & GST Registration /incorporation under the governing
legislation.

f) Eligibility of bidding agencies shall be evaluated on the basis of their overall past
performance, experience of similar projects, available technical manpower and
their qualification and experience. The Bidders are requested to submit correct
information and give documentary evidence duly certified in support of the
information required.

g) A Participating Agency which has earlier been barred or blacklisted by any State
/UT Government or Central Government / department / Agency in India from
participating in Bidding Process shall not be eligible to submit bids, if such bar
subsists as on the submission Due Date. The Participating Agency shall be
required to furnish an affidavit that there is no such bar imposed and existing as
on date. An undertaking shall be furnished by the participating agency that the
said participating agency has not been not blacklisted or placed under
funding restriction by any Ministry/ Department of Government of India/State/
U.T Governments.

h) A Participating Agency should have, during the last five years, neither failed to
perform on any agreement, as evidenced by imposition of a penalty or a

judicial pronouncement or arbitration award against the Bidder nor been
expelled from any project or agreement nor have had any agreement
terminated for breach by such Bidder. In case the Bidder, has failed to
perform on any agreement, as evidenced by imposition of a penalty or a judicial
pronouncement or arbitration award against the Bidder or been expelled from
any project or agreement or have had any agreement terminated for breach by
such Bidder, such Bidder shall not be considered for this tender.

i) An undertaking shall be furnished by the participating agency that the said


participating agency has not defaulted either in works or in financial
progress in any of its works with any Government agency in the last five
years or since inception, whichever is less.

j) Participating agency should be profit making organization. The audited


balance sheet for the last three years duly certified by the Chartered Accountant
be attached with the technical bids, otherwise bids will be rejected.

k) Participating agencies should have average annual financial turnover, from


consultancy assignments, of Rs. 100,000,00 (Rupees One crore only) in
immediate preceding three financial years as applicable.

l) Participating agency shall furnish an undertaking that the agency or their


employees have no association with WUCMA.

m) Participating agency shall furnish an undertaking from the bidders that the
CEO/Director/Members of the top management committee have not been
convicted in any criminal case in any court of India.

n) It may be noted that supporting documents of all the above mentioned criteria
must be available with the agency at the time of submission of the tender. The
documents that need to be attached are mentioned in the formats enclosed
herewith this document. Additionally, the Authority reserves the right to seek
additional documents for cross verification or for any reason whatsoever. The
request for such additional documents will be intimated to the agency through e-
mail. The agency will provide the same within a week to the Authority. Inability to
provide the same will render the bidder ineligible for further consideration.

o) Restriction on Global Tenders Enquiries shall apply as specified in the revised


Rule 161(iv) of GFR in terms of instructions communicated by the Ministry of
Finance, Dept. of Expenditure Procurement Policy Division vide No.
F.12/17/2019-PPd dated 28.05.2020 and Finance Department of J & K

Government vide No.A/GFR(2019)-Arrears-532 dated 19-06-2020. Further, the
restrictions of participating countries sharing land borders with India will be in
place as per guidelines issued by Ministry of Finance Govt of India vide No: F.
No 6/18/2019-PPD dated: 23-July-2020.

14. Disqualifications

WUCMA may at its sole discretion and at any time during the evaluation of
proposal, disqualify any bidder if the bidder has:

a. Failed to meet the pre-qualification criteria mentioned in the preceding section.


b. Made misleading or false representations in the forms, statements and
attachments submitted in proof of the eligibility requirements.
c. Exhibited a record of poor performance such as abandoning works, not properly
completing the contractual obligations, inordinately delaying completion or
financial failures, etc. in any project in the preceding three years.
d. Submitted a proposal that is not accompanied by required documentation or is
non-responsive.
e. Submitted the proposal documents after the prescribed date.
f. Failed to provide clarifications related thereto, within the timelines, when sought.

15. Evaluation of Proposals


15.1 The Tender Opening cum Evaluation Committee constituted shall evaluate the
proposals received from bidders. During evaluation of the proposals, the
committee may, at its discretion, ask the bidders for clarification on their
proposals. However, such clarification would not affect any change in the
substance of the proposal.

15.2 The process and criteria to evaluate proposals is given below:-

a) Evaluation of Pre-qualification criteria


Conformance to Pre-qualification criteria: Proposals will be checked for
conformance to the Pre-qualification criteria stated in the tender. Data provided in
the format will be cross-verified with attached documents, wherever attached as
laid down in the tender document. Non-conforming proposals will be rejected.

b) Evaluation of Technical Proposals


Technical proposals will be evaluated only for those bidders who qualify in the
preliminary pre-qualification criterion scrutiny. Technical proposals of shortlisted
bidders would be evaluated and scored on the basis of information provided and
documents attached along with the bid. The technical bid will follow points-based
evaluation whereby the participating agency will be evaluated on a 100- point
scale. The evaluation under technical bid will be as per following criteria:

Based on the above scoring scheme, the total points scored by the bidder out of
a maximum of 100 points will be calculated. Based on the scores obtained by
the bidder in the technical bid, the bidder with a score of 60 points and
above only will be eligible for financial bid.

The final selection will be based on Quality cum Cost Based System wherein
70% weightage will be given to the technical score and 30% weightage to the
financial score. The bidder with the highest score will be awarded the contract.
Proposals will be ranked according to their combined technical (St) and financial
(Sf) scores (total 200 Points) with a weightage of 70:30 for technical and financial
scores respectively .

The formula to be used to evaluate the final scores/Cumulative score of the


bidders after Technical and financial evaluation:

The Committee will recommend the finally selected bidder to the Competent
Authority for acceptance. Successful bidder will be informed of the decision and

16. Right to Accept / Reject Proposal

WUCMA reserves the right to accept or reject any proposal, and to annul the
proposal process and reject all proposals at any time prior to award of contract,
without hereby incurring any liability.

17. Award of Contract

On receiving concurrence and acceptance of proposal for awarding the contract,


CED/Coordinator WUCMA will notify the successful bidder in writing of the
acceptance of their proposal with a request to formally enter into an agreement
with the WUCMA by signing of a Contract. A copy of the proposed contract may
also be sent to the concerned agency along with the letter of acceptance. The
successful bidder shall produce Performance Bank Guarantee/Security
Deposit amount equivalent to 10% of successful bid amount in the name of
“Coordinator Water Management O/O CED, Wular Conservation &
Management Authority Kashmir with validity up to three years from the
date of signing agreement. CED WUCMA will sign the contract as per the
agreed format. After signing of the contract, no variation in or modification of the
terms of the contract shall be made except by written amendment signed by both
the parties.

18. Work Schedule/Payment

Payment shall be strictly on the basis of performance of the agency against the
task assigned. The time bound milestones are provided in the annexure.

19. Confidentiality

Information relating to the examination, clarification and comparison of the


proposals shall not be disclosed to any bidders or any other persons not officially
concerned with such process until the selection process is over. The undue use
by any bidder of confidential information related to the process may result in
rejection of its proposal. Except with the prior written consent of the CED
WUCMA, the bidder and the personnel shall not at any time communicate to any

person or entity any confidential information acquired during the course of the
contract.

SECTION-IV

GENERAL CONDITIONS OF CONTRACT (GCC)

1. Application
These general conditions shall apply to the extent that provisions in other parts of
the tender /contract do not supersede them. For interpretation of any clause in
this tender document or contract, the interpretation of the CED WUCMA shall be
final and binding on the Bidders.

2. Relationship between the Parties

Nothing mentioned herein shall be construed as relationship of master and


servant or of principal and agent as between the ‘WUCMA’ and ‘bidder’. The
bidder subject to this contract for hiring of services has complete charge of
personnel and sub-bidder, if any, performing the services under the project. The
bidders shall be fully responsible for the services performed by them or on their
behalf hereunder as also for any liabilities arising out of their performance of
services under this assignment.

3. Standards of Performance

The bidder shall perform the services and carry out their obligations under the
contract with due diligence, efficiency and economy in accordance with generally
accepted professional standards and practices. The bidder shall always act in
respect of any matter relating to this contract as faithful advisor to WUCMA. The
bidder shall always support and safeguard the legitimate interests of WUCMA, in
any dealings with an organization. The bidder shall abide by all the provisions /
Acts / Rules etc. prevalent in the State. The bidder shall conform to the standards
laid down in this tender document in totality.

4. Delivery and Documents


As per the time schedule agreed between the parties for the work given to the
hired bidders from time to time, the bidder shall submit all the deliverables on due
date as per the delivery schedule. The bidder shall not without the prior written
consent of CED WUCMA disclose the contract to any person other than an entity
employed by WUCMA for the performance of the contract. In case of termination
of the contract, all the documents used by bidder in the execution of project shall
become property of the WUCMA.

5. Change Orders
CED WUCMA may, at any time, before completion of work under the contract
awarded to the successful bidders, change the work content by increasing /
reducing the quantities of the services as mentioned in the contract agreement
without creating any liabilities for compensation on any grounds, whatsoever due
to this change. In such a case, the bidder will have to perform the service in the
increased / decreased quantity at the same contract rates within the time
stipulated for providing services.

6. Bidder Personnel
The bidder shall employ and provide such qualified and experienced personnel
as may be required to perform the services under the specific project assigned
by WUCMA and as has been stipulated in this tender document. In case of
emergent and unavoidable circumstances, the replacement provided by the
bidder should be equally competent and eligible as the outgoing personnel.

7. Applicable Law
Applicable law means the laws and any other instruments having the force of law
in Jammu & Kashmir as they may be issued and be in force from time to time.
The contract shall be interpreted in accordance with the laws of the Union of
India and of Jammu & Kashmir.

8. Intellectual Property Rights

No services covered under the contract shall be sold or disposed by the bidder in
violation of any right whatsoever of any third party, and in particular, but without
prejudice to the generality of the foregoing, of any patent right, trademark or
similar right, or any charge mortgage or lien. Similarly, the Bidder shall not violate
any Intellectual Property Right (IPR), patent, trademark or any other such right of
any third party during the performance of this assignment The IPRs related to
this assignment will be held by the WUCMA.

9. Indemnity
The bidder shall indemnify the WUCMA from all actions, costs, claims, demands,
expenses and liabilities, whatsoever, resulting from any actual or alleged
infringement as aforesaid and at the expenses of the bidder, WUCMA shall be
defended in the defense of any proceedings which may be brought in that
connection.

10. Governing Language
The contract shall be written only in English language.

11. Assignments

The bidder shall not assign the project to any other agency, in whole or in part, to
perform its obligation under the contract.

12. Effectiveness, period and expiration of Contract


The contract shall come into force and effect on the date of signing of the
agreement. The period of contract will be determined in the contract. Unless
terminated earlier, the contract shall expire on the date specified in the contract.

13. Performance Assessment

During the execution of the assignment, if any of the following problems are
found, then a penalty of 2% of the Contract value for each fortnight delay in
deliverables may be imposed by WUCMA after providing opportunity to the
selected agency to present its case:

i. Quality of deliverable is not up to the mark (till the quality is improved to


the required extent).
ii. Delays in deliverables.
iii. Not assigning adequate resources in time.
iv. Not engaging resources on a dedicated basis, even when required.
v. Assigning resources that do not meet the clients requirements.
vi. Inadequate interaction with the client department.
vii. The work is either not complete or not completed satisfactorily within the
prescribed period.

If the delay is beyond 3 months then the WUCMA may terminate the agreement
and shall be free to get it done from other agency at the risk and costs of the
hired agency. WUCMA may blacklist the concerned agency and debar the
agency for applying for its future assignments also.

The CED WUCMA would create suitable mechanism for evaluation of the work of
the agency and assess the progress and achievement against the deliverables
specified in the tender document of the assignment by the Monitoring Committee
periodically.

14. Liquidated Damages
If any of the services performed by the bidder fail to conform to the specifications
of the assignment or in the event of the failure of the assignment due to
indifferent, non-supportive attitude of the bidder and WUCMA decides to abort
the agreement because of such failure, then a sum up to 20% of the value of the
agreement shall be recovered as liquidated damages from the bidder. Besides,
all the payments already done for such service shall also be recovered. This shall
be without prejudice to other remedies available under this tender to WUCMA.

15. Suspension

WUCMA may, by written notice to bidder, suspend all payments to the bidder
hereunder if the bidder fails to perform any of its obligations under this
assignment including the carrying out of the services, provided that such notice
of suspension;
a. shall specify the nature of failure.
b. Shall request the bidder to remedy such failure within a period not exceeding
thirty (30) days after receipt by the bidder of such notice of failure.

16. Termination
Under this agreement, WUCMA may, by written notice terminate the services of
the bidder in the following ways.
a. Termination by default for failing to perform obligations under the agreement
or if the quality is not up to the specification or in the event of non-adherence
to time schedule.
b. Termination for convenience in whole or in part thereof, at anytime.
c. Termination for insolvency if the bidder becomes bankrupt or otherwise
insolvent.

In all the three cases, termination shall be executed by giving written notice to the
bidder. No consequential damages shall be payable to the bidder in the event of
such termination.

17. Force Majeure

Notwithstanding anything contained in this tender document, the bidder shall not
be liable for liquidated damages or termination for default, if and to the extent
that, it’s delay in performance or other failures to perform its obligations under the
agreement is the result of an event of Force Majeure.

For purposes of this clause “Force Majeure” means an event beyond the control
of the bidder and not involving the bidder’s fault or negligence and which was not

foreseeable. Such events may include wars or revolutions, fires, floods,
epidemics, quarantine restrictions and freight embargos. The decision of the
WUCMA, regarding Force Majeure shall be final and binding on the bidder. If a
Force Majeure situation arises, the bidder shall promptly notify the CED WUCMA
in writing, of such conditions and the cause thereof. Unless otherwise directed by
the CED WUCMA in writing, the bidder shall continue to perform its obligations
under the agreement as far as reasonably practical, and shall seek all
reasonable alternative means for performance which are not prevented by the
Force Majeure event.

18. Resolution of Disputes

In case dispute cannot be resolved amicably, CED WUCMA may appoint an


Arbitrator to resolve the issue as per Arbitration & Conciliation Act 1996 whose
decision shall be binding to both the parties.

19. Taxes and Duties

The bidder shall fully familiarize themselves about the applicable domestic taxes
(such as Sales Tax, Service Tax, Income Tax, GST, duties, fees, levies etc.) on
contract amount under the agreement. The bidder shall pay such Goods &
Services tax, domestic tax, duties, fees and other impositions (wherever
applicable) levied under the applicable law.

20. Legal Jurisdiction

All legal disputes between the parties shall be subject to the jurisdiction of the
Courts in Jammu/Srinagar.

21. Notice
Any notice, request or consent required or permitted to be given or made
pursuant to this contract shall be in writing. Any such notice, request or consent
shall be deemed to have been given or made when delivered in person to an
authorized representative of the party to whom the communication is addressed,
or when sent to such party at the address mentioned in the project specific
Agreement or specific conditions mentioned in this tender are met with regard to
delivery of such notice, request or consent.

1. INTRODUCTION

Wular Lake forms a part of river Jhelum basin which is a sub-basin of Indus river.
Wular Lake is one of the largest freshwater lakes of Asia. Wular with its
associated wetlands support rich biodiversity and provides habitat to migratory
birds within Central Asia flyover. Lake is largest fisheries resource in Kashmir
valley supporting livelihoods of large human population living along its fringes.
The Wular and its associated wetlands protect the Kashmir Valley from floods as
well as maintain the flow to support agriculture and hydro-power generation.
Recognizing importance of this wetland for its biodiversity and socio-economic
values, the lake was designated as Wetland of International Importance under
Ramsar Convention in 1990.

The lake spread of Wular lake as per Toposheets of 1911 has been 217.88 sq
km which included 58 sq km of associated wetlands. The area has got reduced
over the period of time mainly due to conversion for agriculture, plantations,
settlements etc. As per revenue records area of lake is 130 Sq Km. The role of
Wular lake to regulate flows has got drastically reduced due to reclamation,
siltation, willow plantation, pollution etc. Estimated 1/5 th of the water holding
capacity has got reduced due to these factors.

The State Government formally constituted the “Wular Conservation and


Management Authority” (WUCMA) in 2012 vide SRO-311 & 314 of 2012 under
the J & K Development Act of 1970 and the Authority came into existence in
2011-2012. The Authority has been given the task of conservation and
preservation of the Wular lake and its feeder channels as well as the treatment of
its catchment area falling under Erin and Madhmuti watersheds in district
Bandipora.

2. FUNCTIONS & VALUES OF WULAR LAKE

i) Flood Mitigation and Protection

Kashmir valley is flood prone and the recent floods of Sept 2014 were the most
devastating floods in the valley in over 80 years. The damages caused by the
floods ranged as per different estimates from Rs 25,000 crores to Rs 44,000
crores. All the water that the valley gets in the form of precipitation, snowmelt and
from springs ultimately goes through the Wular lake to emerge and flow into the
Indus in Pakistan. Thus Wular acts as a basin for all the water that the valley
accumulates. However, its role in flood control is mainly as an absorption basin

for waters flowing through Jhelum. However, this downstream control is
constrained by loss of volumetric capacity of the lake, slowing of inflows from
rivers mainly Jhelum. The role of several wetlands in the course of the Jhelum,
helps in absorption of excess water and thus play definite role in flood control.
Wetlands at for instance Sonawari, Bemina, Hokersar, Hygam and the
associated wetlands of Wular, all play their important part.An increased water
holding capacity of Wular can certainly play a major role in flood control by
allowing excess water to be drained into it through either Jhelum (35,000-40,000
cusecs) or the existing flood channel (12,000 cusecs) or the proposed spill
channel from 1 Dogripora to Wular (55,000 cusecs). Although with a larger
volumetric capacity, the Wular does not have more prominent role in reducing the
impact of the catastrophic floods such as floods of Sept 2014 in the upstream
areas of the lake. However, it would certainly save flood damages within the
district Bandipora.

ii) Irrigation
Water from Madhumati Nallah is withdrawn through the Zainagir Canal and is
further augmented by lifting lake waters at Watlab to irrigate the entire
agricultural area situated in the Zainagir block of tehsil Bandipora and Sopore.
This canal is designed to carry 10 cumecs flow. However, this is utilized to an
extent of 7 cumecs at present during irrigation season. This scheme therefore
utilizes 128.81 MCM of water annually from overall lake water availability.
Besides the Zainagir Canal, there are numerous lift irrigation schemes
operational in the reclaimed marshes in the southern lake fringes. The same
pumping stations are also used for dewatering purposes in the periods of
inundation.

iii) Drinking Water Supply


A 4 MGD lift water supply installation at Watlab draws its raw water requirements
from the lake to supply drinking water needs of Sopore town and Villages
between Watlab and Sopore. Another rural water supply scheme at Tarzoo
Sopore also utilizes 0.17 MGD of lake waters for its raw water requirements.
Water supply schemes lead to withdrawal of 6.94 MCM of lake waters annually.
Besides there are other numerous small to medium sized water supply schemes
operational drawing raw water directly or indirectly from Wular Lake.

iv) Hydropower
The outflows from the lake are also utilized for generating hydro Electric power in
the series of run off the river installations, namely Lower Jhelum Hydro-electric

Project (105 MW capacity located at Ghantamulla), Uri Hydro Electric Project
Phase 1 (480 MW capacity located at Uri,) and Uri Hydro Electric Project Phase
2 (240 MW capacity also located at Uri). These installations, being of run off the
river type, function as per the availability of water of River Jhelum in the
downstream reaches. Power development in the basin is regulated through the
Indus Water treaty that prevents creating storages on the river and its tributaries
for any developmental purposes, including hydropower and irrigation. Therefore,
run of the river schemes are the only source of hydropower generation in the
basin. Water storage in Wular has a direct bearing on the availability of water in
the river for hydroelectric power generation. Changes in the hydrological regimes
particularly lowering of flows during the lean season tremendously affect the
power generation capacity of the state. The two downstream projects, i.e. Lower
Jhelum and Uri have water requirement of 7,000 and 8,000 cusecs respectively.
Lowering of discharges in the lean seasons, particularly during late October to
February when the discharge reduces to 2,000 cusecs forces closure of 75%
installed capacity of these projects and consequent huge economic loss.

v) Biodiversity Hotspot

Strategically located at the western extremity of the Himalayan range in India and
south of the Pamirs, the wetlands of Kashmir serve as important staging grounds
for medium and long distance migratory geese, ducks, shorebirds, cranes and
other species that breed in the northern latitudes of Central Asia and Siberia.
Many of these wetlands are of international and national importance, due to the
large population and diversity of waterbirds and other wetland associated birds
that they support. Of these, Wular Lake and Hokersar have already been
included under Ramsar Convention considering their importance based on
biodiversity and socio economic aspects. More recently Wular Lake and
associated marshes viz., Haigam, Hokersar, 2 Mirgund and Shallabugh have
been included in the network of Important Bird Areas, based on their international
importance for birds and all of which are not formally protected. The wetlands
within the Jhelum Basin are nationally and internationally renowned for rich bird
life particularly in regard to migratory ducks and geese. The Valley acts as an
important staging ground for many of these species. At least 45 of the 213 water
bird species and 66 of the 118 wetland associated bird species have been
reported in the region. The Basin has records of 7 of the 53 globally threatened
and near threatened water bird and wetland bird species reported in the country,

although none of these species are regularly observed here in recent years.
Eight of 43 water bird species are listed under the appendices of the Convention
on the Conservation of Migratory Species of Wild Animals (Bonn 1982) to which
India is a Contracting Party. Forty-three of the water bird species are covered
under the Central Asian Flyway Action Plan.

vi) Recreation &Tourism

Wular Lake with its rich biodiversity and scenic beauty is one of the important
tourist destinations of the State. The major recreational activities undertaken in
the lake are angling, boating, bird watching etc. Although there is low foot fall of
tourists, still sizeable population is dependent on taking people out for
recreational activities. The vistas are excellent and a small park called the
Vintage Park has been made for the benefit of tourists. A small entry fee is
charged. Few hotels on the bank of the lake near Sangri have come up which
are registering good number of visitors daily.

vii) Fish Production

Wular is a very important fish resource for the Kashmir valley with over 60% of
the demand for fish being met by the lake. The lake supports over 2500
registered fishers but unofficially, the number of people dependent on the fishing
activity for livelihoods is much larger. Fish extraction forms an important
resource base of livelihoods for the lakeshore communities. The number of
licensed fishermen and registered with the fisheries departments for 2014-15 in
Bandipora are 2061 and in Sopore are 438. As per the reports of the fisheries
department of Kashmir, there are 10 species of fish in Wular lake, of which seven
species are native whereas the remaining three are exotic. In the commercial
catches the exotic carps contribute 60 – 65% of the total catch whereas native
species contribute 30-35% of the catch. Fish production in J&K has been
recorded 20.39 thousand tonnes in 2016-17.

viii) Aquatic Vegetation for Economic Purposes

Vegetation of Wular Lake is an important component of the lake ecosystem


providing both ecological and economic benefits. The communities within the
lake area have been utilizing aquatic vegetation for various purposes particularly
food, fodder and other purposes. However, dense growth of some species has
chocked the lake area thereby reducing water flow and overall potential to
provide ecological and economic benefits. A separate wing of the revenue
department under the designation Naib Tehsildar, Mahali Singhara, (Sonawari)
regulates the harvest of vegetation in the lakes. The department issues licenses
for harvesting the different vegetation components. Licenses are issued for trapa

collection in three phases, a fee of Rs. 250 is charged for two months, i.e. July -
August (for immature fruits, locally called subzsinghara); Rs. 300 for the month of
September (for harvesting relatively dry trapa directly from plants, dry Singhara)
and a five months license fee of Rs. 500 during October to February for mature
fruits called Kamaigaer (Abi-Singhara). A key feature of the vegetation around
Wular is the presence of extensive willow plantations on its periphery. These
plantations were raised by the various government departments to meet the
fuelwood requirements of the city and town.

3. THREATS TO ECOLOGICAL CHARACTER

Based on the analysis of wetland features and status and trends of components,
processes and services, threats to ecological character have been identified. The
threats have been further linked to the likely influence on ecological character.
The key threats are as under:-

i) Changes in Hydrological Regimes

The hydrological regimes of the wetland have undergone drastic change. The
wetland presently builds storages during the winter months, when the flows are
already in the lean phase. This is markedly different to the earlier trends, wherein
the storages were been built during the excess flow periods and were released in
the lean flow periods, thereby providing uniformity to the flow regimes. The above
trend is also an indicator of quick drainability as the high flows in summer do not
get an opportunity to build up storages which could be subsequently available
during the lean season. Loss of marshes and catchment degradation have
further reduced the capacity of the wetland to regulate hydrological regimes. The
present stage of Wular is a contribution of the water resources development
projects which have aimed at enhancing the outflows from the Wular Lake to
achieve flood moderation in the upstream areas, and conversion of marshes for
agriculture development.

ii) Loss of Water Holding Capacity

The water holding capacity of the lake has declined by one fifth over the last
three decades. This is a major factor leading to high drainability and reduced
capacity of the wetlands to regulate flow regimes. The capacity has been further
reduced due to willow plantation. Additionally, conversion of marshes which
augment the overall holding capacity of the wetland system particularly in its
upstream reaches has led to further reduction of water holding capacity. The total
water holding capacity of the Wular at normal lake levels (1576 meters) is 340
MCM. The storage available between the average winter levels and summer

levels is of about 170 MCM. The loss of capacity is attributed to the following
factors:

a. Shrinkage of lake area: A comparison of the SOI toposheet of 1911 and satellite
imageries of 2007 indicates an overall reduction in wetland area by 45% (157.74
sq km to 86.71 sq km) during this period. Changes between various land use

b. Lake Siltation: Although there is no specific information on erosion from


catchments which are under pressure due to deforestation and quarrying in some
pockets, yet it is clear that huge amount of silt from various sources is deposited
in the lake leading to reduction in its water holding capacity. This is further
enhanced by construction of embankments for flood control in the peripheral
areas which prevent fanning of the sediments in the floodplains and its direct
deposition into the lake. This is quite evident through remote sensing survey
studies which indicate northward shifting of course of River Jhelum after Baniyari
due to heavy silt deposition at the inlet.

iii) High Rate of Sedimentation

The preliminary geological field survey in and around Wular lake reveal that the
major factors responsible for the silt deposition in the Wular lake are:
 Lithology of the geological formations along the catchment of Jhelum,
whose tributaries drain into the Wular lake,
 Structural and tectonic factors related to the rock formations bordering the
Catchment of the tributaries of Jhelum,
 Extreme climatic variations (such as frost, hot and wet conditions)
 Palaeo-geological and topographical conditions of the terrain and
 Environmental conditions of the present day (deforestation, land
acquisition, farming practices, climate change scenario which leads

tounpredictable high precipitation pattern, receding of glaciers, frequent
cloud bursts, etc.).

A comparison of the stage volume relationship derived for the Ningli Barrage
project, indicates a loss of 91.56 MCM of capacity at 1,579 amsl elevation
(maximum water level) during a period of last 30 years. Thus about one fifth of
the water holding capacity has been lost over the last three decades. This is
equivalent to an annual lake sedimentation rate of 2,470 acre feet or 999.5
hectare feet. Catchments of Wular Lake are highly degraded. Against more than
50% of very dense forests in the 1950s, presently only 30% remain under dense
forest cover. Approximately 30% of the catchment area is bare and denuded.
The other key factors responsible are:-

 Conversion for agriculture and horticulture development.


 Increasingdependence for energy.
 Adoption of erosion intensifying agro-practices in catchments.
 Degradation of high altitude pastures.
 Quarrying

Degradation of the catchments has contributed to high levels of erosion.


Assessment of erosion intensity carried out by the Forest Department using 1997
remote sensing imagery integrating information on slope, aspect, and land use
reveals that 43% and 19% of the catchment area falls under high and moderate
erosion categories.

iv) Deterioration of Water Quality

The water quality of Wular has deteriorated drastically due to discharge of high
levels of untreated sewage into the wetland. Wular Lake, due to its geo-
morphological setting becomes a recipient of entire wastewater of the basin.
Despite a rapid increase in human population, there has been no up-gradation of
the civic infrastructure leading to an increasingly higher proportion of wastes
being dumped into the water bodies. Presently none of the settlements have
been provided with sewerage treatment facilities, the result is the discharge of
wastewater directly in the water body leading to water quality deterioration.

v) Willow Plantation in Wular Lake

Growing of willow plantation has severely altered the hydrological processes of


the wetland. The Willow plantation act as a barrier to silt laden waters of the river
Jhelum forcing it to discharge the sediment load into the lake, and thereby
inducing loss of water holding capacity. A spatial analysis of the sedimentation
pattern within the wetland clearly indicates rapid siltation along the fringes of the
plantation areas. The detritus from the plantations have also accelerated nutrient
enrichment of the waterbody leading to water quality deterioration. Based on an
average plantation density of 1000 trees per ha, the Wetlands International-
South Asia in its report of Comprehensive management Action Plan (CMAP)2007
estimated that 21.84 lakh trees need to be uprooted using manual and
mechanical means. Specific areas covered under the willows are:

vi) Loss of Biodiversity

Alteration of hydrological regimes has severely altered biodiversity of the


wetlands. Several native fish species have been reported to be declining due to
deteriorating water quality, sediment load, completion with the non-native
species. The waterbird population has also declined due to declining food
availability and shrinkage in water spread area.

vii) Poverty in Wetland Dependent Communities

Wetland resources, particularly fish and economically important food and fodder
species form the base of livelihoods of the 31 villages located around Wular.
While the peripheral settlements have undergone a rapid growth in population,
there has also been a simultaneous decline in resources. Based on the rapid
appraisals carried in fringe villages, the most affected resources are the fish and
nadroo, which have recorded 87% and 46% decline over the last fifty years. With
little opportunities for occupational diversification, this loss of resources has
induced high levels of poverty within these communities. With rapid degradation
of lake water quality and absence of adequate sanitation and safe drinking water
facilities, the quality of life of the communities has rapidly eroded.

viii) Encroachment in Wular Lake

Encroachment is one of the main threats to the wetlands of Kashmir Valley. The
loss of area of associated marshes around the Wular Lake has mainly been due
to their reclamation and expansion of arable fields for paddy cultivation. As per
records available, the area under encroachment is 35.00 hectares in Wular lake.
The consequences of wetland encroachments are visible in the Anchar Lake and
Hokersar. A major portion of these wetlands have turned into residential colonies
and the remaining portion has turned into swamps.

ix) Solid Waste Disposal and Pollution

The solid wastes comprise of non-biodegradable materials like polythene and


plastics which are dumped into the wetlands by the local people. Most of the
human habitations which are settled in and around the Wular lake are the
epicenters of organic wastes which dump all types & forms of waste directly into
it. Besides, villages surrounding Wular lake discharge night soil into this lake in
absence of sanitary facilities and proper drainage networks. In addition to the
solid and organic pollutants, the chemical fertilizers and pesticides produced from
the surrounding agricultural lands run directly into Wular lake which increases it
toxicity and further deteriorates the health of wetland.

x) Hunting of Migratory Birds

Hunting of migratory birds takes place in Wular lake but there are no estimates
available. Hunting of wild birds takes place for a variety of reasons including for
subsistence and recreation. Hunting causes huge disturbances to migratory
birds/ waterfowls and leaving negative impact on population levels. Hunting is a
serious threat to endangered avifauna of Wular lake and a leading cause to
changes their migration patterns observed in over the period of years. It calls for
therefore strict enforcement of provisions of Wildlife (Protection) Act in order to

save the rare and endangered avifauna visiting Kashmir valley from as far as
Siberia.

xi) Invasive Alien Species

Invasive species are one of the important causes of species extinction. Wular
lake has also shown infestation of certain invasive species, thus cause for
concern. During the vegetation survey of the lake in 2008, Alternanthera
philoxeroides (Alligator weed) was observed in six areas. The size of these areas
varied from 3.5 m2 to 12 m2. Of the six cases of Alternanthera philoxeroides, four
were present in stands of Trapa natans. Alligator weed forms large floating
islands in the lake. There are several wetlands adjacent to Wular lakes which are
also very susceptible to invasion of this weed. Alternanthera philoxeroides forms
dense mats and thereby disrupts the aquatic environment by impeding
penetration of light and gaseous exchange as well as promoting sedimentation.
The weed also provides habitat for mosquitoes. Exotic species such as
Salvinianatans, Lemnasp. and Azollasp. have profusely grown in the lake area
and have assumed invasive character reaching to nuisance proportions.
Proliferation of Azolla in the lake is a recent phenomenon and has been also
reported profusely growing in the upstream lakes and the river channel. River
Jhelum contributes significantly to the explosion of these species besides various
channels draining into the lake.

5. PROJECT FUNDING & KEY ACHIEVEMENTS

Prior to the constitution of WUCMA, a Comprehensive Management Action Plan


(CMAP) for the conservation and development of Wular lake and its associated
wetlands was prepared by M/s Wetlands International, South Asia, New Delhi in
2007 which projected an amount of Rs 386 crores for rejuvenation and
preservation of Wular Lake. The Comprehensive Management Action Plan
(CMAP) was forwarded to Govt. of India in 2011-2012 for necessary funding. The
GOI approved an outlay of Rs. 120 crores under the 13 th Finance Commission
Award (with an approved outlay of Rs. 30 crores per annum for 4-years w.e.f
2011-2012). A Revised Management Action Plan for Rs.120 crores was
subsequently submitted to the Govt of India in 2011-2012. However, an amount
of Rs. 60 crores only were released by the GoI from 2011-2012 up to march
2016. The said amount was spent on lake conservation works as per approved
components as given below;

5.1 Key Achievements

Various key achievements that have been made by WUCMA on various


conservation and eco-restoration operations during the first phase of action plan
(2011-17) are as follows:-

i) The demarcation of the Wular lake has been carried out as per Survey of
India maps and revenue records and stands completed. The concrete
boundary pillars have been fixed all over the periphery of the lake. The
boundary line has been duly digitized using GPS & Remote Sensing
technology and each boundary pillar has been properly geo-referenced.
Net area of Wular lake at present is 130 Sq.km. The water expanse within
the lake varies from season to season.

ii) As per Management Action Plan, an area of 27-square Km of Wular has


been categorized as severely silted and covered by old willow plantations.
The WUCMA has been focusing on intensive dredging and de-silting
operation in the severely silted area of the lake. As per funds made
available for the purpose, an area of around 1.5 square kms of the
severely silted part of the lake has been completely dredged out and
de-silted. The treated portion of the lake has been restored back to its
original position. Besides, 1.8 km long stretch of the choked feeder
channel (NaazNallah, having a total length of approximately 6.00kms)
has been also completely de-silted, cleaned and restored back to its
original course.

iii) Low cost sanitary units (toilets) have been built for the population living
along the banks of Wular lake so as to prevent diffused pollution to Wular
lake as prescribed under the Management Action Plan.

iv) Financial assistance of over Rs 81 lacs has been given to the Municipal
Committee Bandipora town (through DDC Bandipora) for infrastructure
development required by the civic body to manage solid waste in
Bandipora town.

v) Financial assistance of Rs 24 lacs has been provided to Sheep, Animal


and Horticulture Departments for better grazing management, Veterinary
health support and sustainable horticultural practices in the mountainous
catchment areas directly draining into Wular lake.

vi) Afforestation of over 1220 hectares of badly degraded catchment areas


has been carried out by means of planting of approximately 12 lac saplings
(both conifer and broadleaved species) for mass greening of the denuded
hills in Erin & Madhumati Watersheds. Fodder development and energy
plantation too have been raised in the target areas falling under the
catchment areas besides large-scale vegetative and engineering measures
have been taken to prevent and control soil erosion in these areas.

5.2 Wular Action Plan 2019-2020


In order to overcome slow pace of work and insufficiency of funds, WUCMA
moved a fresh proposal in the year 2019-20 under Wular Action Plan in which
WUCMA proposed to deploy modern hydraulic machinery such as Cutter suction
dredgers for dredging of the lake and projected fund requirement to the order of
Rs 200 crores so as to cover maximum part of silted up areas of the lake within
shorter duration of time. The proposal was approved by the State Administrative
Council vide its decision No. 96/10/2019 dt. 25/04/2019 and the administrative
approval was accorded vide Govt. order No. 138/FST of 2019 dt.25/04/2019 to
this action plan. The work has already been started on the action plan and the
components/activities proposed shall be completed in two years of period. The
approved components of said action plan with financial outlay are as under:-

The main achievements of this action plan shall be desilting of more than 3 Sq
Km area of critically silted up portion of Wular lake with excavation of silt load of
6.4 MCM of silt from Wular lake. 400 hectares of immediate catchment (Erin &
Madhumati) which is degraded shall be also rehabilitated by carrying out
plantation of 4.40 lakh plants. Besides, other activities, involving biodiversity
conservation and development of ecotourism in Wular lake.

6. PROJECT OUTCOME

7. NECESSITY FOR CONSULTANCY ASSIGNMENT

The Wular project is an eco-restoration and conservation project which has great
importance in ensuring water security of Kashmir. It has also great biodiversity
value as it is a Ramsar Site which further adds cardinal value to this project.
However, to implement Wular project successfully, a substantial funding shall be

required for its restoration and conservation. Therefore, the project needs
uninterrupted funding from multi-lateral financing agencies such as World Bank,
Asian Development Bank (ADB), Japan International Cooperation Agency (JICA)
etc. The said agencies are active in the forestry & environment sectors in many
countries especially India and can be persuaded to fund this prestigious
environmental and livelihood improvement project. Association with such
agencies will facilitate the introduction of global best practices such as improved
ecosystem/river basin approach to conservation, sectoral analyses and reforms.
Due to smooth flow of funds, Wular lake will be restored to its past glory leading
to prosperity and development of Kashmir. Therefore, a Comprehensive
Conservation & Management Plan including Detailed Project Report for Wular
Lake is required to be prepared through a reputed consultant at the first instance
before approaching to such external agencies for funding.

8. OBJECTIVES OF THE CONSULTANCY SERVICES

Objective of the Terms of Reference (TOR) document is to clearly define, the


scope of work and all the significant aspects that need to be addressed while
preparing the Detailed Project Report (DPR). A detailed exposition of the Prime
activities and their suggested methodologies, which shall be carried out to
complete the entire process of preparation of DPR are described in this
document. The Scope of work for preparation of DPR however, shall not be
limited to these activities. All the activities shall be carried out as per the latest
applicable & relevant codes and established practices such as Ministry of Water
Resources Guidelines for Preparation of DPR

The main objectives of consultancy service on Wular project are:-

(i) Conduct surveys/studies in respect of various aspects of Wular lake


such as hydrological processes that maintain the ecological character of
Wular lake, management of threatening processes or activities that can
impact the sites ecological character, options of flood management,
scope of recreational activities and restoration of health of vegetation
communities and conservation and protection of biodiversity.
(ii) To integrate Wular lake and its associated wetlands study with main
Jhelum Basin environmental impact assessment study and preparation
of environmental management plans (EMPs).
(iii) Formulate Comprehensive Conservation & Management Plan (CCMP)
for Wular Lake.
(iv) Develop Detailed Project Reports (DPR’s) for selected and prioritized
schemes and other connected documents.

(v) Conduct stakeholder consultation in the preparation of Conservation
Plan & DPR.
(vi) Assist WUCMA in obtaining clearances from Central government, CWC
and other agencies.
(vii) Assist WUCMA in getting funds from external agencies such as World
Bank, ADB, JICA , GIZ etc.

9. SCOPE OF WORK

The consultant shall have to prepare Comprehensive Conservation and


Management Plan (CCMP) with emphasis on livelihood improvement for Wular
lake and associated wetlands which shall include Detailed Project Report for all
lake management projects/schemes. In general the scope of work shall include
but not be limited to the following:-

(i) Analysis of data available with different government agencies and


identify and arrange/collect additional data which may be required to
complete the study for preparing lake management and conservation
plan in all respect.

(ii) Carry out surveys and investigation relevant to the Wular lake and its
associated wetlands/ tributaries, natural depressions etc to know their
existing ground profiles, levels, contours and cross-sections. Such
investigations will be required to estimate degree of cuttings required for
dredging operations to achieve certain levels.The topographic and
bathymetric survey of Wular lake which is already part of River Jhelum
basin study being undertaken in Jhelum & Tawi Flood Recovery Project
(JTFRP) shall have to be integrated with the Wular lake and its
associated wetlands/tributaries.

(iii) Carry out geo-technical, geo-physical and geological investigations,


study satellite imageries etc as may be required to complete the study in
all respect for preparation of DPR.

(iv) Carry out hydro-morphological study/ investigations which should be


based on the sustainable approach like;
 To provide a framework to improve success of hydro-morphological
restoration measures.
 To reach cost effective ecological targets. Success of project will
depend on Hydro-morphological sustainable approach, Ecological
effectiveness and Socio-Economic Potential.

 Cost Effective- Optimization of ecosystem health, goods and
services.

International best practices to follow and develop protocols and


procedures:-

 To monitor biological response to Hydro-morphological change with


greater precision and scientifically.
 To integrate ecological restoration better with socio-economic
activities to enhance the livelihood from lake ecosystem and to
uplift the community based on the lake harvests.
 To develop a process based hydro-morphological framework like
processes essential to rejuvenate channels, riparian zones and
floodplains., to distinguish spatial and temporal scales to explain
river/ lake/wetland physical appearances & its ecosystem
functioning.

To ascertain the effects of Hydro-morphological change on river/


lake/wetland ecosystem

 Assessing the impact of hydro-morphological pressures on aquatic


biotic community including altered sediment dynamics by way of
dredging.
 Better understanding of how biotic indicators of hydro-
morphological pressures respond in multiple-pressure
environments like “Experimental and Water quality modelling work”

Review case studies/ lessons learnt from the International/ national


“Flagship” Lake/Wetland restoration projects and its correlation with the
present study.

(v) The main cause of deterioration of the Wular Lake is siltation. Apart from
the contributing channels which discharge into Wular Lake, the river
Jhelum exceeds far more than all, in bringing huge deposits of silt and
other sediment into the Lake. The proposed study shall demonstrate
ways and means to address the issue of huge quantity of sediments
being brought in by the River Jhelum and being deposited into the Wular
Lake.

(vi) Conduct feasibility studies of various options for increasing the water
holding capacity of the Wular lake, associated marshes, feeder
channels, outfall channels, balancing the early depletion effects of Wular
with suitable mechanism thereby maintaining the uniformity of the River

Jhelum to maintain its water levels in Hydrology and maintaining the

(vii) Integrate Wular Action Plan with Jhelum River Flood Mitigation study
Plan. The Irrigation and Flood Control Department has started working
on Comprehensive Flood Management Plan Phase II wherein they have
proposed the widening of OFC by 40m to increase the carrying capacity
of River Jhelum.. This Jhelum River Flood Mitigation Plan is going to
increase the drainability in OFC channel and may cause reduction in
water levels in Wular lake. Therefore the plan has to be integrated with
the de-siltation of Wular lake in order to optimize the objectives of flood
mitigation measures and lake conservation measures.

(viii) Analyse sediment/silt/ deposits of the lake so that feasibility of dredged


out material for embankment construction is technically assessed.
Soil/sediment analysis of samples from proposed dredging sites has to
be conducted to arrive at the average, minimum and maximum moisture
content of the dredged-out material which will therefore provide the
necessary basis for designing of embankment with respect to how much
consolidation and compaction is required to be carried out to achieve a
certain design with required proctor density test to make it structurally
safe for loads on embankment before such application.

(ix) Find long term solution with respect to flood mitigation systems in
reference to various aspects of Wular lake conservation, restoration and
rehabilitation. It should also provide a framework for taking up the
strengthening and extending the existing flood protection embankments
(3rd line flood protection bund) and its utilization for promotion of eco-
tourism by constructing a Wular Boulevard utilising periphery of lake.
The whole process should take into consideration all the related
environmental concerns and inter-connected livelihood issues to arrive
at the impacts.

(x) The Comprehensive Management Action Plan (CMAP) of Wular lake


prepared by Wetlands International in the year 2007 indicates that a total
no. of 21.84 lac (approx.) willow trees are existing inside the lake. The
action plan proposes removal of these willows along with grubbing out of
stumps followed by dredging to a required depth. The said estimation
has been based on sampling and willows have been quantified some 15
years back which therefore requires fresh estimation to arrive at exact
quantification followed by Environmental Impact Assessment &

Environmental Management Plan studies in order to address
environmental concerns simultaneously.

(xi) Wular lake is a lake of International Importance and has been declared
as a Ramsar Site in 1990. It harbours unique and endangered
biodiversity and therefore its conservation is of paramount importance
for conservation of aquatic biodiversity including water birds found within
the lake. Therefore the proposed study should identify ways and means
to conserve and improve waterbirds and other flora and fauna through
habitat improvement activities, control of invasive species, monitoring
mechanisms for assessment of populations etc.

(xii) Catchments of Wular Lake are highly degraded. Against more than 50%
of very dense forests in the 1950s, presently only 30% remain under
dense forest cover. Approximately 30% of the catchment area is bare
and denuded. Degradation of the catchments has contributed to high
levels of erosion. Due to erosion from catchments, huge amount of silt
from various sources has deposited in the lake leading to reduction in its
water holding capacity. The proposed study should therefore suggest
measures for treatment of prioritized micro watersheds to control soil
erosion and regulate flow regimes through biological, limited engineering
and other appropriate measures.

(xiii) Wular lake is a source of livelihood for people living in and around Wular
lake. The consultant should perform community survey, conduct
stakeholder analysis and analyse livelihood assets of lake and
accordingly propose interventions needed for livelihood improvement of
wetland dependent communities.

(xiv) Formulation of CCMP & DPR of Wular lake and its associated marshes
shall be within the ambit of provisions as laid down in “The Environment
(Protection) Act-1986”, “Wetlands (Conservation and Management)
Rules, 2017”, “The Jammu and Kashmir Water Resources (Regulation
and Management) Act, 2010”, “Non-Biodegradable Material
(Management, Handling & Disposal), Act”, “The Indian Forest Act,”; “The
Forest (Conservation) Act,”; “The Wildlife (Protection) Act, 1972”; “The
Water (Prevention and Control of Pollution) Act, 1974”, “The Indus water
treaty-1960”, etc.

10. TASKS

The consultancy assignment is divided into 3 main components, which are


further sub-divided as mentioned below;

 Evaluating different lake management & conservation solutions and


conducting feasibility study to develop a comprehensive lake management
plan. The feasibility study will consider various engineering, economic,
forestry & environmental viewpoints and be socially and economically
acceptable. The study will be based on available data supported by targeted
fresh data collection, field observations and detailed analysis.

 Formulate Comprehensive Conservation & Management Plan (CCMP) for


Wular Lake.

 Develop Detailed Project Reports (DPR’s) for selected and prioritized


schemes along with tender documents.

Task-1: Profiling of Wular Lake, its Associated Wetlands & its Catchment
Area

i) This activity shall include preparation of base map indicating the area of the
Wular lake, strengthening of bunds, bank levels maximum water levels,
bottom profiling, flood levels and flooding pattern.
ii) Geographical location, area of lake, source of water, ownership and uses of
the lake. Location and level of all inlets contributing water and effluent flow
into the water body. Details of outlets overflow, details of present utilization
of the water body and surrounding land uses.
iii) Study of the historic maps with geologic aspects of the lake along with all
channels to understand the evolution of the lake.
iv) Survey of point of pollution and non-point sources of pollution around the
lake.
v) Ecological profile of lake, flora and fauna found within the lake, threatening
processes and present status.
vi) Estimation of accumulated silt deposition, quality and quantity, depth of silt
level and its characteristics, etc.
vii) Collection of water and soil samples and their analysis for pollutants
impairing its quality. Indicator parameters, sample collection and its
procedures for analyzing according to the norms stipulated by CPCB and
Standard Practice for Examination of Water and Waste Water. (APHA,
AWWA).

viii) Analysis of water samples for eutrophication and its representation by an
index indicating the status of water body based on International/ national
best practices.
ix) Measures to protect the lake from future misuse, such as disposal of waste
water, dumping of solid waste, encroachments, commercialization etc.
x) Profiling of nature and type of catchment area, soil profile, and evaluation of
topography, storm water drainage pattern and other geological and
hydrological aspects of the catchment area, rainfall intensity, duration,
frequency and peak flood characteristics in the contributing catchment.
xi) Population in the immediate catchment area and its impact on lake.
Identification of sources of pollution like point and non-point sources of
pollution from the catchment area, quantification of pollution load to the lake
suggested by lab tests/field tests and encroachments in the catchment area.
xii) Information on the soil characteristics both in the catchment and in the
waterbody to assess the water retention, evaporation and recharging
capacity for the lake.
xiii) Identification of inlets and outlets of the lake and their existing condition and
identify the sources of pollution that discharges polluted water into the lake
and the agencies/industries responsible for causing such pollution.

After completion of Task-1, the consultant shall submit the inception report
which in general shall cover/include the following:

Methodology of the consultant for carrying out the study, feasibility


reports and detailed project report as included in the scope of work.
Findings of various data reviewed and gaps if any.
List of fresh and or additional data required for the completion of the
work.
Specification of survey and investigation required.
Preliminary Morphology Report of Wular Lake & its associated wetlands
including maps on GIS platform.
Preliminary Hydrology Report of Wular Lake based on available data and
reports.

Task-2 - Data Collection


Consultant will collect the data as may be required for the preparation of
Comprehensive Conservation & Management Plan and Detailed Project Report.
Under this Task, the consultant will collect all primary data & secondary data
available with different agencies and evaluate quality of such data. The
consultant will perform the following:

2.1 Survey and Investigations

The Consultant will be required to carry out additional Topographic and


Hydrographic survey relevant to Wular Lake and its associated wetlands to
establish cross-sections, L-sections, contours, quantity tables and block wise
BOQs etc. In addition, a survey of the land areas is also required for locating
reclamation areas/dumping sites. Topographical surveys and bathymetric
surveys of Wular lake and its immediate tributaries, natural depressions etc are
to be carried out to know their existing ground profiles, levels, contours and
cross-sections. Such investigations shall be required to estimate degree of
cuttings required for dredging operations to achieve certain levels. The
topographic and bathymetric survey of Wular lake which is already part of River
Jhelum basin study shall have to be integrated with the Wular lake and its
associated wetlands/tributaries

The outlined activities above shall be reported as separate reports and drawings
in specified scale. The detailed site plans, L-sections and X-sections shall have
bench marks, coordinate, and all the physiographic features and shall have
adequate overlap for continuity purpose.

2.1.1 Surveys of the lake

The survey shall include necessary preparation of drawings & designs with levels
with 3D Auto CAD drawings as per the requirement. It should bring out the
information of boundary survey of the lake demarcating the overall lake
boundary, outside the lake bunds and also the water spread area. Drawings have
to be prepared to show the following morphometric details of the lake as given
below:

 Total length and area within shoreline at various water levels as well a full
tank level (FTL).
 Bed levels of the lake at gridlines along north-south and east-west at 20m
spacing to cover the entire lake bed and also to a distance of 200m around
the lake outside the bund of the lake giving ground levels at every 20m
interval along the gridlines.
 Surveying and mapping all existing water inlet and outlet drains of the lake
indicating the width of channel as existing to a distance of 500m from the
lake along the upstream and downstream of the inlet and outlet channels.
Cross sections of these channels (both inlet and outlet channels) have to be
surveyed at every 25m interval indicating levels at every 1m up to the total
width of the channel extending up to 20m on either side of the channel.

Cross section drawings bringing out details shall be prepared and
submitted.
 The full storage capacity of the lake shall be computed taking into
consideration the survey data.
 A lake plan drawing has to be prepared showing all the above details.
 It is to be noted that while benchmarking the level of the point above MSL,
pillars shall have to be installed around the lake as per standards.

2.1.2 Contour Survey of the lake bed for baseline data

The contour map of the lake has to be prepared showing the depth of the lake at
different points by means of contour lines drawn for every 0.5m difference in
elevation.

The map must be prepared based on bed levels taken at several points of the
lake and not extrapolated from a few spot levels. The spot levels at intersections
of 20 m grids have to be factually read and marked on the plan of the lake.

Detailed hydrographic survey for whole area has to be carried out to ascertain
the current status. Boundary survey of the lake, demarcating the overall lake
boundary and also the water spread area.

Hydrographic surveys has to be carried out and survey charts has to be prepared
to a suitable scale with soundings at a grid interval of 20mx20m.

Drawings have to be prepared showing total length of the shoreline along full
tank level. Total area of the lake falling within the FTL, surveying and mapping all
existing water inlet and outlet drains of the lake, all buildings and structure
located adjacent to the lake up to a distance of 200m.

2.2 Geo-technical, Geo-morphological, Geo-physical & Geological


Investigations of Wular Lake & its associated wetlands

Geophysical investigations have to be carried out to identify and characterize


layers of sediment or rock under the lake floor.

Geotechnical investigations have to be carried out to identify the sub bottom


layers of lakebed, determination of the in-situ physical and mechanical properties
of the materials and sampling of materials for laboratory tests.

The following properties shall have to be assessed for Wular lake by carrying out
Borehole investigations:

 Particle Size Analysis and Atterberg Limits
 Density and Moisture content
 Shear Strength
 Cohesion
 Bulk Density
 Standard Penetration Test Value (SPT/ N-Value)

Geotechnical investigations shall also bring out soil classification of Wular lake
bed conforming to Classification of Soil as per Indian Standards & PIANC Soil
Classification (1984).

2.3 Study of Associated Wetlands, Choked Feeder Channels and their


Topographic and Hydrographic Surveys

This activity shall include study/status of existing connectivity between


associated marshes/nallas with Wular lake and necessary interventions required
to re-establish connectivity of these wetlands with Wular lake by carrying out
dredging in choked feeder channels. Similar topographic and hydrographic
surveys and requisite geo-technical investigations shall also have to be carried
out in these channels to estimate the degree of cuttings required for carrying our
effective dredging and restoring connectivity.

2.4 Study of impact of restoration measures on biotic features

This activity will assess the possible impact of restoration activities on aquatic
organisms, fish, benthic invertebrates, Zooplankton and Phytoplankton etc. and
impact on migratory and local birds which depends on the lake ecosystem.

The abundance of fish is a striking feature in Wular Lake and is an important


breeding area for many native fish species. It is also an internationally important
area for wintering and staging of numerous species of waterbirds and the most
important staging area for a freshwater surface-feeding ducks. Human activities
like poaching and hunting etc are threat to the migratory birds. The consultant will
be required to carry out evaluation and prediction of impacts of the dredging
activities on above biotic features and carry out comprehensive assessment of
dredging activities.

To devise mitigation measures for the anticipated dredging impacts.

2.5 Analysis of Soil/Silt for construction of circumference road and other
economic uses with Identification and assessment of Dumping Grounds

This activity shall include spot wise analysis of soil/silt/sediment and its feasibility
for usage in development of circumference road/boulevard, with slope design
and tests required etc. A proper analysis of sediment/silt/ deposits of the lake
shall have to be carried out to technically assess feasibility of dredged out
material for embankment construction. Soil/sediment analysis of samples from
proposed dredging sites shall have to be conducted to arrive at the average,
minimum and maximum moisture content of the dredged-out material which will
therefore provide the necessary basis for designing of embankment with respect
to how much consolidation and compaction shall be required to achieve a certain
design with required proctor density test to make it structurally safe for loads on
embankment before such application.

The silt/soil have to be analysed for other economical purposes such as brick
making etc.

As the silt load which is estimated to be taken out from Wular lake is humongous,
it is therefore necessary to plan properly its dumping and disposal. The studies
have to be carried out for selection of suitable dumping sites for deposition of silt,
covering economic and environmental considerations. Following are the essential
requirements for assessment of dumping grounds for silt:

 Preparation of Comprehensive Plan for the dumping of the dredged


material. The selection of dumping ground should be such that the
dredged material disposed at the dumping ground should not come back
into the lake or channel. It should not affect the ecology of the area where
dumping takes place.
 Detailed current observations/tracer studies are to be carried out to
assess the silt flow direction from the dumping ground and also the littoral
drift in the lake.
 The material shall be disposed off evenly spread at the dumping ground to
see that the depths should not get reduced unevenly.
 While selecting dumping ground, area having extensive flora and fauna
may be avoided.
 Dumping ground should be located preferably on government owned land.
Detailed surveys and topographic studies of suitable dumping sites shall have to
be carried out for dredging purpose.

After completion of Task-2, the consultant shall submit the report on data
collection & analysis which in general shall include data collected, maps, analysis
of data, findings. Maps and data should be submitted in agreed format.

Task 3: Modelling of Wular Lake and study of its Water Balance and Water
Budgeting

This activity shall include creating physical and mathematical models for
simulating the hydrodynamics and morphological changes in Wular lake. The
results obtained from the investigations on littoral drift, erosion and sedimentation
in movable bed model will help in determining on viability of the project before
undertaking a capital dredging or any other major activity. This part has to be
consistent with the modeling framework of Jhelum River Morphology study.

The activity shall also include hydrological and hydraulic modelling to carry out
water balance study of the lake as under:

 To carry out water balance study of the lake and measures required for
retaining water for longer duration of the year.
 Dynamic modelling of a shallow freshwater lake for ecological and economic
sustainability.
 To study its role and capabilities in absorbing floods of various frequencies.
 To assess its impact on floods when its capacity is increased artificially by
dredging.
 Modelling of water qualities of lake for various point and non-point sources of
pollution.
 Modelling of the process should also test the possible scenarios to assess the
part through these models and to evaluate the impact of various structural
and non-structural interventions proposed for restoration of lake.

After completion of Task-3, the consultant shall submit report on various modelling
studies. Report shall be submitted in agreed format.

Task 4: Preparation of Lake Hydrology & Morphology Report

This activity shall include preparation of updated report on hydrology and


morphology of Wular lake based on data collection campaign, modeling and
other studies. This activity shall take national guidelines, global experience,
Ramsar convention, wise use principle and stake holder consultations within its
purview while developing format for reporting. The consultant will provide
trainings, prepare system and operation manuals.

After completion of Task-4, the consultant shall submit the Revised Hydrology and Lake
Morphology Report for Wular Lake & associated wetlands

Task 5: Assessment of Sediment load and Rate of Siltation

The activity shall include assessment of rate of siltation in Wular lake and study
of erosion intensity in catchment of Wular Lake and shall also propose
appropriate interventions to have sediment control within Wular lake. Silt
monitoring stations and their locations shall be so planned so as to have proper
measurement of amount of silt entering into Wular Lake and leaving it. This study
shall provide present rate of siltation in Wular lake and expected rates in future.
This activity shall identify places for construction of silt traps or sedimentation
chambers in order to prevent direct entry of silt into lake. This activity shall also
provide latest assessment of erosion intensities using GIS/remote sensing
imageries integrating information on slope, aspect, and land use.

After completion of Task-5, the consultant shall submit report on rate of siltation in Wular
lake and erosion intensity classification of watershed in the format as under.

Task 6: Catchment Conservation

Catchments of Wular Lake are highly degraded. Due to erosion from catchments,
huge amount of silt from various sources gets deposited in the lake leading to
reduction in its water holding capacity. This activity shall therefore include:-
 Identification and prioritization of critical micro watersheds based on
assessment of land use, land cover and slope characteristics
 Suggest measures for treatment of prioritized micro watersheds to control
soil erosion and regulate flow regimes through biological, limited
engineering and other appropriate measures.
 Propose measures for management of high-altitude pastures to control
erosion.
 Identify alternate sources of energy to reduce pressure on forests.

After completion of Task-6, the consultant shall submit Catchment Conservation Plan of
Wular Lake &its associated wetlands.

Task 7: Sewerage Network Plan

This activity shall include study/ status of water quality and methodology for
improving the water quality, if required by physio/bio-mediation processes
including suggesting various anaerobic/aerobic/ micro-algae intrusion/ cultivation
methodologies. Requirement of Sewerage Network/ STP’s for all settlements

from which sewerage is disposed-off (point/ non-point sources) into Wular lake/
Wetland. It will also include study of sewage flow, solid waste flow and
installation of STPs for controlling the discharge of the effluents into lake area. It
will also include study of methods for improving water quality through installation
of bio-toilets and control of diffused pollution through wetland technology. This
task will give clean policy framework of sewerage management for the region.

After completion of Task-7, the consultant shall submit Water Quality Improvement Plan
of Wular Lake &its associated wetlands.

Task 8: Biodiversity Conservation

This activity shall include development of an action plan for conservation of water
birds through habitat improvement measures, development of bird breeding
centres, rescue centres, improvement of lake vegetation, and conservation of
local fish species and enhancement of fish yield and also suggest measures to
control the invasive species.

After completion of Task-8, the consultant shall submit Biodiversity Conservation Plan of
Wular Lake &its associated wetlands.

Task 9: Ecotourism potential and Development of Wular Boulevard/


Foreshore Road

The perimeter of Wular Lake is 83.6 km and it is proposed to develop a Wular


Boulevard in three phases viz from Garoora to Bandipora, Banyari to Sopore and
Bandipora to Sopore. This boulevard is proposed to be developed by upgrading
embankment of Wular lake to add not only beauty to the waterbody but also
consolidate its boundaries permanently and prevent encroachments.

Various aspects of Wular lake conservation, restoration and rehabilitation lie in


finding long term solutions. Proposed study should therefore analyse available
silt/soil and its utility for road construction after carrying out necessary tests and
provide a frame work for taking up the strengthening and extending the existing
flood protection embankments and its utilization for promotion of eco-tourism by
constructing a Wular Boulevard all along the periphery of lake.

The proposed Wular Boulevard has to be planned in such a way that it is eco-
friendly in nature and uses locally available material and 4G technologies (Geo-

Textile, Geo-Mattress, Gabions, Geo-grid) with provision of green belt so that it
becomes environmentally sustainable periphery.

The whole process should take into consideration all the related environmental
concerns and inter-connected livelihood issues to arrive at the impacts. Besides
prescribing framework for taking other ecotourism activities such as boating, bird
watching, fishing, adventure sports etc. in order to generate livelihood and bring
prosperity in wetland dwellers which will eventually lead to conservation of lake.

The Action Plan should carry out complete survey of periphery of lake to propose
necessary designs and estimates, designs and estimates for bridges, culverts,
jetties etc. It should also have detailed Plan of eco-tourism infrastructure
development.

After completion of Task-9, the consultant shall submit Wular Boulevard & Ecotourism
Development Plan of Wular Lake.

Task 10: Enumeration of undesirable trees such as Willows etc and their
disposal

This activity shall include detailed estimation/quantification of undesirable trees


based on sampling/total enumeration existing within the Wular demarcated
boundary. After counting of trees, suitable plan shall have to be formulated for
their techno-economical disposal supported by proper environmental impact
assessment studies (Impact assessment will form part of the frontline EIA study
of Jhelum Basin study in general).

After completion of Task-10, the consultant shall submit Willow Action Plan- Removal,
Disposal and Mitigation strategies.

Task 11: Socio-economic Development and Livelihood Improvement

Thisactivity shall include:


 Analysing livelihood resources, vulnerability context and opportunities for
intervention for livelihood improvement of wetland dependent communities.
 Suggesting measures for enhancement of fish yield and diversity using
appropriate techniques.

 Proposing measures for management of aquatic vegetation for food, fodder,
fuel and other uses.
 Developing strategies for additional income generation through micro
enterprises based on sustainable use of wetland resources and innovative
wetland mediated technologies.
 Designing an ecotourism development plan based on carrying capacity of
the wetland ecosystem.

Suggest measures for better-quality of life for stakeholders through improved


access to social and economic infrastructure.

After completion of Task-11, the consultant shall submit Socio-economic Development


Plan of Wular Dwellers.

Task 12: Institutional Development and Capacity Building

This activity shall include:

 Developing an effective monitoring and evaluation framework and


Institutional Organogram to ensure integrated conservation of wetland and
livelihood improvement of dependent communities.
 Developing an action plan for communication, education and public
awareness on values and functions of wetland and need for their
conservation and sustainable use.
 Developing an action plan for capacity building of WUCMA, enhancing
technical and managerial capacity of government agencies, research
organizations, non-governmental organizations and local communities for
wetland management.

This activity shall also include designing and drawing office blocks, residential
blocks and site offices along with quantity schedules and site plans showing
location for such constructions keeping in view the eco-friendliness of proposed
infrastructure.

After completion of Task-12, the consultant shall submit Institutional Development Plan
of WUCMA.

Task 13: Economic Analysis

Economic analysis shall have to be carried out to assess the overall efficiency of
project. Assessment of costs and benefits to be carried out using international
standards for economic evaluation of interventions of Lakes. Estimation of

Economic Internal Rate of Return (EIRR) and Benefit Cost Ratio of the proposed
investment shall have to be carried out for assessment of investment efficiency.
Economic analysis shall include assessment of Benefit Cost Ratio and evaluation
of the estimated project cost both in terms of total cost of the project and annual
cost for the entire duration of the project execution. Based on above analysis,
prioritisation of implementation of the various components of the project shall
have to be prepared. During the financial analysis, past project experiences shall
be studied and reflected as part of the DPR preparation activities.

The overall investment for the proposed management plan which includes the
cost of manpower, equipment and other resources to be used for implementation
of the activities has been taken as the project costs. Costing of activities shall be
based on the current schedule of rates prevalent norms of Government of India,
existing market rates, and implementation of similar activities within J&K .

Task 14: Formulate Comprehensive Conservation & Management Plan


(CCMP) for Wular Lake.

The scope of this task shall be to formulate Comprehensive Conservation &


Management Plan (CCMP) for Wular lake as per Ramsar Convention guidelines,
including detailed hydrological assessment, EIA and EMP, wise use, action plans
and community participation along with cost and duration. The consultant shall
conduct stakeholder workshop, discuss options and feasibility studies and select
and prioritize alternate schemes and recommend investment schedule.

The Environmental Impact Assessment (EIA) study and Environmental


Management Plans (EMPs) as a part of Detailed Project Report (DPR) shall be
prepared as per World Bank guidelines and its operational policies relevant to the
project and taking cognizance of the national/ regional laws or any other
competent authorities. The study shall be carried out in an integrated manner
considering the impacts of interlinking for multitude of components of River
Jhelum and Wular Lake and its associated wetlands.

Task 15 Prepare Detailed Project Reports (DPR’s) for selected and


prioritized schemes along with connected documents.

The scope of this task shall be to prepare the detailed project report for finally
selected lake conservation works/schemes. The task shall include but not be
limited to the following.

 The DPR shall be as per the relevant guidelines of Ramsar Convention and
Central Water Commission as applicable.
 DPR shall consist of detailed hydrology, design, cost and financial analysis
chapters along with other details.
 While preparing the DPR, the consultant shall keep in view the works
already carried out or being carried out or proposed by JTFRP/ WUCMA.
 The consultant will provide clarifications/compliance to all the queries
raised by any concerned department connected with the project and will
provide all the technical support to their replies till the complete clearance
of the DPR.
 The consultant will carry out any type of additional survey and investigation
which may be required for detailed design and analysis.
 Prepare documents depicting specifications of works to be executed along
with their bill of quantities.

Deliverables and Time Schedule

Considering the various activities and scope of work involved in preparation of


DPR, interstate/international aspects involved and also statutory clearances
required to be obtained from various agencies for the work of DPR preparation,
the time schedule for preparation of DPR may vary from project to project.
However in normal circumstances, a time schedule of+12 months is considered
reasonable to complete the DPR of a Lake Restoration/ conservation and
Management Project (Ramsar Wetland site of international importance). The total
consultancy period shall be for 1 year (12 months) from the effective date.
Effective date shall be considered as the date of issuance of the allotment order.

During the entire period of contract, the consultant shall prepare and submit the
reports/deliverables as detailed in table below:
