A RESOLUTION AUTHORIZING THE CITY GOVERNMENT OF PASIG,

THROUGH THE HONORABLE CITY MAYOR, VICTOR MA. REGIS N. SOTTO,

TO STIPULATE/NEGOTIATE WITH BARANGAY LOCAL GOVERNMENT UNITS
ON THE TEMPORARY SUSPENSION AND/OR WAIVER OF BARANGAY
CLEARANCE FEES FOR CERTAIN SECTORS OR INDUSTRIES FOR FISCAL
YEAR 2021 OR FOR SUCH PERIOD AS MAY BE RESOLVED BY THE BARANGAY
COUNCILS CONCERNED

WHEREAS, Republic Act No. 7160, also known as the Local Government Code
of 1991, states that every local government unit (LGU) shall exercise the powers to
ensure, support, and enhance, among others, economic prosperity and social justice,
promote full employment among their residents, maintain peace and order, and
preserve the comfort and convenience of their inhabitants. Further, R.A. No. 7160 grants
authority to the Sangguniang Panlungsod to enact ordinances and approve resolutions,
to ensure, among others, efficient and effective delivery of basic services and facilities;

WHEREAS, Republic Act No. 9485, otherwise known as the Anti-Red Tape Act
of 2007, was enacted to eliminate red tape and to simplify frontline service procedures,
formulate service standards to be observed in every transaction, and to inform the
public of such standards;

WHEREAS, Republic Act No. 11032, otherwise known as the Ease of Doing
Business and Government Service Delivery Act of 2018, seeks to make the process of
putting up and running a business in the Philippines easier and more efficient;

WHEREAS, Section 11(f) of Republic Act No. 11032 provides that “[b]arangay
clearances and permits related to doing business shall be applied, issued and collected
at the City x x x in accordance with the prescribed processing time of said Act; Provided,
that the share in the collections shall be remitted to the respective barangays”;

WHEREAS, the Sanggunian Panlungsod has, through Resolution No. 183, s.

2019, previously authorized the City Mayor to enter into Memoranda of Agreement
with the thirty (30) barangays of Pasig City, which would allow the City Government to
collect, for and on the barangays’ behalf, and eventually remit, the pertinent barangay
fees for the issuance of barangay clearances for applications for new business permits,
business permit renewals, building permits, and certificates of occupancy;

WHEREAS, for humanitarian considerations, the City Government of Pasig

deems it desirable to encourage barangays concerned to temporarily reconsider the
imposition of barangay clearance fees on certain sectors or industries that may have
been severely affected by the pandemic;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PASIG

CITY, IN REGULAR SESSION DULY ASSEMBLED, to authorize, as it does hereby
authorize, the City Government of Pasig, through the Honorable City Mayor, Victor
Ma. Regis N. Sotto, to stipulate/negotiate with barangay LGUs on the temporary
suspension and/or waiver of barangay clearance fees for sectors, businesses, or
industries that may be identified by the respective barangay councils as having been
severely affected by the pandemic, for fiscal year 2021 or for such period as may be
resolved by the barangay councils concerned.
 RESOLVED, FURTHER, that the coverage of any such temporary
suspension/waiver of barangay clearance fees shall be specified not only in the
pertinent resolutions/ordinances of the barangay concerned, but also in the
Memoranda of Agreement to be entered into by the City Government of Pasig with the
thirty (30) barangays on the collection and remittance of barangay clearance fees and
issuance of barangay permits at the city level.
