Reasons for laws (Pg 71)

1. Laws are system of rules which a particular country or community recognizes as regulating the
actions of its members and which it may enforce by the imposition of penalties.

2. Sports rules are rules that when broken have lot less harsher penalties and a very simple discipline
system. The law of the land involves a very complex justice legal system and very harsh penalties for
the person that commits the crime such as jail time or a very heavy fine. In some extreme cases, the
school might actually get the police involved if a extremely serious offence is committed such as
weaponary.

3. The term “anarchy” means that society cannot function due to war reasons which as a result
society is free to do whatever they want to do to any other person without legally getting into
trouble with the law.

4. Society needs laws because to protect society from danger and harm from certain individuals. It is
also to keep society in order and settled when an emergency situation breaks out such as war or
environmental reasons.

5. If I ruled Australia, I would try to introduce some new traffic laws for police officers such as
allowing the driver to see what they’ve done wrong with the camera footage. I would choose to
promote this law because some police officers just pull people over for money and they’ve haven’t
actually done anything wrong so when I promote the law, it will stop police officers doing their tricks
to drivers that haven’t done anything wrong.

The law allows you to: The law doesn’t allow you to:
- Have protection from harm or dangerous - Behave in such a way that harms the safety of
individuals other individuals.
- Act freely in freedom - Commit crimes such as murder, rape, racism,
scams, etc.
- Resolve disputes - Do freely to do whatever you want

The legal system (Pg 73)

1a) This expression “might is right” means that even the person could’ve or couldn’t done it, the
person was still accused of committing the crime.

1b) This system of resolving disputes is really unfair to most people because there could be no
evidence towards the convicted (accused person) which makes the trial unfair.

1c) A comprehensive legal system allows the accused to have a fair trial and response to the jury.

2. The role of the police in our society is to enforced the laws that all people must obey, prevent and
detect crime, protect life and property and maintain peace and order within society.
3. If police went on strike, our society would become out of order which as a result allows society to
become dysfunctional and feel free to do whatever what they want.

The court structure – Hierarchy (Pg 75)

1. The four different levels of courts are The local court, The district court, The supreme court and
The high court.

2. We have a number of courts in Australia because it depends the state where you live in and the
nature of the legal dispute.

3. The highest court in Australia is The High Court.

4. Courts are necessary in our society because they help protect the person’s constitutional rights
and protect the person from a certain individual.

5a) A murder trial would most likely be heard in a supreme court.

5b) An appeal from the NSW supreme court would most likely be heard from The High Court.

5c) A hearing for a minor traffic offence would most likely be heard from The Local Court.

5d) An investigation into a suspicious death would most likely be heard from The Supreme Court.

5e) An armed robbery trial would most likely be heard from The District Court.

5f) The preliminary hearing of a rape case would most likely be heard from The District Court.

5g) A civil dispute between business partners involving $100 million would most likely be heard from
The Supreme Court.

5h) A case dealing with an aspect of the Australian Constitution would most likely be heard from The
High Court.

6. A judge is the person who hears more complicated cases such as a suspected murder while
magistrates hear smaller, minor cases such as traffic offences.
