consistently, thoroughly with absolute excellence. If they hadn’t fired me, that is what I would
be doing today.

-And they don’t wanna fire you for having AIDS, so in spite of your brilliance, they made you
look incompetent thus the mysterious lost file, Is that what you are trying to tell me?

-Correct, I was sabotaged.

-The federal vocational rehabilitation act of 1973 prohibits discrimination against otherwise
qualified handicapped persons who are able to perform the duties required by their
employment, although the ruling did not address the specific issue of HIV and AIDS
discrimination subsequent decisions have held that AIDS is protected as a handicap under law,
not only because of the physical limitations it imposes, but because the prejudice sorrounding
AIDS exacts a social death which Britain seed, which precedes the actual physical one.

-This is the essence of discrimination, formulating opinions about others not based on the
individual merits, but rather on their membership in a group with assumed characteristics…

know that they’re looking at me and thinking about it, so let’s just get it out in the open.
Let’s get it out of the closet because this case it’s just not about AIDS, so let’s talk about
what this case is really all about, the general public's hatred... our loathing, our fear of
homosexuals and how that climate of hatred and fear translated into the firing of this
particular homosexual, my client and Rebbeca.

- In this courtroom Mr Miller, justice is blind. To matters of race, creed, color, religion and
sexual orientation.

- Your honor. If Andrew was forced to use a wheelchair due to his illness would the defense
ask him to park it outside because it would unfairly influence the jury? Come one, we’re
talking about AIDS, we're talking about lesions. Let’s see what we’re talking about.

Defense

Considering that it has not yet been defined what is involved in suffering from a disease
such as HIV, it is very premature to judge an individual who, in addition to being judged
for his or her sexual orientation, is also judged for his condition, denying him or her the
right to work which, according to the Federal Vocational Rehabilitation Act of 1973,
described in the file, AIDS is protected as a disability by law, not only because of the
physical limitations it imposes but also because the prejudice that surrounds AIDS causes
a social death that precedes actual physical death. From this, it is unfair the way my client
has been accused of deteriorating his physical and mental integrity, which are paramount to
the resolution of this case before the Supreme Court.

Now, I turn to the jury, is it right or even necessary to judge someone by his or her sexual
preferences, taking his or her illness as an excuse? People should express themselves freely
without fear, as long as they do not cross the boundaries of the environment of other
members of society around them. In other words, no one should change their natural way of
being, of living, of expressing love. On the other hand, the injuries caused by this silent
killer show, in the eyes of those present in this courtroom, the vulnerability of the human
being, which does not mean that in order to contract a disease of this type, one has to be
homosexual. Furthermore, homosexuality has existed, exists, and will exist, becoming an
unnatural subject in the eyes of society, which should not be related to the symptoms of
HIV.

My goal as a counselor in this trial is to prove that my client is not guilty of the disease in
question and to ask you to maintain your objective opinions to the end. Thank you.
