Please find attached herewth Notice dated: 17.08.2017 issued by Sta Selection Commission (SSC) in consultation with
DoPT and Department of Legal affairs regarding submission of OBC Certificate by the candidates.
In this connection, itis informed that SSC was eartier prescribing that the OBC Certificate in the prescrived format issued
within 3 years before the last date of receipt of applications and upto 180 days after the closing date of receipt of application
‘would be considered by the Commission.
‘The Staff Selection Commission in consultation wth DoPT and Dept. of Legal Affairs, Keeping in view the dficulties faced
by the candidates and in view of Order of Hon'ble Supreme Court of indian SLP No. 3116/2017 in the matter of UOI Vis
‘Abdul Rasheed, has decided vide Notice dated: 17.08.2017 that w.e 23.01.2017 the Commission (SSC) will nat insist on
candidates for producing OBC Certificate issued within the cut off dates ie. 3 years before the last date of receipt of
plications and upto 180 days after the closing date of application. Further in cases where final result was declared after
23.01.2017 ors yet to be declared, the candidates may furish prima facie proof of being OBC, i already not produced, to
tenable the Commission to considerfprocess their claim under the OBC category. The candidature of OBC candidates will
‘remain provisional; subject to verification of hislher claim by the User Department concemed as Appointing Authority, as
per the extant Govt. provisions/guidelines on the subject,
Further as per DoPT letter No. 36011/1/2012-Estt (Res.), dated14.03.2016, where a candidate belonging to SC, ST or OBC
category is unable to produce a certificate from any ofthe prescribed authorities, helshe may be appointed provisionally on
the basis of whatever prima-facie proof helshe is able fo produce in support of hisher claim, subject to hishher furnishing
the prescribed certificate within a reasonable time,
Ithas been decided to adopt the above guidelines of SSC which are issued in consultation with DoPT for considering the
aims of candidates under OBC category in ESIC. As such all the Appointing Authorities in ESIC are advised that
‘candidates under OBC category may be considered for selecon/appointment on the basis of prima facie proof of being
belonging to OBC category. Further the candidature of OBC candidates will remain provisional; subject to verification of
hisiher cizim by the concemed Appointing Authory, as per the extant Gov. provisions/guidelines onthe subject.

Candidates may refer to the provisions in the Commission’s earlier Notices of various
Examinations, which inter-alia prescribed that the OBC Certificate in the preseribed format
issued within Three years, before the last date of receipt of applications and up to 180 days
after the closing date of applications would be accepted by the Commission.
2, [thas been observed by the Commission that the candidates were facing difticulties in
producing the OBC Certificates in the prescribed format within the cut off date specified in
the Notices. Some of the candidates had also challenged the above provisions in various
Couns.
3. Keeping in view the difficulties tuced by the candidates and the Order of Hon'ble
Supreme Court in SLP No, 3116/2017 in the matter of Union of india vs Abdul Rasheed, the
Commission took up the matter regarding relaxation in the stipulated time limit (as indicated
‘at para | above) with the Department of Personnel & Training, The Department of Personnel
& Training in consultation with Department of Legal Affairs, endorsed the followi
decisions of the Commission as given below:~
(i). With effect from 23.01.2017, fie the date of dismissal of SLP No, 3116/2017 filed by
the Commission in the Hon’ble Supreme Court of India (UOI vs Abdul Rasheed} the
Commission will not insist on eandidates producing OBC Certificates issued within the
cut off dates ie, 3 years, before the last date of receipt of applications and up to
180 days after the closing date of applications mentioned in the Notices.
Gii)_ Tn cases where document verification has already been completed and the final result
was declared after 23.01.2017 or iy yet to be declared, the candidates may furnish
prima facie prool of being O3C, if already not produced, to enable the Commission to
consider/process their claim uxder the OBC category.
(iii) ‘The candidature of OBC candidates will remain provisionals subject to verification of
his/her elaim by the User Department concerned as Appointing Authority, as per
the extant Government provisions/guidelines on the subject
(iv) Is categorically stated that the Commission shall nol reopen cases where the final
result has already been declared before 23.01.2017.
