Tutorial – Non-fatal offences

1) One evening, Jane, a 17 year-old girl, was walking to the night market in Bukit
Beruang with her younger sister Honey, aged 11. Suddenly a van drove by Bill pulled
over next to them. Albert, the passenger, asked Jane for the direction to MMU.
Pretending not to be familiar with the area, Albert and Bill asked if Jane and her sister
could come with them in the van to show the place. The two girls agreed and got into
the van. However, instead of going to MMU, Bill took the girls to his apartment and
locked them in one of the room. Bill then contacted the girls’ parents, Tan Sri Bob and
told him that he is holding their daughters. He ordered Tan Sri Bob to accept a tender
applied by Syarikat DEF in order to secure the safety of his children.

After four days in captivity, Jane managed to unlock the door and got help from the police.
They were sent to Hospital Melaka for check up and the doctor notified the police that a
fresh tear inside Honey’s vagina was found and the doctor suspected that she had a
sexual intercourse within 48 hours before she was saved by the police. Jane told the
police that she could identify Albert entered their room during that period and sat on
top of Honey but she could not do anything as Albert had threatened to kill them both if
they retaliated.

Discuss the offence/s committed by Albert and Bill.

Abduction

2) Mike and Mariah have divorced and the custody of their two children, Hannah and
Haris, were given to Mariah. One evening, Mike called Hannah, a 18 years old girl, and
offer to take her and her brother Haris, aged 11 for a picnic. Both of them silent ly sneaked
out without the knowledge of Mariah. Instead of going for a sight-seeing, Mike took them
to his apartment, which was against the court order, and locked them in a room. Mike
then contacted Mariah and told her that he wanted RM 80,000 or else she will never see
her kids anymore. After two days in captivity, Hannah managed to unlock the door when
Mike was not around. The two quietly sneaked out of the room. As they were exiting the
apartment’s door, suddenly Mike arrived at the apartment stopped them from running away.
He then dragged them back into the room. The two remained in the room for the next six
days until the police came to rescue them.
