Problem No. 6 Original Petition

Sunil Sharma got married with Sukanya in Jan 2018 at Pune. Out of the said wedlock they have a son
viz., Chintu of one year old. Sunil Sharma is working as Software engineer at Mumbai, earning nice
income. After 2 years of marriage Sunil Sharma started ill-treating and neglecting his wife and the
child. It is learnt that Sunil Sharma is having an illicit relation with one Shanaya. Ultimately Sunil
Sharma drew his wife and the child out of the house in August 2020. Since then Sukanya is living
with her parents at Nagpur along with her son. She wants to file a petition for divorce. Draft an
appropriate petition for her.

Problem No. 7 Execution Petition

Chandappa Arlikatti had filed a suit for recovery of money against Suraj for Rs. 3, 50,000/- (Rupees
Three lakh fifty thousand only) on the file of VII Addl. Civil Judge (Jr.Dn) at Prayag. The said suit
has been decreed on 14.7.2020 directing the defendant to pay the decretal amount with an interest @
12% p.a. within 1 month from the date of judgment. The court has also awarded a cost of Rs. 2000.
Suraj failed to repay the amount as directed by the court. Now Chandappa wants to enforce the said
decree. Draft an appropriate petition for him.

Problem No. 8 Writ Habeas corpus

Narahari is a businessman carrying on business in home appliances at city market Delhi. On

11/12/2020 Narahari went to city market police station on getting a call from the Sub-Inspector. When
Narahari went there he was informed that the Police Commissioner has passed an order dt.
10/12/2020 directing the detention of Narahari under Immoral Traffic Act. However, no order copy
was served on him. Since 11/12/2020 Narahari is missing. His wife Smt. Sumangala has filed a
complaint before a police station for his search but no action has been taken so far. Now she wants to
file a writ for the release of her husband. Prepare an appropriate writ petition for her.

Problem No. 9 Writ Certiorari (PIL)

Govt of Karnataka by a notification dt. 15.6.2020 assured supply of 24/7 drinking water to Koppal
Dist. Later by another notification dt. 10.11.2020 it had cancelled earlier notification. ‘Suchitva’ an
NGO desires to challenge the said action. Draft an appropriate Writ Petition.
Problem No. 10 CRP

Mr. Shamlal has filed a suit in S.C. No. 345/2018 on the file of XI Addl. Civil Judge (Sr. Dn.) at
Belagavi for ejectment and recovery of arrears of rent of Rs. 21000/- against Tammanna in respect of
1 BHK house bearing no 51/2 situated at Roshan galli, Belagavi. The suit was dismissed by the court
of Small Causes by its judgement dated 14.11.2020. now Mr. Shamlal wants to challenge it before the
High Court. Draft an appropriate petition for him.
