Executive summary: This document proposes to modify the draft amendments to


regulations 2 and 14 of MARPOL Annex VI set out in

Background

1 MEPC 74 noted that PPR 6 had agreed to the draft amendments to MARPOL
Annex VI to support consistent implementation of the 0.50% sulphur limit. The Committee also
considered document MEPC 74/10/11 (IBIA and IPIECA). Following consideration, the
Committee established the Working Group on Air Pollution and Energy Efficiency and
instructed it to finalize the draft amendments to MARPOL Annex VI. The Committee
subsequently approved draft amendments to regulations 1, 2, 14 and 18, and
appendices I and VI of MARPOL Annex VI, with a view to adoption at MEPC 75 (MEPC 74/18,
paragraphs 5.2 to 5.6 and 5.114 to 5.116).

2 This document proposes some editorial modifications to draft amendments to


regulations 2 and 14 and appendix VI of MARPOL Annex VI.

The terms "MARPOL delivered sample", "In-use sample" and "Onboard sample"

3 The terms "MARPOL delivered sample", "In-use sample" and "Onboard sample" are
defined in paragraphs 54 to 56 of draft amendment to regulation 2. These terms are used in
the draft amendment to Appendix VI as follows:

"This appendix refers to the following representative MARPOL Annex VI fuel oil
samples:

Part 1 – sample of fuel oil delivered in accordance with regulation 18.8.1,


hereafter referred to as the "MARPOL delivered sample" as defined in
regulation 2.54.

Part 2 – sample of fuel oil in use, intended to be used or carried for use on
board in accordance with regulation 14.8, hereafter referred to as the 'in-use
sample' as defined in regulation 2.55 and "onboard sample" as defined in
regulation 2.56.

Part 1 – MARPOL delivered fuel oil sample

1 General Requirements

1.1 The representative fuel oil sample, which is required by regulation 18.8.1
(the MARPOL delivered sample) shall be used to verify the sulphur content of the
fuel oil delivered to a ship."

4 On the other hand, the phrase "the in-use or onboard fuel oil sample" and the terms
"the in-use fuel oil sample" and "the onboard fuel oil sample" are used in paragraph 8 of draft
amendment to regulation 14. Furthermore, the phrase "in-use and onboard fuel oil samples"
and the term "MARPOL delivered fuel oil sample" are used in draft amendment to Appendix VI.

5 To retain consistency, it is deemed appropriate to modify the draft definitions, i.e.


paragraphs 54 to 56 of regulation 2, and the above-mentioned text of draft amendment to
appendix VI as follows:

"54 MARPOL delivered fuel oil sample means the a sample of fuel oil delivered
in accordance with regulation 18.8.1 of MARPOL Annex VI.

55 In-use fuel oil sample means the a sample of fuel oil in use on a ship.

56 Onboard fuel oil sample means the a sample of fuel oil intended to be used
or carried for use on board that ship."

and

"This appendix refers to the following representative MARPOL Annex VI fuel oil
samples:

Part 1 – sample of fuel oil delivered in accordance with regulation 18.8.1,


hereafter referred to as the "MARPOL delivered fuel oil sample" as defined
in regulation 2.54.

Part 2 – sample of fuel oil in use, intended to be used or carried for use on
board in accordance with regulation 14.8, hereafter referred to as the ' "in-use
fuel oil sample" ' as defined in regulation 2.55 and "onboard fuel oil sample"
as defined in regulation 2.56.

Part 1 – MARPOL delivered fuel oil sample

1 General Requirements

1.1 The representative fuel oil sample, which is required by regulation 18.8.1
(the MARPOL delivered fuel oil sample) shall be used to verify the sulphur content of
the fuel oil delivered to a ship.

1.2 A Party, through its competent authority, shall manage the verification
procedure.

1.3 A laboratory undertaking the sulphur testing procedure given in this appendix
shall have valid accreditation in respect of the test method to be used.

2 Verification Procedure Part 1

2.1 The MARPOL delivered fuel oil sample shall be conveyed by the competent
authority to the laboratory. "

Application paragraph of in-use fuel oil sampling point

6 The draft new paragraph 11 of regulation 14 is as follows:

"11 For a ship constructed before entry into force of these requirements, the
sampling point(s) referred to in paragraph 10 shall be fitted or designated no later than
the first renewal survey that occurs 12 months or more after the entry into force of this
regulation."

7 For clarification, it is deemed appropriate to specify the exact date in the draft
amendment, taking into account that the phrase "the entry into force of this regulation" is
vague. In view of this, Japan considers that the following modification is appropriate:

"11 For a ship constructed before entry into force of these requirements [the date
of entry into force of this amendment], the sampling point(s) referred to in
paragraph 10 shall be fitted or designated no later than the first renewal survey that
occurs 12 months or more after the entry into force of this regulation carried out on or
after [the date of entry into force of this amendment plus 12 months]."

Action requested of the Committee

8 The Committee is invited to consider the modifications provided in paragraphs 5 and 7


and take action as appropriate.
