TERMS AND CONDITIONS FOR THE USE OF AUTOSWEEP RFID


By affixing my signature below, I, (‘the Subscriber”) in consideration of the terms and conditions for the use of AUTOSWEEP RFID tag, the Skyway O&M Corporation (SOMCO)
and Manila Toll Expressway System (MATES), grants me the privilege to avail of the electronic toll collection (ETC) services thru the use of AUTOSWEEP RFID sticker as provided by Citra
Metro Manila Tollways Corporation (CMMTC)in relation to the interoperability agreement with South Luzon Tollway Corporation (SLTC) hereby agree to abide with the terms and
conditions stipulated in this agreement as clearly explained by an authorized Representative:

1. Provision for the use of the AUTOSWEEP RFID sticker:


1.1. The subscriber shall use only one (1) Autosweep RFID sticker for each enrolled vehicle throughout the duration of this agreement.
1.2. The subscriber shall be assigned a unique Account Number for identification and reloading.
1.3. The Autosweep RFID sticker shall be mounted on the enrolled vehicle only by authorized tollways representatives.
1.4. The Autosweep RFID sticker is NON-TRANSFERABLE.
1.5. Multiple tags may be applied for under a single Autosweep RFID account (Article 2).
1.6. The Autosweep RFID account is a pre-paid account and can be reloaded through the reloading facilities listed at the Autosweep RFID website www.skywayslexrfid.com.
1.7. The use of the Autosweep RFID sticker/s shall be limited to electronic toll collection (ETC) lanes only.
1.8. The toll charges incurred by the Subscriber shall be automatically deducted from his Autosweep RFID Account.
1.9. The subscriber can view and download his Autosweep RFID statement of account from the Autosweep RFID website www.skywayslexrfid.com.
2. Subscription Arrangement
2.1. Account Options:
1 Account Per Vehicle : One (1) Autosweep RFID Account per Vehicle. Balance of the account is designated to one (1) enrolled vehicle only.
1 Account for ALL Vehicles: One (1) Autosweep RFID Account, Multiple Autosweep RFID stickers individually assigned to multiple enrolled vehicles. The balance of the
account is shared by all vehicles enrolled in the account.
3. Required Documentations. Incomplete documents will not be processed.
Personal Account. The client must present the following:
3.1.1. Duly filled up forms - Signed Autosweep RFID subscription form and signed Terms and Condition.
3.1.2. Photocopy of one (1) valid ID (driver’s license, SSS, TIN or Passport; with picture & signature) with original signature on the side.
3.1.3. Photocopy of the latest valid Official Receipt (OR) & Certificate of Registration (CR) of the vehicle to be enrolled
3.1.3.1. If you are the not the registered owner, please present proof of vehicle ownership (deed of sale) or authorization letter from the registered owner allowing
you to register the vehicle and create an Autosweep RFID account under the user’s name.
3.1.3.2. Valid ID of the registered owner and the assignee (user)
3.1.3.3. For newly purchased vehicle, a photocopy of the vehicle’s sales invoice issued by the car dealer can be submitted during enrollment. The copy of the OR & CR
MUST be submitted to Tollways Representative within fifteen (15) days after the registration date.
Business Account. The client must present the following:
3.1.4. Duly filled up and signed Autosweep RFID subscription form and terms and condition by the company’s President or his Authorized Representative.
3.1.5. Photocopy of the OR & CR of the vehicle/s to be enrolled.
3.1.5.1. If the vehicle is not registered under the company, proof of vehicle ownership is required such as deed of sale or authorization letter from the registered
owner authorizing the company to register the vehicle and create an Autosweep RFID account under the company’s name.
3.1.5.2. For newly purchased vehicle, a photocopy of the vehicle’s sales invoice issued by the car dealer can be submitted during enrollment. The copy of the OR & CR
MUST be submitted to Tollways Representative within fifteen (15) days after the registration date.
3.1.6. Business Permit &DTI/SEC Registration
3.1.7. Secretary’s Certificate or Letter of Authority of the Authorized Representative.
3.1.8. Photocopy of one (1) valid ID of the Company President (driver’s license, SSS, TIN, and Passport) and his Authorized Representative with original signature on the side.
Note: Subscriber must keep his/her contact information updated. Any update on the contact details must be communicated to RFID Customer Care (Article 16).
4. Applicable Fees.
4.1.1. Initial load requirement during enrollment per sticker per class: Class 1 – P500, Class 2 – P1,000, Class 3 – P1,000)
4.1.2. The cost per tag is Two Hundred Pesos (P200.00). The same amount shall be paid by the subscriber for every tag replacement not covered by warranty.
4.1.3. The cost per card is One Hundred Pesos (P100.00). The same amount shall be paid by the subscriber for every card replacement.
4.1.4. An annual subscription fee of Fifty Pesos (P50.00)per account shall be charged directly to the subscriber’s account every subscription anniversary date.
5. Maintaining Balance& Threshold Balance (Low Balance) - The subscriber whose account has fallen below the prescribed maintaining balance shall not be given access to pass the
AUTOSWEEP RFID lanes. In case the subscriber’s account has reached this status, the account may be temporarily deactivated if he fails to replenish the account and the subscriber
must load his account immediately before passing the electronic toll collection (ETC) lanes to avoid the inconveniences (Article 6) otherwise the subscriber must use the cash lane
until his AUTOSWEEP RFID account is replenished. The threshold balance is the amount that triggers the need to replenish the account. Maintaining balance : Class 1 - P100, Class 2
- P200, Class 3- P300. Minimum threshold is P500/account or threshold defined by Tollways applicable to motorist.
6. Loading your Account. The subscriber must ensure that his account has sufficient load by monitoring the balance of his account regularly before passing through the tollgate. The
subscriber must reload his account immediately once the balance is about to reach or reaches the threshold (low balance) to avoid inconvenience. The AUTOSWEEP RFID account

may be loaded in any of the available loading stations. Convenience fee arising from the processing of reloads by the merchant partner shall be for the account of the RFID
subscriber. The complete list of AUTOSWEEP RFID loading stations shall be provided during enrollment and also enumerated in the AUTOSWEEP RFID customer care portal
www.skywayslexrfid.com.
6.1. Note: For Auto Debit Arrangements, e.g. Credit Card, please complete the Authority to Charge form and submit the originally signed form to the Authorized RFID Tollway
Representative along with the photocopy of the front face of your card for encoding and activation of ADA enrollment. Any changes in the ADA subscription requires re-
application.
7. Proper Handling of the AUTOSWEEP RFID Sticker. Throughout the term of this Agreement, the subscriber shall be responsible for the proper handling of the Autosweep RFID tag.
The subscriber shall ensure that the Autosweep RFID sticker is properly installed on his vehicle at all times. ONLY Tollways Authorized Representatives are allowed to perform the
mounting of the appropriate Autosweep RFID tag. The Subscriber shall not remove, tear, cut, transfer or alter whatsoever the Autosweep RFID sticker from the enrolled vehicle/s
under any circumstance. The following should be avoided in order to preserve the tag: (a) Use of harsh detergent on the tag during car wash (b) Heavy rubbing on the tag (c) Other acts
that may cause damaged to the tag.
8. Damaged or Defective Sticker .The subscriber must ensure proper care of the tag. In case of damaged/defective Autosweep RFID sticker, the subscriber must bring the vehicle to the
nearest Customer Service Center immediately for checking and possible tag replacement. Failure to do so may result to the tag becoming invalid and may be subjected to Article
12&13. Only Authorized Tollways Representatives are allowed to detach the Autosweep RFID sticker on the enrolled vehicle if needed.
9. Warranty. The Autosweep RFID sticker is covered by six (6) months warranty from the date of installation and shall be shall be limited to manufacturer’s defects only. Any damage to
the tag attributed to subscriber’s negligence/mishandling shall void the warranty of the Autosweep RFID sticker.
10. Transfer/Sale of Vehicle. The subscriber must notify the Tollways Customer Service by means of a written notice about the transfer or sale of the enrolled vehicle along with the
submission of the issued Autosweep RFID sticker and card for cancellation, otherwise the accountability of the Autosweep RFID sticker and its toll usages shall remain with the
original account holder.
11. Use in Electronic Toll Collection (ETC) Lanes. ONLY the designated Autosweep RFID lanes shall be used by the subscriber. Provided, however, that the subscriber’s Autosweep
RFID account has sufficient balance to cover his toll fees and the sticker is valid.
12. Unreadable Sticker. In case the subscriber’s AUTOSWEEP RFID sticker is not detected at the ETC lanes, the subscriber must obtain an Entry Toll Card and must pay the
corresponding toll fee in cash at the cash or mixed lanes during exit. Failure to do so may result in the following:
a) The subscriber shall be liable to pay the toll fee applicable to the highest toll/farthest entry to the actual exit toll plaza.
b) A penalty charge of P150.00 for not presenting the Entry Card as set forth by the Toll Road Operator, which may be adjusted by the Toll Road Operator from time to
time.
c) The subscriber may be subject to the penalties for violation of traffic laws, rules and regulations applicable to the toll ways (R.A. No. 2000 – Limited Highway Access Sec.10
and other laws applicable) and maybe issued Traffic Violation Ticket for Disregarding Traffic Signs (DTS), by using the Autosweep RFID lane when not qualified to do so.
The subscriber must report the incident to Tollways Customer Service immediately for verification or replacement (Article 8).
13. Suspension/ Cancelation / Blacklisting of Account. The AUTOSWEEP RFID account may be subject to suspension or blacklisting due to the following reasons:
a) Disrespecting Tollway personnel.
b) Failure to submit documents as may be required by Autosweep RFID personnel.
c) Unauthorized use, loss or unregistered Autosweep RFID card and/ or sticker.
d) Use of RFID card assigned on a different vehicle.
e) Use of an e-Pass/DSRC tag with an Autosweep RFID sticker in the same vehicle at the same time.
f) Not using the appropriate lane intended for Autosweep RFID customers.
g) Using an invalid tag at the Autosweep RFID lanes for more than two (2) incidents.
h) Continuous use of defective RFID sticker.
i) When the balance of the account becomes negative and the Subscriber fails to replenish his AUTOSWEEP RFID account within SEVENTY TWO (72) hours from the hour
of the last transaction that triggered the negative balance of the account.
14. Dormant / Inactive Accounts. The AUTOSWEEP RFID sticker that has not been utilized for over twelve months (12) months will be automatically deactivated. The AUTOSWEEP RFID
sticker that has been deactivated may be reactivated by informing the Autosweep RFID Customer Service (Article 16).
15. Reactivation & Penalty Fee. The Subscriber agrees to pay the reactivation fee and/or penalty fee amounting toP500 per account arising from Article 13 at any of the Tollways
Customer Service Center. The account maybe activated within 48 hours upon receipt of payment.
16. Complaints/Issues/Request/ Notices. The subscriber may elevate his request/ concerns thru:

17. Liability. The subscriber shall indemnify and hold Skyway and SLEX Management, its affiliates, and related parties, as well as their respective shareholders, directors, officers,
employees and representatives, directly or indirectly, free and harmless against any claim by, or from any liability to, any User or third party, for any loss, damage or liability arising
out of or in connection with this Agreement, including but not limited to those caused by any of the following:
a) Any delay, interruption, stoppage or error in delivery of the Autosweep RFID sticker caused by administrative, technical, mechanical, electronic, computer error or fault,
or any other reason or circumstance attributable to the improper use, care and/or safekeeping of the Autosweep RFID sticker by the Subscriber/User, and or beyond the
control of Skyway and SLEX Management, its employees, contractors, and representatives, including but not limited to such causes as government action, change in
legislation, force majeure or interference by third parties;
b) Unauthorized use of Autosweep RFID sticker installed in the registered vehicle, e.g. vehicle theft, unauthorized use, etc., without any form of notice (Article 16)
submitted by the subscriber to Tollways Management.
18. Right to Refuse / Changes in Terms and Conditions. The Management reserves the right to refuse, deny, disapprove and or cancel any application for an AUTOSWEEP RFID sticker
and is under no obligation to provide any reason for such decision. Tollways Management reserves the right to change, modifies, delete or add any item in the Agreement from time to
time and such changes shall be communicated to the Subscribers in any means possible prior to its effectivity. The Subscriber agrees to be bound by any revision of the terms and conditions of
the Agreement.
19. Data Protection. Disclosure of personal information by the Subscriber under this Agreement is voluntary. The collection of the customer’s information is to facilitate the Autosweep
RFID account management related to the collection of tolls, enable the Autosweep RFID Customer Care to handle customer related concerns and other services in compliance with the
Autosweep RFID account management.
a) The AUTOSWEEP RFID Subscription form includes data protection notice(or in the case of an online application, a Privacy Policy)
b) All information provided by the Subscriber shall be classified as confidential information upon which both parties may invoke privileged communication resulting from
practice of profession or business relation.

 I hereby certify that the information provided above is true, correct and complete. I voluntarily disclose my personal information for the fulfillment of my
Autosweep RFID account management. I understand that any false, misleading, incorrect or withheld information may cause the disapproval or termination of the
contract for the Autosweep RFID Services.
 I have read and clearly understood the above terms and conditions and freely and voluntarily agree to be bound by this agreement.

The convenience fee is collected in addition to the actual amount of reload for the RFID account made through the collection service provider which provide access at their sites and other branches.
However, the convenience fee does not form part of the collection of the Tollways companies but will go to the account of the Collection Service Provider.
