ORDINANCE GRANTING BENEFITS TO THE BEREAVED FAMILY OF THE

MEMBERS OF THE PHILIPPINE NATIONAL POLICE AND THE ARMED


FORCES OF THE PHILIPPINES WHO ARE RESIDENTS OF THE
MUNICIPALITY OF POLOMOLOK, SOUTH COTABATO AND DIED WHILE IN
THE PERFORMANCE OF THEIR DUTY.

Section 1. Short Title

This Ordinance shall be known as the “Benepisyo Alay sa Pamilya ng


Migigiting na Sundalo”.

Section 2. Objectives

The main objective of this Ordinance is to provide assistance to the


bereaved family of our fallen heroes who died or killed while in the performance
of their sworn duty as a member of the AFP, PNP, BFP and BJMP.

Section 3. Definition of Terms

The following words shall be defined, as used in this Ordinance, as


follows:

A. Armed Forces of the Philippines – is responsible for upholding the


sovereignty of the country, supporting its Constitution, and defending its
territory against all enemies. It is composed of the Philippine Army, the
Philippine Navy, and the Philippine Air Force.
B. Children – refers the the legitimate child, ages 6 to 21 years old, of the
fallen hero.
C. Duty- while in the performance of his official function as a member of the
AFP, PNP, BFP and BJMP.
D. Fallen Hero – pertains to the member of the AFP, PNP, BFP and BJMP
who died or killed while in the the performance of their sworn duty as a
member of the AFP, PNP, BFP and BJMP.
E. Family – this pertains to the bereaved legitimate family of the fallen hero.
F. Guardian – pertains to the overseer of the minor child of the fallen hero.
It could be the surviving spouse of the fallen hero or his next of kin.
G. Police – a personnel who is a member of the Philippine National Police. It
shall include the members of the Bureau of Fire and Protection and
Bureau of Jail Management and Penology.
Section 4. Body

A. Benefits for the Children

The children of the bereaved family shall be priotized in the grant of the
scholarship in the municipality. The scholarship may be granted from
Elementary up to College provided that the minimum requirements for
such scholarship are met. The scholarship grant may be withdrawn by the
Local Government Unit (LGU) if he/she fails to meet or maintain the
minimum requirements of the scholarship program.

B. Benefits for the Family

The breaved family shall be granted with one-time monetary assistance


worth ten thousand pesos (P 10,000.00). It shall be given to the legitimate
wife/husband. If the hero is single, it shall be given to his/her surviving
parents, if not available to his/her siblings or next of kin. If he/she has no
legitimate spouse but has children, it shall be given to such children
provided that he/she is atleast 18 years of age; if he/she is a minor, it shall
be given to his guardian.

Section 5. Separability Clause.

If, for any reason or reasons, any part or provision of this Code shall be held
to be unconstitutional or invalid, other parts or provisions hereof which are not
affected thereby shall continue to be in full force and effect.

Section 6. Repealing Clause.

The provisions of all local enactments, resolutions, executive orders,


memoranda, circulars and other issuances

Section 7. FUNDING. The funding for this Ordinance shall be taken from the
General Fund Annual Budget of the Municipality.

Section 8. IMPLEMENTING RULES AND REGULATION (IRR). The Office of


the Municipal Mayor shall pass the Implementing Rules and Regulation related
to the implementation of this ordinance within 60 days from its approval.

Section 9. EFFECTIVITY. This ordinance shall take effect immediately after


its posting in at least three (3) conspicuous places.

POLICE AND THE ARMED FORCES OF THE PHILIPPINES WHO ARE
RESIDENTS OF THE MUNICIPALITY OF POLOMOLOK, SOUTH COTABATO
AND DIED WHILE IN THE PERFORMANCE OF THEIR DUTY.

WHEREAS, Section 9, Article 2 of the 1987 Philippine Constitution provides


that the State shall promote a just and dynamic social order that will ensure
the prosperity and independence of the nation and free the people from poverty
through policies that provide adequate social services, promote full
employment, a rising standard of living, and an improved quality of life for all.

WHEREAS, sub-paragraph iv, paragraph 2, subsection b, section 17, Chapter


2, Title 1 of Republic act 7160 otherwise known as the Local Government Code
provides that the Municipality has the responsibility to provide social welfare
services which include programs and projects on child and youth welfare,
family and community welfare xxx;

WHEREAS, the passage of this Ordinance is our way of expressing our


gratitude to our fallen heroes who sacrificed their lives in the perfomance of
their sworn duty and we owe it to their family to provide them with
comfortable lives;

WHEREFORE, premises considered, on motion of SB Member, Eliazar G.


Jovero, duly seconded by ____ the SB members present, the Body.

RESOLVED, as it is hereby resolved, to pass a RESOLUTION ENACTING


THE ORDINANCE GRANTING BENEFITS TO THE BEREAVED FAMILY OF
THE MEMBERS OF THE PHILIPPINE NATIONAL POLICE AND THE ARMED
FORCES OF THE PHILIPPINES WHO ARE RESIDENTS OF THE
MUNICIPALITY OF POLOMOLOK, SOUTH COTABATO AND DIED WHILE IN
THE PERFORMANCE OF THEIR DUTY.
