AN ORDINANCE ESTABLISHING AND CREATING THE OFFICE OF THE

SENIOR CITIZENS AFFAIRS (OSCA) IN THE MUNICIPALITY OF


POLOMOLOK, PROVINCE OF SOUTH COTABATO.

Section 1. Title

This Ordinance shall be known as the “ORDINANCE ESTABLISHING AND


CREATING THE OFFICE OF THE SENIOR CITIZENS AFFAIRS (OSCA) IN THE
MUNICIPALITY OF POLOMOLOK, PROVINCE OF SOUTH COTABATO.”.

Section 2. Legal Basis.

Section 6 or Republic Act 9994, otherwise known as the Expanded Senior


Citizens Act of 2010  provides that there shall be established in all cities and
municipalities an OSCA to be headed by a senior citizen who shall be
appointed by the mayor for a term of three (3) years without reappointment but
without prejudice to an extension if exigency so requires. Said appointee shall
be chosen from a list of three (3) nominees as recommended by a general
assembly of senior citizens organizations in the city or municipality.

Section 3. Function of the OSCA.

The OSCA shall have the following functions:

a. To plan, implement and monitor yearly work programs in


pursuance of the objectives of this Act;

b. To draw up a list of available and required services which can


be provided by the senior citizens;

c. To maintain and regularly update on a quarterly basis the list


of senior citizens and to issue national individual identification
cards, free of charge, which shall be valid anywhere in the
country;

d. To serve as a general information and liason center for senior


citizens;

e. To monitor compliance of the provisions of this Act particularly


the grant of special discounts and privileges to senior citizens;

f. To report to the mayor, any individual, establishments,


business entity, institutions or agency found violating any
provision of this Act; and

g. To assist the senior citizens in filing complaints or charges


against any individual, establishments, business entity,

institution, or agency refusing to comply with the privileges under
this Act before the Department of Justice (DOJ), the Provincial
Prosecutor's Office, the regional or the municipal trial court, the
municipal trial court in cities, or the municipal circuit trial court.

Section 4. Administrative Provisions.

a. The head of the OSCA shall be appointed to serve the interest


of senior citizens and shall not be removed or replaced except
for reasons of death permanent disability or ineffective
performance of his duties to the detriment of fellow senior
citizens.

b. The head of the OSCA shall be entitled to receive an


honorarium of an amount at least equivalent to Salary Grade
10 to be approved by the LGU concerned.

c. The head of the OSCA shall be assisted by the City Social


Welfare and Development officer or by the Municipal Social
Welfare and Development Officer, in coordination with the
Social Welfare and Development Office.

d. The Office of the Mayor shall exercise supervision over the


OSCA relative to their plans, activities and programs for senior
citizens. The OSCA shall work together and establish linkages
with accredited NGOs POs and the barangays in their
respective areas.

Section 6. The OSCA Head

The Head of the OSCA shall have the following qualifications:

a. A Filipino citizen and resident of the Municipality or City for at least


one (1) year;
b. A registered voter of the municipality;
c. Able to read and write;
d. Must be physically and mentally capable of performing the tasks of
the OSCA Head;
e. A bonafide member of a duly registered senior citizens organization
which has a track record of at least three consecutive years;
f. Good moral character; and
g. At least high school graduate.

Section 7. Budget Allocation.

The Local Government Unit of Polomolok, South Cotabato through the


Sangguniang Bayan shall appropriate substantial amount for the operation
and Sustainability of senior citizens programs and activities.

Section 8. Separability Clause.

If, for any reason or reasons, any part or provision of this Code shall be held
to be unconstitutional or invalid, other parts or provisions hereof which are not
affected thereby shall continue to be in full force and effect.

Section 9. Repealing Clause.

The provisions of all local enactments, resolutions, executive orders,


memoranda, circulars and other issuances inconsistent with this Code are
hereby repealed or modified accordingly.

Section 10. Implementing Rules. Within 60 days from the passage of this
Ordinance in the Sangguniang Bayan, the Executive Department shall make
the Implementing Rules and Regulations (IRR) for the effectivity of the same.

Section 11. Effectivity Clause. – This Code shall take effect after fifteen (15)
days following the completion of its publication in any local newspaper of
general circulation.

MUNICIPALITY OF POLOMOLOK, PROVINCE OF SOUTH COTABATO.

WHEREAS, Section 11, Article XIII of the 1987 Constitution provides that
The State shall adopt an integrated and comprehensive approach to health
development which shall endeavor to make essential goods, health and other
social services available to all the people at affordable cost. There shall be
priority for the needs of the underprivileged sick, elderly, disabled, women, and
children;
WHEREAS, Section 2 of Republic Act 9257, otherwise known as the Expanded
Senior Citizens Act of 2003, provides that it is the declared policy of the State
to promote a just and dynamic social order that will ensure the prosperity and
independence of the nation and free the people from poverty through policies
that provide adequate social services, promote full employment, a rising
standard of living and an improved quality of life. In the Declaration of
Principles and State Policies in Article II, Sections 10 and 11, it is further
declared that the State shall provide social justice in all phases of national
development and that the State values the dignity of every human person and
guarantees full respect for human rights;
WHEREAS, paragraph xvii, sub-section 5, section 447, Article 3 Chapter 3,
Title 2, Book 3 of the Republic Act 7160 otherwise known as the Local
Government Code provides that the municipality shall establish a municipal
council for the elderly which shall formulate policies and adopt measures
mutually beneficial to the elderly and to the community; provide incentives for
non-governmental agencies and entities and, subject to the availability of
funds, appropriate funds to support programs and projects for the benefit of
the elderly;
WHEREAS, there is the need to prioritize the elderly in the municipality and to
provide them with proper care and assistance during the twilight of their lives.

NOW, THEREFORE, on motion of Hon. Eliazar G. Jovero, duly seconded by

RESOLVED, as it is hereby resolved, to enact this Ordinance entitled: AN
“ORDINANCE ESTABLISHING AND CREATING THE OFFICE OF THE
SENIOR CITIZENS AFFAIRS (OSCA) IN THE MUNICIPALITY OF
POLOMOLOK, PROVINCE OF SOUTH COTABATO.”
