WHEREAS, it is the policy of the State to promote full employment and equality of
employment opportunities for all, strengthen and expand the existing employment facilitation
service machinery of the government particularly at the local levels;
WHEREAS, Section 3 of RA 8759, stipulated that there shall be established in all capital
towns of provinces, key cities and other strategic areas a Public Employment Service Office,
hereinafter referred to as "PESO," which shall be community-based and maintained largely by
local government units (LGUs) and a number of nongovernmental organizations (NGOs) or
community-based organizations (CBOs) and state universities and colleges (SUCs). The PESOs
shall be linked to the regional offices of the Department of Labor and Employment (DOLE) for
coordination and technical supervision, and to the DOLE central office, to constitute the national
employment service network.;
WHEREAS, Republic Act No. 10691 was passed amending for the purpose sections
3,5,6,7 and 9 of Republic Act No. 8759, otherwise known as the Public Employment Service
Office Act of 1999;

WHEREAS, Section 1 of RA 10691 stipulated that Section 3 of Republic Act No. 8759,
otherwise known as the “Public Employment Service Office Act of 1999”, is hereby amended to
read as follows:
“SEC. 3. Establishment of the Public Employment Service Office. – To carry out the
above declared policy, there shall be established in all provinces, cities, and municipalities a
Public Employment Service Office, hereinafter referred to as ‘PESO’, which shall be operated
and maintained by local government units (LGUs). The PESOs shall be linked to the regional
offices of the Department of Labor and Employment (DOLE) for coordination and technical
supervision, and to the DOLE central office, to constitute the national public employment service
network.
“The PESO shall be under the office of the governor, city or municipal mayor. The PESO
shall be initially organized by and composed of a PESO manager and may be assisted by a labor
and employment officer (LEO) as may be determined by the LGU.
WHEREAS, Section 16 of the Local Government Code of 1991, every local government
unit shall exercise the powers expressly granted, those necessarily implied there from, as well as
powers necessary, appropriate, or incidental for its efficient and effective governance, and those
which are essential to the promotion of the general welfare;
WHEREAS, Section 17 of the Local Government Code of 1991, local government units
shall endeavor to be self-reliant and shall continue exercising the powers and discharging the
duties and functions currently vested upon them. They shall also discharge the functions and
responsibilities of national agencies and offices devolved to them;
WHEREAS, Section 76 of the Local Government Code provides that “Every Local
Government Unit shall design and implement its own organizational structure and staffing
pattern taking into consideration its service requirements and financial capability, subject to the
minimum standards and guidelines prescribed by the Civil Service Commission;
WHEREAS, Section 443 (c) of the Local Government Code likewise provides that “The
Sangguniang Bayan may: (1) maintain existing offices not mentioned in subsection (a) and (b)
hereof (mandatory and optional position); (2) create such other offices as may be necessary to
carry out the purposes of the LGU, or (3) consolidate the functions of any office with those of
another in the interest of efficiency and economy”;
WHEREAS, under Section 447 (vii) of the Local Government Code, it is the
responsibility of the Sangguniang Bayan to determine the powers and duties of officials and
employees of the Municipality subject to the relevant positions of the Code;
WHEREAS, Section 447 (vii) empowers the Sanguniang Bayan to determine the
positions and salaries, wages, allowances and other emoluments and benefits of the officials and
employees paid wholly or mainly from municipal funds and provide for expenditures necessary
for the proper conduct of program, projects, services, and activities of the LGU;
Section 2. Functions of the MPESO – The main functions of the MPESO shall be in
accordance with Section 2 of RA 10691 which amends Section 5 of RA 8759.
“(a) Encourage employers to submit to the PESO on a regular basis a list of job vacancies in their
respective establishments in order to facilitate the exchange of labor market information between
job seekers and employers by providing employment information services to job seekers, both
for local and overseas employment, and recruitment assistance to employers;
“(b) Develop and administer testing and evaluation instruments for effective job selection,
training and counselling;
“(c) Provide persons with entrepreneurship qualities, access to the various livelihood and self-
employment programs offered by both government and nongovernment organizations at the
provincial, city, municipal and barangay levels by undertaking referrals for such program;
“(d) Undertake employability enhancement trainings or seminars for job seekers, as well as those
who would like to change career or enhance their employability;
“(e) Provide employment or occupational counselling, career guidance, mass motivation and
values development activities;
“(f) Conduct pre-employment counselling and orientation to prospective local and, most
especially, overseas workers;
“(h) Prepare and submit to the Local Sanggunian an annual employment plan and budget
including other regular funding sources and budgetary support of the PESO; and
“(i) Perform such functions as to fully carry out the objectives of this Act.”
Section 3. Funding – The MPESO shall have a regular budget allocation from the LGU
of Cagdianao in accordance with the existing laws, rules, and regulations.
Section 4. Manpower – The MPESO shall be manned by permanent staff. The following
permanent positions shall be created:
Section 5. Office Space – There shall be an office space for the MPESO within the
Bayay Lungsod nan Cagdianao. The office shall be strategically located to for the easy access of
its services.
If any provision of this ordinance is held invalid or unconstitutional, other provisions not
affected thereby shall continue to be in full force and effect.

This Ordinance shall take effect after fifteen (15) days posting and publication.
