EXECUTIVE ORDER NO. 007- 2022

AN ORDER RECONSTITUTING THE MUNICIPAL AFRICAN SWINE FEVER


TASKFORCE (ASF-TF), PROVIDING POWERS THEREOF AND ORDERING THE
MONITORING ON THE TRANSPORT OF LIVE ANIMALS, MEAT PRODUCTS, AND
MEAT BY-PRODUCTS INTO THE MUNICIPALITY OF POLOMOLOK.

WHEREAS, the African Swine Fever (ASF) is a very contagious disease affecting domestic and
wild pigs, with a case-fatality rate approaching 100%, caused by a resistant virus with no
developed cure to date, resulting to industry estimate of 36% reduction of national swine
inventory impacting both livelihood and agriculture economy;

WHEREAS, Republic Act 9296 as amended by R.A. 10536, otherwise known as “Meat
Inspection Code of the Philippines” was enacted to enforce the meat inspection and control in the
country. Further, it is a policy of the State  to: promulgate specific policies and procedures
governing the flow of food animals, meat and meat products through the various stages of
marketing and the proper preservation and inspection of such products; ensure food security and
provide safety and quality standards for consumer products related to agriculture to assure the
protection of the public against unreasonable risks of injury and hazards to health; and support
local government units in their endeavor to be self – reliant and to continue exercising the
powers and discharging the duties and functions currently vested upon them;

WHEREAS, section 16 of R.A. 7160, otherwise known as the Local Government Code of 1991,
states that every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of general
welfare;

WHEREAS, Department of Agriculture issued Administrative Order No. 08, Series of 2019, as
amended by DA AC No. 2 of 2022, provides for the revised guidelines on the local movement
of swine, pork, pork products and pork by-products outside the disease outbreak areas;

WHEREAS, President Rodrigo Roa Duterte issued Administrative Order No. 22, series of 2020
dated February 5, 2020 directing all government agencies and local government units to strictly
implement and comply with the “National Zoning and Movement Plan for the African Swine
Fever”;

WHEREAS, the Department of Agriculture-Bureau of Animal Industry Memorandum Order


No. 04, Series of 2019, provides for the necessity to regulate the entry and movements of live
animals, meat, and meat products to ensure food safety and security. Further, the Department of
Agriculture Administrative Order 7 of 2021 provides for the implementing guidelines for the
“Bantay ASF sa Barangay (BABay ASF) Program,” which was enacted to intensify disease
response of the government against ASF, where the DA, academe, private stakeholders and
swine industry experts provide technical and support services to empower Local Government
Units (LGU) in the implementation of the “Bantay ASF sa Barangay Program” interventions at
the farm and community levels;

WHEREAS, Department of Interior and Local Government (DILG) – DA Joint Memorandum


Order No. 1 of 2022 directs all municipal mayors to implement the “Bantay ASF sa Barangay
Program”;

WHEREAS, Executive Order 34-A series of 2022 of the Provincial Government of South
Cotabato provides for the regulation and restrictions in the movement or transport and trade of
live pigs, pork, pork products including board semen in affected and non-affected areas with
ASF in the municipalities and city in the Province of South Cotabato;

WHEREAS, there is a possibility that ASF may gain entry in the Municipality and may cause
the swine population to be at risk of infection thereby affecting the livelihood of hog raisers as
well as the swine industry in the Municipality;

WHEREAS, to protect the public as well the swine industry of the Municipality, there is a need
for an urgent, immediate, collaborative actions, responses and preventions such as the necessary
dissemination of policies, guidelines and precautionary measures for the temporary banning of
the entry of live hogs, imported and local pork, and pork by-products, whether raw, processed or
cooked, but not limited to frozen boar semen from ASF infected areas;

NOW THEREFORE, I, BERNIE D. PALENCIA, Municipal Mayor of the Municipality of


Polomolok, by the powers vested in me by the law, do hereby order reconstitute the Municipal
African Swine Fever Taskforce (ASF-TF), providing powers thereof and ordering the monitoring
on the transport of live animals, meat products, and meat by-products into the Municipality Of
Polomolok.

Section 1. Composition

The Municipal African Swine Fever Taskforce (ASF-TF) shall be composed of the following:

Section 2. Functions.

1. To monitor the transportation and entry of live animals, meat products and meat by-
products and ensure that they are accompanied by pertinent documents stated in
Department of Agriculture Administrative Order 4 series of 2019, as amended by DA
AC No. 2 of 2022 and Executive Order 34-A series of 2022 of the Provincial
Government of South Cotabato;
2. Carry out immediate diagnosis of suspected case and implement stumping out
procedures as stated in the Approved National ASF contingency plan;
3. Conduct surveillance and profiling of swine disease in the identified priority areas;
4. Regulate movement of animals and conduct quarantine procedure during suspected
and confirmed cases of ASF as stated in the Approved National ASF contingency
plan;
5. Consolidate data on swine population, farm location, etc.;
6. Ensure adequate public awareness of the general public on ASF and ASF prevention;
and
7. Such other function that may be required by law.

Section 3. Repealing Clause.

All Executive Orders, rules, regulations and other issuances or parts thereof, inconsistent with
the provisions of this Order are hereby revoked, repealed and modified accordingly.

Section 4. Separability Clause.

If any portion or provision of this Order will be declared inconsistent or invalid, the other
portions or provisions hereof, which are not affected thereby, shall continue in full force and
effect.

Section 5. Effectivity.

This Executive Order shall take effect immediately upon signing and shall remain valid and
enforced until revoked.
