JOINT COUNTER-AFFIDAVIT
I, JESTER DE ASIS y MAGDAOG , of legal age, single and a resident
Mabini, Casiguran, Sorsogon after having been duly sworn in
accordance with law, depose and state that:

1. I the am respondent in the above-captioned case;

2. The acts alleged in the complaint and in the affidavits supporting it

do not sufficiently show that I am responsible for rape in relation
to RA 7610 and/or that I am probably guilty thereof and thus
should be held for trial;

3. The truth is that I was not in Casiguran, Sorsogon in March 2019. I

was in Bukandala, Alapan, Cavite working in a water station;

4. That I started working there from February 2019 until September

2019. And, I only returned in Casiguran, Sorsogon to attend to the
fiesta of Tulay, Casiguran, Sorsogon;

5. That I was surprised to learn that I was being charged of rape in

relation to RA 7610 when I was not even in Casiguran, Sorsogon
that time. It bears to note the private complainant has mental
deficiency and perhaps her statements were misconstrued to refer
me as the person who raped her, if ever true;

6. That for the above reasons, I humbly submit that I did not rape the
private complainants;
 7. Thus, I execute this affidavit to attest to the truth of the foregoing,
SPECIFICALLY, FOR THE DISMISSAL OF THE INSTANT
COMPLAINT FOR LACK OF SUFFICIENT BASIS TO SHOW
THAT RAPE IN RELATION TO RA 7610 HAD BEEN
COMMITTED AND/OR THAT I AM PROBABLY GUILTY
THEREOF, AND THUS SHOULD BE HELD FOR TRIAL.
