MANIFESTATION WITH MOTION

ACCUSED, by counsel and to the Honorable Court, most respectfully states

that:

1. This case has a pending motion before the Honorable Court for the
reduction of bail of the accused;

2. The Court, however, did not act yet on said motion until there is
findings of accused’ psychological status;

3. While waiting for the results, the case is held in abeyance;

4. Recently, there is a new development in this case, more particularly

that an affidavit of desistance of the private complainant has surfaced, stating in
that affidavit that the latter is no longer interested in pursuing this case anymore;

5. With this, accused moves that the case be set for hearing on July 14,
2021 at 8:30 o’clock in the morning for the Court to act on the Affidavit of
Desistance notwithstanding the result of psychological assessment;

6. The accused seeks the mercy of the Honorable Court considering his
mental condition. With the earlier trial date, he could have availed himself of
earlier proper treatment.

7. This would also entail the expeditious termination of case, if ever.

 PRAYER

WHEREFORE, premises considered, it is most respectfully prayed before

the Honorable Court that this case be set on July 14, 2021 at 8:30 o’clock in the
morning or at the convenience of the Honorable Court.

Such other reliefs just and equitable under the premises are likewise prayed
for.
