Draft consent terms.

A and B agree to ambically and settle their marital disputes on the following Grounds.

1) They will dissolve the marriage by Mubaarat ( freeing of each other ) as per mutual
consent as per the Islamic law.
2) The party will pay Rs. 50 lakhs through FD, D. D and PDCs in view of the full and final
settlement with his wife and son Rushil
3) The amount is a full and final settlement and shall be paid on the date of withdrawal of
pending cases.
4) On the basis of this consent terms party A shall withdraw all the cases pending in family
court in Bandra, 498a and D. V. Case in Andheri Court.
5) Party A shall also give her consent for quashing the 498 a petition which will filed by the
husband in High Court of Bombay.
6) Both the parties should obtain a decree of divorce from Delhi family court in any one of
the two petition filed at Delhi family court.
7) The wife shall have the full custody of the minor child for now and in future and even in
changed circumstances. FATHER OF A CHILD CAN MEET WHENEVER HE
REQUIRES.
8) The minor son rushil shall have no rights in the property of his father AND HIS GRAND
FATHER properties at Delhi, Amroha and Shimla. IN FUTURE PURCHASED
PROPERTIES ALSO RUSHIL WILL HAVE NO RIGHTS.
9) Both the parties shall not malign each other in public and in private.
10) Both the parties not maligned each other parents or relative
11) Both the party undertake they shall not claim any right title and interest in each other
property and the property of each other relatives
12) The consent is free without any fraud and binding on both the parties.

From Fahad’s side.

Terms of Settlements:

1. That Rs.20 lakhs in shape of FD shall be made maturing upon attaining 18 yrs by Rushil
which can be utilized for his higher studies.
2. After withdrawal of cases FD of Rs.20 lakhs and and a cheque of Rs.10 lakhs which is to
be deposited in Rushil and Huma joint account shall be paid to Huma Rizvi.
3. Two PDCs of Rs. 10 lakhs each to be paid to Huma Rizvi.
4. That the settlement amount is in addition to Rs 35.02 L paid as maintenance fees during
the last 7 yrs of court cases. (break up in annexure B)
5. That further to the settlement amount there shall not be any further claim either by Huma
& Rushil or by their descendant / immediate relative / distant relative.
6. That Huma shall not use family name ‘Abbasi’ after settlement of cases.
7. That either of the parties or their descendant/ immediate relative /distant relatives shall
not file any new case in the court of law.
8. That either of the parties are free to live their life of their choice. No objection if Huma
remarries and Rushil changes his father’s name.
9. That either of the parties their descendants will not any claim or legal rights of one
another properties, earning, savings.
