MOST RESPECTFULLY SHEWETH:


1. The Complainant states and submits that the Complainant has
preferred a Complaint under Sections 138 r/w 141 and 143A of the
Negotiable Instruments Act, 1881. It is further submitted that the
contents of the said Complaint be read as an part and parcel of this
Application and are not repeated herein for the sake of brevity.

2. It is submitted that by an Order dated 30 th August 2019, this Hon’ble


Court was pleased to issue process against the aforesaid Accused No.
1, 3 and 4, returnable on 30th September 2019.

3. It is further submitted that the Summons along with the copy of the
accompanying complaint has been duly received by the Accused No.
1, 3 and 4 on 16th September, 2019 and are present today before this
Hon’ble Court.

4. In the light of the facts and circumstances stated hereinabove, the


Complainant prays that this Hon’ble Court to order and direct the
Accused No. 1, 3 and 4, jointly or severally, to pay a interim
compensation of sum of Rs. 20,000/- (Rupees Twenty Thousand
only) being 20% of the cheque amount to the Complainant.

APPLICATION FOR ISSUANCE OF NON-BAILABLE
WARRANT AGAINST ACCUSED NO. 1, 3 and 4.
MOST RESPECTFULLY SHEWETH:
1. The Complainant herein has preferred Complainant under Section
138 r/w 141 and 143A of the Negotiable Instruments Act, 1881
against the Accused. It is further submitted that this Hon’ble Court by
its Order dated 30th August 2019 was pleased to issues process against
the Accused No. 1, 3 and 4 and was further pleased to post the
hearing on 30th September 2019.

2. It is submitted that the Summons along with the copy of the


accompanying complaint has been duly received by the Accused No.
1, 3 and 4 on 16th September, 2019 and are present today before this
Hon’ble Court. Annexed hereto are the postal receipts and online
tracking report.

3. It is submitted that despite the summons been duly served, the


Accused No. 1, 3 and 4 have deliberately, intentionally avoided or
neglected to appear before this Hon’ble Court.

4. In the light of the facts and circumstances stated hereinabove, the


Complainant prays that this Hon’ble Court be pleased to issue non-
bailable warrant against Accused No. 3 and 4 to ensure their presence
before this Hon’ble Court.
