AN ORDINANCE PROHIBITING GOING HALF-NAKED IN PUBLIC
PLACES IN THE MUNICIPALITY OF ALIAGA, NUEVA ECIJA AND
PROVIDJNG PENALTIES FOR VIOLATION THEREOF.
WHEREAS, the Municipality of Aliaga, classified as Class B
Municipality, must set an example of orderliness, propriety and decency;
WHEREAS, it has been observed that some people still
roam around in public places within the Municipality oftentimes topless or half naked;
WHEREAS, the Sangguniang Bayan adheres to MMDA
Resolution No.03-20, Series of 2003 " urging the Local Government Units of Metro Manila to enact an ordinance on dress code in public places in their areas of jurisdiction";
WHEREAS, the Sangguniang Bayan recognizes the need to
bring about an atmosphere of decency to uphold higher morals and standards among the residents of the Aliaga, Nueva Ecija;
NOW, THEREFORE, BE IT ORDAINED BY THE
SANGGUNJANG BAYAN OF THE MUNICIPALITY OF ALIAGA, NUEVA ECIJA IN A SESSION DULY ASSEMBLED THAT; Section 1. The Local Government of Aliaga hereby prescribes that all persons must be properly and decently attired while moving about in public places within the Municipality of Aliaga.
Section 2. No person shall move about (i.e. walk, jog, run
or the like) in public places and outside his private residence half naked or wearing clothing covering only the lower most portion of the body without any top apparel. Section 3. Definition of Terms
a. Half-naked (Topless/bottomless) - wearing
clothing covering only the lower-most or upper- most portion of the body with the absence of any top or bottom apparel
b. Public Place s
b.I Open public places - include but not limited to
the following: roads, streets, sidewalks, parks, bridges, alleys, and overpasses. b.2 Covered public places - include but not limited to the following: schools, colleges, universities, museums, clinics, health's centers, dispensaries, laboratories, government or private offices, auditoriums/session halls/churches/convention centers, theaters/movie houses/studio, bars, restaurants/cocktail lounges/canteen kiosk, and other enclosed public eating places, dance
halls/disco houses, enclosed public eating places,
dance halls/disco houses, day and night clubs, beer/pub houses, hotels, department stores, markets/groceries, factories, plants and other covered places where people stay or gather for political, social, educational, religious, sports or entertainment purposes.
Section 4. Penalty. Any person apprehended for
violating this Ordinance shall be penalized as follows:
First Offense: Warning;
Second Offense: Three Hundred Peso (P300.00) Fine or eight (8) hours Community Service (at the option of the offender); Third Offense: Three to five (3-5) days imprisonment.
Section 5. .Implementing Authority. The Public Order
and Safety Office, the Philippine National Police of Aliaga, and the Barangay Officials/Tanods are hereby tasked to strictly implement this ordinance. Section 6. Repealing Clause. All ordinances and resolutions contrary and inconsistent herewith are hereby repealed and amended accordingly.
