“ORDINANCE REGULATING SPEED LIMIT 20Kph SPEED LIMIT AT TOKAWAL

SCHOOL ZONE AREA WITH DISTANCE 100 METERS FROM THE SCHOOL GATE
FOR SAFETY OF STUDENTS AND PROVIDING PENALTIES FOR VIOLATION
THEREOF..”

BE IT ORDAINED by the Sangguniang Barangay of Tokawal, Alabel, Sarangani

Province, that;

SECTION 1. TITLE. This ordinance shall be known as “ORDINANCE REGULATING

SPEED LIMIT 20Kph SPEED LIMIT AT TOKAWAL SCHOOL ZONE AREA WITH DISTANCE 100
METERS FROM THE SCHOOL GATE FOR SAFETY OF STUDENTS AND PROVIDING
PENALTIES FOR VIOLATION THEREOF.”

SECTION 2. DEFINITION OF TERMS. For the purpose of this ordinance, the following terms
shall mean:

a. MOTOR VEHICLE- means a self-propelled wheeled conveyance, such as a car; a

truck; single motorcycle, tricycle and all other transportation both private and PUV
that do not run on rails.

 b. DRIVER means any licensed operator of a motorcycle, and sits astride the vehicle on
a seat with his/her hands on a set handlers.
c. Barangay Traffic Citation Ticket is a ticket issued to person violating the traffic laws
and shall show among other information, the name and address of the offender
and include information the constitutes a complaint charging offense.
d. STREET AND WAY are terms used interchangeably with road. Highway is simply
road or street dedicated for public use, normally between two localities or towns,
and is often referred to as a public highway or public road.
e. SPEED LIMIT is the limit of speed allowed by law for road vehicles, either maximum
limits are commonly set by the legislative bodies of national or local governments.

SECTION 3. SPEED LIMIT.

a. All drivers must observe 20 Kph to the Tokawal School Road.

 Elementary School Zone
All drivers must observe the speed limit 20kph from South Direction
(Berdera) and North Direction (Olaguir )vice versa.
 Tokawal National High School Zone
All drivers must observe the speed limit 20kph from South Direction
(Iglesia ni Cristo Church) and North Direction (Bolol-awang
Crossing)vice versa.
b. All drivers must observe 30 Kph to the all Tokawal Roads.

SECTION 4. EXEMPTIONS. The rates of speed hereinabove prescribed shall not apply to the
following:

a. A physician or his driver when the former responds to emergency calls;

b. The driver of a hospital ambulance on the way to and from the place of
accident or other emergency;
c. Any driver bringing a wounded or sick person for emergency treatment
to a hospital, clinic or other similar places.
d. The driver of a motor vehicle belonging to the Armed Forces while in
use for official purposes in times of riot, insurrection or invasion;
e. The driver of a vehicle, when he or his passenger are in pursuit in
criminal;
f. A law-enforcement officer who is trying to overtake a violator of traffic
laws;
g. The Tokawal Emergency Response Team or responding an emergency;
h. Municipal Traffic Enforces in pursuit of a traffic violator;
i. Media men covering news report;
j. The driver officially operating a motor vechicle of any fire department,
provided that exemption shall not be construed to allow unless or
unnecessary fast driving of drivers aforementioned.

SECTION 5. ENFORCEMENT PERSONNEL. The following are deputized by the Barangay Local Chief
Executive to implement this ordinance:

a. Barangay Officials
b. Barangay Auxiliary Police
c. Civilian Volunteers Organization (CVO)
d. Purok Chairman

SECTION 6. PENALTIES. Any driver found to have violated any provision of this ordinance shall be
penalized with:
First Offense - Two Hundred Pesos (P200)
Second Offense - Five Hundred Pesos (P500)
Third Offense - One Thousand Pesos (P1,000)
Fourth and Succeeding - Five Thousand Pesos (P5,000) and/or
recommendation for revocation of
driver’s license with the LTO.

The Barangay Treasurer or any of this authorized agents shall collect the administrative fines
through the Traffic Citation Ticket herein provided and shall issue official receipts thereof. Failure
to appear and/or report before the Barangay Treasurer’s Office within a period of seven (7) days
from the date of the issuance of the Traffic Citation Ticket will constrain the proper authorities to
file complaint against the violator.

SECTION 7. SEPARABILITY CLAUSE. In case of any provision of this Ordinance is declared

unconstitutional, the other provision shall remain in full force and in effect.

SECTION 8. REPEALING CLAUSE. An ordinance or regulation inconsistent therewith is

hereby deemed modified or amended accordingly.

SECTION 9. EFFECTIVITY. This ordinance shall take effect after thirty (30) days from the
date of the approval following its publication in Barangay Bulletin Boards designated in
conspicuous areas and local publication within the Barangay Tokawal, Alabel, Sarangani
Province.
