BARANGAY ORDINANCE NO. 012 SERIES OF 2019

AN ORDINANCE ADOPTING AND IMPLEMENTING CITY ORDINANCE NO. 5133-95

ENTITLED “ AN ORDINANCE PROHIBITING THE DRINKING OF ALCOHOLIC
LIQUOR AND OTHER INTOXICATING BEVERAGES IN ALL PUBLIC PLAZAS,
PARKS, ROADS, SIDEWALKS AND ALLEYS OF THE CITY AND IT’S BARANGAYS
EXCEPT ON OFFICIAL FUNCTIONS AND PROVIDING PENALTY FOR VIOLATION
THEREOF”

BE IT ORDAINED BY THE BARANGAY 14 COUNCIL OF CAGAYAN DE ORO

CITY IN SESSION THAT.

SECTION 1. TITLE. - This Ordinance shall be known as ‘“AN ORDINANCE

ADOPTING AND IMPLEMENTING CITY ORDINANCE NO.
5133-95 OF CAGAYAN DE ORO CITY”.

SECTION 2 PURPOSE- This Ordinance is adopted to deter the existing problem in the
barangay regarding business establishment allowing their
costumers to drink alcoholic liquor and intoxicating
beverages along the roads, sidewalks, and alleys fronting
their store/establishment which is the subject of various
complaints due to several incidents of violence such as
brawling and mêlée, and public disturbance due to loud
noise in the middle of the night.
SECTION 3. PENAL PROVISION. Section 3 of the City Ordinance 5133-95 is hereby
adopted and shall be imposed for any violation.

SECTION 4. PENALTY. Any person who violates any of the provisions of this Ordinance
shall pay the fine of :

First Offense 500.00

Second Offense 1,000.00

Third Offense 1,500.00

SECTION 5. ACCRUAL OF FINES

. Fines collected from violators of this Ordinance shall accrue to

the General Fund of the apprehending office provided that the
latter shall issue corresponding receipt. .
SECTION 6. ENFORCING OFFICE

. All barangay officials, tanods and other person that duly

appointed and authorize by the Punong Barangay and PNP are
hereby directed to strictly enforce and implement this Ordinance.

SECTION 7. SEPARABILITY CLAUSE.

If for whatever reason any section or provision of this Ordinance is

declared illegal or unconstitutional, other section/s and/or
provision hereof which are not affected shall continue to be in full
force and effect. .

SECTION 8. REPEALING CLAUSE.

All ordinances, resolutions, memoranda or executive orders not

consistent with this Ordinance are hereby repealed and/or
modified accordingly.

SECTION 9. EFFECTIVITY CLAUSE. This Ordinance shall take effect upon its approval.

SECTION 10. PUBLICATION.

This Ordinance shall be posted in conspicuous places at the

Barangay 14 area.

Adopted this 8th of August 2019 at Barangay-14, City of Cagayan de Oro, Republic of
the Philippines.
