BARANGAY ORDINANCE NO. 01 SERIES OF 2023

“AN ORDINANCE INSTITUTIONALIZING, PROMOTING AND


DEVELOPING BACKYARD AND COMMUNITY ORGANIC GARDENING,
PROVIDING FOR ITS INCENTIVES AND APPROPRIATING FUNDS
THEREFORE AND FOR OTHER PURPOSES.“

WHEREAS, Section 17 of RA 7160. – (a) Local government units shall endeavor to


be self-reliant and shall continue exercising the powers and discharging
the duties and functions currently vested upon them. They shall also
discharge the functions and responsibilities of national agencies and
offices devolved to them pursuant to this Code. Local government units
shall likewise exercise such other powers and discharge such other
functions and responsibilities as are necessary, appropriate, or
incidental to efficient and effective provision of the basic services and
facilities enumerated herein.;

WHEREAS, DILG MC 2023-001; mandating all barangay government in


implementation of the Barangay Community Garden

WHEREAS, Section 15 of the 1987 Philippine Constitution declared that the State
shall protect andpromote the right to health of the people and instil
health consciousness among them ;

WHEREAS, the barangay as the ultimate bridge of the state to the people and
guided by its role andcommitment to serve efficiently in bringing out
sustainable living in the community has adopted backyardgardening to
promote individual’s health requiring every households to plant and
grow different vegetablesand roots crops in their backyards.

WHEREAS, Upon the initiative of Hon. Clark Collin L. Tejada and Hon. Adolfo A.
Rivera on their motion to enact Ordinance No. 01, series of
2023 entitled as AN ORDINANCE INSTITUTIONALIZING,
PROMOTING AND DEVELOPING BACKYARD AND COMMUNITY
ORGANIC GARDENING, PROVIDING FOR ITS INCENTIVES AND
APPROPRIATING FUNDS THEREFORE AND FOR OTHER
PURPOSES duly seconded by Hon Rodel M. Rulona . So therefore, the
Sangguniang Barangay, afterdue deliberation, agreed that.

BE IT ORDAINED by the Sangguniang Barangay in session duly assembled:


ARTICLE 1 GENERAL PROVISION

SECTION 1. TITLE.

- This Ordinance shall be known and cited as “ Backyard/Community


Organic Gardening Ordinance of Barangay 14, Cagayan de Oro City".

SECTION 2. DECLARATION OF POLICY.-

It is a declared policy of the Barangay 14 advance the rights of its


constituents to food security. sufficiency and safety. Towards this end
the barangay institutionalizes, promotes and develops
backyard/community organic gardening as an attempt for self-
reliance on food particularly vegetables. It shall also be the policy of
the city to promote ecological well-being through the adoption and
promotion of organic gardening among the constituents.

SECFLON 3. DEFINITION OF TERMS.-

As used in the ordinance. the following terms shall be undersfood as


follows:

a) Family Home — shall be synonymous with the word household. It


shall refer to the house where the family resides. Multiple families
living under one roof shall be required to maintain one family garden.

b) Food Garden - shall refer to the growing of any kind of plants


that produce
edible leaves, fruits or tubers actually consumed
by the concerned family. It may also include medicinal herbs and
plants. Fruit trees and coconut trees ore excluded within the context
of a food garden.

c) Backyard — Shall be used in its brood and general concept which


includes any vacant land in any port of fhe home lot.

d) Urban gardening — shall refer to the gardening techniques in small


spaces which includes the use of pots. bottles, etc. or the growing of
crops or ornamental plants in urban setting.

e) Community Open Spaces — non-buildable spaces in settlement


areas.

f) Hydroponics — the growing of plonfs in nutrient solutions.

g) Public Open Spaces — vacant lots and spaces owned and


maintained by the government.

h) Bio pesticides — are naturally occurring substances and


microorganisms that control pests.

i) Food Security - is the ability of the individual, household and


community to produce and /or access/acquire appropriate, abundant.
nutritious and safe food on a regular Dosis using socially acceptable
means;

j) Organic Agriculture — is a production system thot sustains the health


of soils, ecosystems and people. It relies on ecological processes,
biodiversity and cycles adopted fo local conditions, rather than the
use of inputs with adverse effects. Organic agriculture combines
traditions. innovation and science to benefit the shored environment
and promote fair relationships and good quality of life for all involved.

k) Public Open Spaces — vacant lots and spaces owned and


maintained
by the government.

l) Vertical Garden — green wall. a wall partially or fully covered with


greenery that includes a growing medium such as soil.

SECTION 4. BACKYARD AND COMMUNIFY ORGANIC GARDENING


PROGRAM.-

There is hereby established a Backyard and Community Organic


Gardening Program which consists of the following:

a) Voluntary backyard organic food garden for every family;

b) Mandatory community Organic Gardening in under the


management of Barangay officials under its Clean and Green
Program;

c) Training and mentoring on current technology and techniques for


sustainable backyard and community gardening in rural/urban
context, such as but not limited to, backyard plot gardening. self-
watering bottle gardening. hydrophonics, etc.;

d). Use of organic fertilizers and pesticides:

e) Compliance with the Barangay Solidwaste Management


Ordinance.
f) Incentives

SECTLON 5. MANDATORY COMMUNITY ORGANIC GARDENING.-


It is hereby prescribed the barangay must establish their own
community organic garden consisting of atleast
five (5) varieties of vegetables. However, the barangays shall
establish their garden in on appropriate urban setting in accordance
with but not limited to Secfion 7 of this ordinance.

The Barangay and its constituent shall establish its respective


Community Organic Garden to be maintained. sustained and
administered by barangay officials in accordance to rural or urban
setting.

SECTION 6. VOLUNTARY FAMILY HOME ORGANIC BACKYARD GARDENING.

- Every household is hereby encouraged to establish voluntarily its own


organic backyard food garden whether residing in a rural or urban-
situated Borongay. If must at least cultivate a minimum of fwo (2)
varieties of vegetables.

SECTION 7. URBAN GARDEN DESIGN.


Urban Gardens shall be in the form of the following:
a) Rooftop garden;
b) Window garden;
c) Vertical or wall garden;
d) Pots and small containers gardening;
e) Plots
f) Hydroponics
g) Air plants

SECTION 8. USE OF PUBLIC AND PRLVATE OPEN SPACES.-

The Barangay should determine which public open spaces to be


used for community gardens. The development cost. operation and
maintenance of these gardens shall be under the Barangay
Committee on Enviroment thru its Clean and green with the
assistance of the other Barangay Officials and other sectoral
organization.

Idle lots owned by private individuals within the territorial jurisdicfion of


the barangay 14 . without any development plan within the year, may
convert their lots into a vegetable garden. either by them or by the
barangay through any form of legal arrangement with the owner until
such time that development on the lot shall commence.

SECTION 9. PARTICIPATION OF ALL SECTORAL ORGANIZATION .-

The Sectoral Organization in the Barangay shall be encouraged to


formulate its own short, medium and long-term programs with specific
budget allocation from its National Tax Allotment on organic
gardening.

SECTION 10. COLLABORATION WITH THE PRIVATE SECTOR.-

The efforts of civil society organizations in promoting organic


gardening prior to the passage of this ordinance ore recognized. The
Barangay 14 shall continue to encourage and support the
participation of the private sector in the promotion, propagation,
development and implementation of organic agriculture from
production, consumption and possible marketing.

SECTION 11. INCENTIVES.-

The Barangay shall grant incentives through annual contests, awards


and financial or material support to families engage in backyard
organic gardening and borongays/puroks which promote, sustain and
practice community organic gardening. The Barangay Committee
Incharge shall formulate guidelines for developing incentive
programs, awards systems and /or financial or material support.

SECTION 12. PROCEEDS OF SALES.-

The income from fhe sales of vegetables of the barangay shall be


entered in its respective book of account as other income derived
from local sources which may be appropriated for whatever program
it may deem proper.
SECTION 13. CAPACITY BUILDING.-

To sustain and broaden the base for the implementation of this


Ordinance, within sixty (60) calendar days from the effectivity of this
ordinance and periodically thereafter. the Barangay Committee
incharge , shall develop and conduct series of orientations, seminars
and trainings for the development and proper care of organic food
gardens to be funded by the Barangay 14.

SECTION 14. PROMOTION OF URBAN ORGANIC AGRICULTURE.-

The Barangay 14 shall endeavor to promote urban organic gardening


by utilizing new technologies and taking advantage of ecological solid
waste. The Office shall endeavor to provide free organic fertilizers and
biopesticides.

SECTION 15. “GULAYAN SA KATORSE" CONTEST.-

The Barangay 14 may establish an annual “Gulayan sa Katorse"


Contest for Family Backyard Gardening and Community Gardening
by sectoral organization which may be included as one of the
highlights in any milestone activity of the barangay.

SECTION 16. ADMINISTRATIVE PROVISION.-

The Punong Barangay and Sangguniang Barangay Members


chairman on committee on environment shall be the lead
implementing person of this program.

SECTION 17. APPROPRIATION.-

The Barangay 14 shall appropriate substantial budget to ensure the


implementation ot this ordinance and to support the Family and
Community Organic Gardening

SECTION 18. SEPARABILITY CLAUSE

When any of the provisions of this ordinance is declared to be invalid


or null and void, the other provisions not otherwise declared invalid or
null and void shall remain in full force and effective.
SECTION 19. REPEALING CLAUSE –

Any or all Ordinance found to be inconsistent or in conflict with this


ordinance are hereby declared repealed or amended.

SECTION 20. EFFECTIVITY

This Ordinance shall take effect upon its approval and in accordance
with the law.

SECTION 21. PUBLICATION.

This Ordinance shall be posted in conspicuous places at the Barangay


14 area.
Adopted this 8th September 2023 at Barangay-14, City of Cagayan de Oro, Republic of
the Philippines.
