BARANGAY ORDINANCE NO. 2

AN ORDINANCE IMPOSING RULES AND REGULATIONS ON THE USE OF THE


COVERED COURT AND PROVIDING PENALTIES THEREOF

WHEREAS, under Section 391 of the Republic Act 7160 otherwise known as
the Local Government Code of 1991 where the Sangguniang Barangay has the power
and duties to act revenue ordinance and regulate the use of facilities constructed with
government funds and charge reasonable fees for the use thereof;

WHEREAS, Barangay Canapnapan has successfully upgraded its ordinary


basketball court into a covered court that has high electricity consumption;

WHEREAS, the covered court serves as a training ground, especially for the
youths in enhancing their talent in the field of sports and talents and a venue where
residents and non-residents gather together for social, cultural, educational and
religious activities;

WHEREAS, the covered court needs maintenance for its continuous public
operation and use;

NOW THEREFORE, be it ordained by the barangay council of Barangay


Canapnapan that:

SECTION 1. TITLE. This ordinance shall be known as “Barangay Canapnapan


Covered Court Regulation Ordinance.”

SECTION 2. DEFINITION OF TERMS. For the purpose of this ordinance, the


following are the definition of terms:

1. PERMIT – means the written authorization issued by the Person-in-Charge


to a person engaging in a particular activity on the covered court. The
authorization is subject to the terms and conditions specified in the permit
as well as all applicable laws, barangay ordinances and issuances.

2. OFFICER-IN-CHARGE – refers to the officer-on-duty of the day, designated


by the Punong Barangay.

3. VANDALISM – refers to the destruction or spoiling of structures including


the marking of the benches, stage and playing area.

4. LITTERING – refer to the throwing garbage/trash within and around the


premises of the Barangay Canapnapan Covered Court/ Evacuation Center.

SECTION 3. RULES, REGULATION AND FEES

1. Strictly no permit, no usage of the covered court and other facilities. It is


highly encouraged to pay the rental fees at least a day before using the
covered court.

2. All rental fees will be paid to the Barangay Treasurer and at the same time,
receipt and permit of usage will be issued which will be given to the Officer-
on-Duty.

3. For exclusive usage of non-residents (including private companies, non-


government organizations, and non-resident groups), P150.00 per hour will
be collected.

4. For residents who want to rent the covered court exclusively for private
occasions, P75.00 per hour will be collected and shall have full access
including the usage of sound system.

5. For residents and non-residents who will be using their own sound system
or rent high powered sound system, additional P500.00 will be collected that
is for the entire duration of the event.

6. For residents who want to play sports during nighttime specially using
electricity, P50.00 per hour will be collected.

7. For any form of activities during class hours is strictly prohibited. The
covered court shall be allowed of use at 6:30 PM until 9:30 PM.

8. FREE access to the covered court for the residents of Barangay Canapnapan
at all times during emergency and calamities.

9. Usage of the covered court every Friday and Saturday at 7:30 pm to 9:30 pm
is FREE to all youths for Sports Activities.

SECTION 4. LIABILITIES OF THE USERS


 Maintain peace and order
 No littering and must always observe cleanliness
 Any damages in the facility are chargeable to users
 No vandalism on the walls, chairs or to any property inside the
covered court
 Drinking/smoking or e-cigarette smoking inside the covered court is
highly discouraged

SECTION 5. PENALTY CLAUSE

Violators of the above-mentioned rules may be sanctioned with penalties:


1st Offense: Community Service (One (1) hour clean up) and fine with
P500.00
2nd Offense: Violators will be fined Five Hundred Pesos P1,500.00
3rd Offense: Violators will be banned/forbidden to use the covered court for
one (1) year with an additional fine of Two Thousand and Five Hundred Pesos
(P2,500.00)

SECTION 6. REPEALING CLAUSE

All laws, decrees, orders, rules and regulations, other issuances, or parts
thereof inconsistent with the provisions of this Act are hereby repealed or modified
accordingly.

SECTION 7. EFFECTIVITY CLAUSE

This barangay ordinance shall take effect immediately after the conduct of the
public hearing.

This ordinance with penal sanctions shall be posted at prominent places in the
barangay hall and in covered court/evacuation center for a minimum period of three
(3) consecutive weeks.

RESOLVED, as it is hereby resolved, to furnish copies of this ordinance to the


Mayor’s Office, 19th Sangguniang Bayan, Liga ng mga Barangay and other concerned
in this barangay.
