“ORDINANCE REGULATING SPEED LIMIT AT 20KPH TO ALL TYPE OF MOTOR


VEHICLES THAT TRAVERSE WITHIN THE JURISDICTION OF BARANGAY UNION
AND PROVIDING PENALTIES FOR VIOLATION THEREOF.”

WHEREAS, Republic Act No. 4136 otherwise known as the "Land Transportation and Traffic
Code” signed into law on June 20, 1964, is the governing traffic law of the Philippines, embodying
therein, among other;
WHEREAS, notwithstanding vigorous implementation by appropriate law enforcement
agencies of existing traffic laws, there has been an alarming steady increase in traffic accidents on the
highways, thoroughfares, streets, primarily caused by over speeding and reckless driving, with
motorists perennially ignoring lawful speed limits;
WHEREAS, in the interest of public safety and order, there is an imperative need for the
barangay government to immediately address this serious concern through the adoption of local
measures responsive to the current situation with a view of reasonably and effectively obviating traffic
accidents resulting from over speeding and reckless driving;
WHEREAS, Republic Act No. 7160 grants local government units the power to regulate
traffic on all streets and bridges within their territorial boundaries, and to enact such measures that will
enhance the public health, safety, convenience, maintain peace and order, and promote the general
prosperity of its inhabitants;

WHEREAS, a local measure providing for speed limit must be anchored on the basic precept
outlined on Section 35 of R.A. 4136, which states that: Any person driving a motor vehicle on a
highway shall drive the same at a careful and prudent speed, not greater nor less than is reasonable and
proper, having due regard for the traffic, the width of the highway, and of any other condition then and
there existing; and no person shall drive any motor vehicle upon a highway at such a speed as to
endanger the life, limb and property of any person, nor at a speed greater than will permit him to bring
the vehicle to a stop within the assured clear distance ahead;

BE IT ORDAINED by the Sangguniang Barangay of Union, Gamu, Province of Isabela, that;

SECTION 1. TITLE. This ordinance shall be known as “ORDINANCE REGULATING


SPEED LIMIT AT 20KPH TO ALL TYPE OF MOTOR VEHICLES THAT TRAVERSE WITHIN THE
JURISDICTION OF BARANGAY UNION AND PROVIDING PENALTIES FOR VIOLATION
THEREOF.”
SECTION 2. DEFINITION OF TERMS. For the purpose of this ordinance, the following
terms shall mean:

a. MOTOR VEHICLE- means a self-propelled wheeled conveyance, such as a car; a


truck; single motorcycle, tricycle and all other transportation both private and PUV that
do not run on rails.
b. DRIVER means any licensed operator of a motorcycle, and sits astride the vehicle on a
seat with his/her hands on a set handler.
c. Barangay Traffic Citation Ticket is a ticket issued to person violating the traffic laws
and shall show among other information, the name and address of the offender and
include information the constitutes a complaint charging offense.
d. STREET AND WAY are terms used interchangeably with road. Highway is simply
road or street dedicated for public use, normally between two localities or towns, and is
often referred to as a public highway or public road.
e. SPEED LIMIT is the limit of speed allowed by law for road vehicles, either maximum
limits are commonly set by the legislative bodies of national or local governments.

SECTION 3. SPEED LIMIT.

a. All drivers must observe 20 Kph speed limit to the Elementary School Zone
from any direction (vice versa).
b. All drivers must observe 20 Kph speed limit to all crossing roads, streets, and
highways of Barangay Union.

SECTION 4. EXEMPTIONS. The rates of speed herein above prescribed to the following:

a. A physician or his driver when the former calls;


b. The driver of a hospital ambulance on place of accident or other emergency;
c. Any driver bringing a wounded or sick person for emergency treatment to a
hospital, clinic or other similar places.
d. The driver of a motor vehicle belonging to the Armed Forces while in use
for official purposes in times of riot, insurrection or invasion;
e. The driver of a vehicle, when he or his passenger are in pursuit in criminal;
f. A law-enforcement officer who is trying to overtake a violator of traffic
laws;
g. The Barangay Emergency Rescue team or responding an emergency;
h. Traffic Enforces in pursuit of a traffic violator;
i. Media men covering news report;
j. The driver officially operating a motor vehicle of any fire department,
provided that exemption shall not be construed to allow unless or
unnecessary fast driving of drivers aforementioned.

SECTION 5. PENALTY AND SANCTIONS. Violation of this Ordinance shall be penalized


accordingly, to wit:

1st Offense : Fine of Two hundred Pesos (P200.00)


2nd Offense : Fine of Five Hundred Pesos (P500.00)
3rd Offense : Fine of One Thousand Pesos (P1,000.00)
4th and Succeeding Offense : Fine of Five Thousand Pesos (P5,000.00) and or
impoundment of the unit.

Violators shall, if warranted, be subjected to arrest and their vehicle impounded without prejudice to
the imposition of penalties and fines under the provisions of R.A. No.4136

SECTION 6. ENFORCEMENT PERSONNEL. The following are deputized by the Barangay


Local Chief Executive to implement this ordinance:

a. The PNP Gamu Police station to fully implement this ordinance and mandated
to coordinate with the Land Transportation Office (LTO) for the proper implementation of this
ordinance.

b. The Barangay Officials within their jurisdiction, in coordination with the


Barangay Tanods shall effectively implement this ordinance and arrest the offender and
responsible to deliver the same to the authorities mentioned.

The barangay Treasurer or any of this authorized agent shall collect the administrative fines and shall
issue official receipts thereof. Failure to settle before the Barangay Treasurer’s Office within a period
of seven (7) days from the date of impoundment will be construed to recommend for driver’s License
revocation to LTO or surrender the unit to Authorities.

SECTION 7. IMPOUNDING FEE. In addition to the administrative fine, an impounding fee


of One Hundred (P100.00) per day, computed in a daily basis shall be charged against the violator of
this ordinance.

Section 8. TRAFFIC SIGNS. The Barangay Council, Committee Chairman on Peace and order
is hereby directed to provide appropriate traffic signs indicating the speed limits on all affected
highways, streets, and roads within the barangay;

SECTION 9. SEPARABILITY CLAUSE. Should any provision of this ordinance be declared


by a court of competent jurisdiction to be unconstitutional or invalid, the provision not so affected
shall remain valid and effective.

SECTION 10. REPEALING CLAUSE. All ordinances or parts thereof inconsistent with the
provision of this ordinance are hereby repealed and modified accordingly.
SECTION 11. EFFECTIVITY CLAUSE. This ordinance shall take effect immediately after
posting and publication.

I HEREBY CERTIFY that the foregoing ordinance was duly enacted by the Sangguniang
Barangay of Union, Gamu, Isabela during its Regular Session on February 25, 2024.
