PETITION

COMES NOW THE PETITIONER, represented by the undersigned counsel and

unto this Honorable Court most respectfully files this Petition and respectfully alleges:

1. That petitioner is of legal age , widow, Filipino and a resident of Bgy. Abilay Norte,
Oton, Iloilo, where she may be served with summons and other notices from this
Honorable Court;

2. That petitioner was married to Rodel F. Roa, copy of the Certificate of Marriage is
hereto attached as Annex “A” and made an integral part of this Petition;

3. That their union produced eleven(11) children, the last two being minors at the time of
this Petition, namely, R.J E. Roa (17 y.0.) and Jen Rode E. Roa (15 y.o), copies of their
Certificates of Live Birth are hereto attached as Annexes “B” and “C”, respectively, and
made an integral part of this Petition;

4. That one of their children is named Rodel E. Roa Jr., who was born on July 14, 1982 at
Cuartero, Capiz, copy of the Certificate of Birth is hereto attached as Annex “D” and
made an integral part of this Petition;

4. That thus, his name in his Certificate of Death is now indicated as Rodel F. Roa Sr.,
copy of the Certificate of Death is hereto attached as Annex “E” and made an integral
part of this Petition;

5. That upon the death of said Rodel F. Roa Sr., his compulsive heirs, that is, petitioner
and their eleven (11) children, inherited the former’s undivided share in the estate of his
late father, Rodolfo M. Roa, copy of the Certificate of Death of Rodolfo M. Roa and
TCT No. EP-10486 containing the total area of FIFTEEN THOUSAND NINE
HUNDRED AND EIGHT (15, 908) sq. meters located at Bgy. Abily, Oton is hereto
attached as Annexes “F” and Annex “G”, respectively and made an integral part of this
Petition;

6. That the undivided share of Rodel F. Roa Sr. is ONE THOUSAND ONE HUNDRED
AND THIRTY-SIX (1,136.28) sq. meters, more or less;

7. That due to the minority of said R.J. E. ROA and JEN RODE M. ROA at the time of
this Petition, it is necessary and convenient that a guardian over their persons and
property be appointed;
8. That petitioner JOSEPHINE E. ROA is the mother and person having the custody and
care of the minors since their birth until now, and she possesses all the qualifications and
none of the disqualifications to whom letters of guardianship should issue;

9. That petitioner is working for the best interest of her minor children, that she decided
to file this Petition;

WHEREFORE, premises considered, Petitioner most respectfully prays that after

due notice, hearing and publication, a General Letter of Guardianship and Administration
over the person and property of the minors RJ E. ROA and JEN RODE E. ROA be
issued in favor of their mother, petitioner JOSEPHINE E. ROA.

Other relief just and equitable under the law are also prayed for.

That I am the Petitioner in the above-entitled case; that I have caused the preparation
of the foregoing Petition for Guardianship; that I have read and understood the contents
thereof and that the allegations contained therein are true and correct of my personal
knowledge and beliefs.

Furthermore, I hereby certify that I have not theretofore commenced any other
action or proceeding involving the same issues in the Supreme Court, the Court of
Appeals or any other tribunal or agency; That to the best of my knowledge, no such
action or proceeding is pending in the Supreme Court, the Court of Appeals or any other
tribunal or agency; That, if there is any such action or proceeding which is either pending
or may have been terminated, I must state the status thereof and that if I should thereafter
learn that a similar action or proceeding has been filed or is pending before the Supreme
Court, the Court of Appeals or any other tribunal or agency, I undertake to report such
fact within five days to the court or agency wherein the original pleading and sworn
certification contemplated herein have been filed.
