Resolution.- After carefully considering the objections and suggestions received in respect of the draft
of the Malrarashtra Municipal Councils,.lVqgor Parchayats and Industrial Townships State Services (Absorption,
Recruitment and Conditions of Service) Rules, 2006 published in the Government Notification No. Napras.
1008/365/CR T$lOAttID 14, dated 2nd Marctr, 2009, Government is pleased to direct thatthe rulesshould uow
be finally published. The accompatryrng notification should be published in the Maharoshtra Goveriment
Gazettq Extraordinary Part I-A - Central Section,
2. The General Administration Department should be requested to incorporate the Recruitment Rules
in the consolidated report.
3. lbe Director of Languages should be requested to translate the notification into Marathi and forward
the translation to the Manager, Government Central Press, Mumbai, for publication in the Maharashtro
fuuernmcnt Gszette.The Manager should be requested to forward six copies of the Notification to the Director
of Languages, for this;purpose immediately

4. The Director, Government Printing and Stationery, Mumbai should be requested io keep in stock at
the Govemment Book Depot, sufficient number of copies of the notification in Engtish and Marathi for supply

(2) of section 321 read with sub-section (2) of section 75A of the Maharashtra Municipal Councils, Nagar
Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965), and of all other powers enabling it in
that behalf, the Government of Maharashtra hereby amends the Maharashtra Municipal Councils, Nagar
Panchayats and Industrial Townships State Services (Absorption, Recruihment and C,onditions of Service)
ハ Rules, 2006; the sarne having been previously published as required by sub.section (3) of section 321 of the
said Act, as follows :-
1.Ttrese Rules may be called. the Maharashtra Municipat Councils, Nagar Panchayats and,
Industrial Townships State Services (Absorption, Recruitnrent and Confitions of Sewice) (Amendnrent)
Rules,2010.

2. In rule 2 of the i\{aharashtra Municipal C,ouncils, Na,gar Porrctwyats and Industrial Tornships
. State Ser:vices (Absorption, Recruitment and Conditions of Sen'ice) Rules, 2006 (hereinafter refered
to as "ihe principal rules"), fur cleuse (e), the following clause shall be substituted., namely::
:. " (e) "Appointing Auihority" in relation tr,-
(i) Grade "A posts nrcans the Director of Municipal Administration;
(ii) Grade "8" posts urcans the Regional Director of Municipal Administration; and
(iii) Grade "C" posts rleans the Collector;".
3. In rule 5, in sub-rule (2), in clause (b), for the words 'these ryles'the words "the Maharashtra
Municipal Councils, Nagar"Panchoyots and Industrial Tovrnships State Services (Absorption, Recnritment
and Conditions of Serrice) (Amendrnent) Bules, 2010" shall be substituted.

"7A. Absorption to be prouisional.-The absorption of every existing employee shall be provisional. -
llhe absorbed employee shall, unless he has already passed the MSCIT examination or a iertificate in
computer, specified by the Directorate of Information Technology, have to pass the MSCIT examination in
two chances within the period of one year from the date of absorption or the date of coming into force of
the Maharashbra Mruricipal Councils, Na6ar Paruhayats and Industrial Townships State Services (Absorption,
Recruitment and Conditions of Service) (Amendment) Ruies, 2010, whichever is later. If such employee
fails to submit a certificate to that effect his absorption shall stand terminated.".
5. In rule 16 of the principal rules, for sub-ruIe (l), the following sub-nrle shall be substituted,
namely:--
"(I) A separate select list o{ employees in each Grade of each service shall be prepared for the
purpose of appointnrent by proriotion to the higher post of services. For the prtrpose of preparing
such select list of ernployees eligible for pron'rotion, thete shall be constituted a Selection Committee
. for each grade:- 1
(A) Selection Conrmittee for promotion of Grade A to Selection Grade ancl Grade 'B' >
employees to Grade 'A shall consist o{,- ;

6. In rule 25 of the principal rules,--

. (i) for sub-rule(l), the following sub'rule shall be substituted, namely :-

A person in service of the Selection Grade and Grad.e 'Ii' shall be liable to be transferred
anywhere in the State of Maharashtra. He shall be eligible for being posted in any Municipal
Council on a post indicated in column (5) of Appendix-I appended to the rules. A person in
service of Grade 'B' shall be liable to'be transferred rvithin t]re same Revenue Division and a
person in service of Grade 'C' shall be liable to be transferred within the same District :
Provided that, a person in service in any of the above Grades, may, on a written request made by
hirn to the Direcbor , be transferred to other Region or other District:
