" To obey is also a duty"

CANON 1 - A LAWYER SHALL UPHOLD THE CONSTITUTION, OBEY THE LAWS OF THE LAND AND
PROMOTE RESPECT FOR LAW OF AND LEGAL PROCESSES.

Rule 1.01 - A lawyer shall not engage in unlawful, dishonest, immoral or deceitful conduct.

Rule 1.02 - A lawyer shall not counsel or abet activities aimed at defiance of the law or at lessening
confidence in the legal system.

Rule 1.03 - A lawyer shall not, for any corrupt motive or interest, encourage any suit or proceeding or
delay any man's cause.

Rule 1.04 - A lawyer shall encourage his clients to avoid, end or settle a controversy if it will admit of a
fair settlement.

Lawyer's duty is not only to serve, defend the rights and give justice to those who needed but also they
are bound to obey our constitution. Just like other ordinary citizens, lawyers are most likely the one to
be expected to follow all the laws of the land as they are one of those people who enforces the law.
They are not excuse from doing any unlawful acts and thier profession should never be an excuse for the
same. Furthermore, they should free theirselves from any unlawful, dishonest, immoral or deceitful act
as stated in Canon 1, rule 1.01.They should act as responsible and dignified person. They should avoid
engaging theirselvesfrom any acts that may ruin their profession and can cause losing the respect of
ordinary citizen to lawyers.

In the case of Tolosa v. Cargo, 171 SCRA 21

Complainant Tolosa filed wiht the court an affidavit complaint seeking disbarnment of rspondent District
Citizen's Attorney Cargo for immorality. Complainant claimed that reapomdent had been seeing his wife
Prescilla Tolosa in his house and elsewhere. Complainant further alleged that his wife left his conjugal
home and went to live with respondent and that since then has been living wiht respondent.

The supreme court agrees that there was no sufficient evidence to show that respondent had indeed
been cohabiting with complainant's wife or was otherwise guilty of acts of immorality. For this very
reason, Supreme court does not believe that the penalty of suspension from the practice of law may be
properly imposed upon respondent. At the same time, the Court agrees that respondent should be
reprimanded for failure to comply wiht the rigorous standards of conduct appropriately required from
the members of the Bar and officers of the court. As officers of the court, lawyers must not only in fact
be good moral character but must also be seen to be of good moral character and leading lives in
accordance with the highest moral standards of the community. More specifically, a member of the Bar
and officer of the court is not only required to refrain from adulterous relationships or the keeping of
mistresses but must also so behave himself as to avoid scandalizing the public by creating the belief that
he is flouting those moral standards.

At the given case, it only shows that lawyers should act in a decent manner and avoid any act that
violates any of our law. They are not exempted in doing unlawful acts. Violating one of our laws will
causing them loosing their profession. So as to keeping their profession, they are expected to uphold the
constitution, obey the laws of the land, and promote respect for law and of legal processes.
