Supreme Court of New South Wales Proceeding No. 2019/447839 ("Proceeding")

We act for the Plaintiff in the Proceeding.

We refer to Order 1 of the Orders dated 14 December 2018, requiring the Plaintiff to file
and serve any lay evidence in the Proceeding by 12 July 2019.

We are instructed that our client's primary lay witness has unexpectedly been required to
travel overseas on a personal matter and will be unavailable for the next two weeks. In
those circumstances, our client seeks a short two week extension to file and serve its lay
evidence. Our client would also agree to your client receiving a commensurate two week
extension to file and serve any lay evidence in reply.

We enclose draft Consent Orders which provide for this minor timetable variation and
also set down the matter for a directions hearing on 16 August 2019.

If you are content with the draft Consent Orders, would you please sign and return them
to us and we will provide you with a draft joint communication to the court.
