DOCTRINES:

ABSORPTION DOCTRINE
- A labor organization absorbs another, resulting in
the cessation of the absorbed labor organization’s
existence and the continued existence of the
absorbing labor organization.
LOCK STOCK BARREL RULE (Kiok Loy Ruling)
- CBA proposed by the union may be imposed lock,
stock, and barrel on the ER who refuse to
negotiate a CBA.
- ER who violates the duty to bargain collectively,
loses its statutory right to negotiate or
renegotiate the terms and conditions of the draft
CBA proposed by the union. Hence, the proposal
of the union may be adopted as the CBA, and
consequently imposed on the ER, lock, stack, and
barrel.
AUTOMATIC RENEWAL CLAUSE
- CBA shall remain effective and enforceable even
after expiration of the period fixed by the parties
as long as no new agreement is reached by
them.
- Only to economic provisions of CBA; does not
include representational aspect
SUBSTITIONARY DOCTRINE
- When there occurs a shift in the EE’s union
allegiance after the execution of CB contract with
the ER, the EEs can change their agent (Labor
Union) but the CB contract which is still
subsisting continues to bind the EE up to its
expiration date. They may bargain for the
shortening of the said expi date.
ONE UNION-ONE COMPANY POLICY
- Proliferation of unions in an employer unit is
discouraged as a matter of policy unless there is
compelling reasons which would deny a certain
class of EEs their right to self-organization for the
purposes of collective bargaining
COMMUNITY OF INTEREST DOCTRINE/
SUBSTANTIAL MUTUAL INTEREST RULE
- Factor in determining the appropriate
bargaining unity by Affinity and unity of EE’s
interest such as substantial similarity of work
and duties, or similarity of compensation and
working conditions.
GLOBE DOCTRINE
- Factor in determining the appropriate
bargaining unity by express will or desires of
the employees
