Indemnity Form

By his/her signature that is contained within this disclaimer form, the passenger acknowledge that he/she has read,
understands, agrees to and accepts all of the following to the extent permitted by law:

1. The passenger acknowledges and accepts the inherent risks of the hot air balloon activity organized by Kolej
Tunku Abdul Rahman (KTAR) and provided by Sky Ads Sdn Bhd and the possibility of personal injury or property
damage or loss resulting there from.
2. The passenger agrees to abide by the following rules of Sky Ads Sdn Bhd and/or KTAR at all times:
a. The passenger shall not engage in reckless or foolish behavior likely to cause injury to himself/herself or
any other person or property;
b. All passengers must follow the directives of KTAR and/or Sky Ads Sdn Bhd and its management and staff at
all times;
c. Any passenger injured, or observing that another passenger has been injured, shall notify KTAR and/or Sky
Ads Sdn Bhd management or staff of the incident immediately.
d. No smoking is allowed within 30m from the hot air balloon.
e. Passenger height must be above 120cm.
3. The Passenger also acknowledges that the Passenger is riding on the hot air balloon voluntarily on Passenger’s
own free will and desire.
4. All passengers agree to indemnity KTAR and/or Sky Ads Sdn Bhd against all claims made by any other person
against KTAR and/or Sky Ads Sdn Bhd, as the case may be, in respect of injury, loss or damage arising out of or
in connection with the passenger’s failure to comply with the rules and/or directions of KTAR and/or Sky Ads
Sdn Bhd, its management or staff. If safety becomes questionable at any time or the weather changes to non-
operating conditions, the pilot shall have the authority to abort the flight. Safety of passengers and crew is our
utmost priority.
5. By participating in this activity, the passenger acknowledges and accepts that KTAR and/or Sky Ads Sdn Bhd do
not accept liability whatsoever from:
a. All manner of accidents that may result in injury or worse and/or property damage or loss of any kind
therefrom;
b. Inability of the passenger to continue in their present work or profession as a result of any injury sustained;
c. Any injury or death or loss of any kind that may be attributed to acts of terrorism;
d. The forces of nature, including, but not limited to typhoon, cyclone, monsoon, earthquake, fire, flood and
landslide;
6. The passenger understands and acknowledges the dangers associated with consumption of alcohol and mind
altering substances before or during the KTAR and/or Sky Ads Sdn Bhd activities, and the passenger accepts full
responsibility for injury, loss or damage associated with any such consumption.
7. If the passenger suffers any injury or illness, the passenger agrees and consents that KTAR and/or Sky Ads Sdn
Bhd may provide evacuation, first aid and medical treatment at the passenger’s expense.
8. By personally executing this disclaimer form the passenger warrants that he/she is at least eighteen (18) years
of age. Where this disclaimer form is executed by a parent, guardian or other person, for and on behalf of the
passenger, the person executing this disclaimer form warrants that he or she has authority to do so and that
such parent, guardian or other person, agrees to indemnify KTAR and/or Sky Ads Sdn Bhd in terms of the
indemnity contained in clause 4 thereof.
