In consideration for receiving this air transportation free of charge, the Passenger agrees to HOLD
HARMLESS MIDEX, its pilot(s), and those persons acting on its behalf, including all staff
personnel and agents , and all others associated with MIDEX who have assisted in arranging the
Passengers transportation, from any and all liability, including, but not limited to, liability for
negligence for any personal injury or property damage the Passenger might suffer, and for any
wrongful death action which his or her heirs and/or Estate might bring arising from being a
passenger on an aircraft or ground transportation provided by MIDEX , and operated by pilots or
others acting on behalf of MIDEX. THIS MEANS THAT NEITHER the Passenger, NOR his or
her HEIRS OR ESTATE, MAY PURSUE ANY CLAIM FOR DAMAGES AGAINST
THOSE PERSONS OR ENTITIES AS DESCRIBED HEREIN ARISING OUT OF MIDEX
TRANSPORTATION

Minors or Legally Incompetent Individuals:

In consideration for receiving this air transportation free of charge, the Passenger agrees to HOLD
HARMLESS MIDEX, its pilot(s), and those persons acting on its behalf, including all staff
personnel and agents, and all others associated with MIDEX who have assisted in arranging the

Passengers transportation, from any and all liability, including, but not limited to, liability for

incompetent passenger might suffer, and for any wrongful death action which their heirs and/or
Estate might bring arising from said minor/legally incompetent individual being a passenger on an
aircraft or ground transportation provided by MIDEX, and operated by pilots or others acting on
behalf of MIDEX.

THIS MEANS THAT, ON BEHALF OF THE MINOR/LEGALLY INCOMPETENT

INDIVIDUAL I AM AGREEING THAT NEITHER THE MINOR/LEGALLY
INCOMPETENT INDIVIDUAL. NOR HIS/HER HEIRS OR ESTATE, MAY PURSUE
AGAINST THOSE PERSONS OR ENTITIES AS DESCRIBED HEREIN ANY CLAIM FOR
DAMAGES ARISING OUT OF MIDEX TRANSPORTATION.

THE UNDERSIGNED HEREBY AFFIRMS LEGAL GUARDIANSHIP AND/OR

RESPONSIBILITY OVER THE MINOR/LEGALLY INCOMPETENT PASSENGERS) BEING
TRANSPORTED BY MIDEX, AND AGREES TO INDEMNIFY, SAVE, DEFEND, AND
HOLD HARMLESS MIDEX, its pilot(s), and those persons acting on its behalf, including all staff
personnel and agents , and all others associated with MIDEX, REGARDING ANY CLAIM FOR
INJURIES, DEATH, OR DAMAGES WHICH SAID MINOR/LEGALLY INCOMPETENT
INDIVIDUAL MAY BRING, OR WHICH MAY BE BROUGHT ON THEIR BEHALF(S), AS A
RESULT OF BEING TRANSPORTED ON AN MIDEX AIRCRAFT OR GROUND
TRANSPORTATION
I hereby consent to the minor/legally incompetent passenger mentioned herein being transported on
MIDEX arranged transportation.
I understand it is my sole and exclusive responsibility to purchase any flight or accident insurance
should I desire to be insured on this flight.
In the event any portion of this contract is held invalid, the remaining portions shall remain in full
force and effect.

NOTE: THIS RELEASE MAY BE USED, AND IS DEEMED VALID, AS TO ALL MIDEX
FLIGHTS ON WHICH THE UNDERSIGNED, OR THE MINOR(S)/MENTALLY
INCOMPETENT(S) ON WHOSE BEHALF THIS RELEASE IS BEING SIGNED, ARE
PASSENGERS.

By accepting this free service, Passenger acknowledges its legal sufficiency to bind this Agreement.
Therefore, through this Agreement the Passenger completely waives, releases and holds harmless
any and all parties (“Released Parties”) directly or indirectly involved in providing such services
from any and all claims or demands of any nature, including, but not limited to economic, non-
economic, special, incidental, consequential or property damages, personal injury or death; whether
or not directly or indirectly arising from the flight, or the delay, inability, cancellation or failure to
complete the flight in whole or in part, including entering or deplaning the Aircraft or any other
vehicle used. Such protection extends to all parties providing free services in the air, or on the
ground and includes, but is not limited to MIDEX, its affiliates, officers, directors, shareholders,
members, employees, agents, contractors, volunteers, assigns, successors, insurers and attorneys,
drivers, or pilots, together with their heirs and personal representatives, successors or assigns.

The Passenger agrees that protections invoked above operate in perpetuity, and Passenger waives,
releases, discharges and holds harmless all Released Parties from any and all claims, negligent or
otherwise, now and forever. The Passenger accepts the intent of this Agreement to protect each of
the Released Parties from lawsuits, claims or demands; and to otherwise hold the Released Parties
harmless from such claims, damages or injuries whether or not they are immediately apparent.
Released Parties rely upon the Passenger acknowledgement and acceptance of this Agreement in its
entirety.
Regarding this document, a photocopy, duplicate or facsimile image shall have the same legal effect
as the original Agreement, serving as a legal substitute should the original be lost, destroyed or
misplaced.

Within this Agreement, the term Passenger applies to each individual on board, other than the flight
crew; and each of whom accepts the purpose and full intent of this Agreement, and the signature of
any individual Passenger below, other than the flight crew, shall signify acceptance of this
Agreement for all Passengers, whether or not they have reached their legal majority.

No part or provision of this Agreement may be modified, except in writing, and requires signatures
by the Passengers and MIDEX President. This Agreement states the full understanding and intent
between all parties, and it may not be influenced by past, present or future written agreements or
oral representations of the parties. This Agreement shall be governed by the laws of the United
Arab Emirates and the courts of the United Arab Emirates shall have sole jurisdiction.
This Agreement inures to the benefit of, and binds the heirs, personal representatives, successors,
and assigns of the parties. If any provision of this Agreement shall be held unenforceable or void, it
shall be severable from the remaining provisions and shall not affect their subsequent enforceability
or validity.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO

SIGNING IT. I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING
CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS,
ADMINISTRATORS AND REPRESENTATIVES MAY HAVE AGAINST THE
RELEASEES.

As evidenced by my signature below, I have read this agreement in its entirety and agree to its
terms.

or if only one parent is available, that parent, or that person with sole legal custody, or the legal
guardian/conservator of the minor/legally incompetent passenger)

NOTE: This Complete Waiver and Release of Liability Agreement (“Agreement”) is intended to
be a legally binding document. Read all pages carefully and completely. You may wish to consult
an attorney to obtain advice about this document. By your signature on this Agreement, you
indicate your acceptance of all terms and conditions above..

WARNING: ALL PASSENGERS ARE COMPLETELY RESPONSIBLE FOR THEIR OWN

SUITABILITY TO FLY, AND ARE STRONGLY ENCOURAGED TO CONSULT A
PHYSICIAN PRIOR TO THE PLANNED MISSION SHOULD THEY HAVE CONCERNS
SUCH AS, BUT NOT LIMITED TO, CLAUSTROPHOBIA, HEART OR RESPIRATORY
CONDITIONS, PHYSICAL IMPAIRMENT OR DISCOMFORT, NERVOUSNESS OR
OTHER FORMS OF ANXIETY, OR PREGNANCY.
