COMPROMISE AGREEMENT

PARTIES
1. DIANNE CARLA SY VELEZ (First Party), of legal age, Filipino, with
address c/o Atty. Cherryl K. Ontalan’s law office at Unit 2E New Domain
Bldg., No. 19 Holy Spirit Drive, Don Antonio Heights, Brgy. Holy Spirit
Drive, Quezon City; and

2. ARWIN DOMINGO VELEZ (Second Party), of legal age, Filipino, with

address at No. 1519 Sulu St. Sta. Cruz, Manila.

RECITALS
1. The First Party is the complainant and the Second Party is the respondent
in NPS No. XV-03-INV-19E-04586 pending before the office of Quezon
City Assistant City Prosecutor Diovie M. Macaraig-Calderon.

2. The First Party is also the complainant and the Second Party is the
respondent in NPS No. XV-03-INV-19G-05839 pending before the office
of Quezon City Assistant City Prosecutor Maria Cecilia Gertrudes R.
Salvador.

3. The First Party is the petitioner and the Second Party is the respondent in
Civil Case No. 7000-19 pending before the Regional Trial Court Branch 4
of Imus, Cavite.

4. The parties have a minor child named Arianne Denise Sy Velez.

5. The parties have separated on August 2018 and their reconciliation is

highly improbable.

6. The parties recognize their rights and obligations as parents to Arianne

Denise and they herein agree on their exercise of parental authority,
custody, and visitation rights over their child and the manner of providing
support.

TERMS and CONDITIONS

1. The First Party shall withdraw the complaints docketed as NPS No. XV-
03-INV-19E-04586 and NPS No. XV-03-INV-19G-05839.

2. The First Party shall also withdraw the petition for legal separation
docketed as Civil Case No. 7000-19 pending before the Regional Trial
Court Branch 4 of Imus, Cavite.

3. The Second Party will take sole responsibility of all the debts incurred by
both parties up to the time of their separation.

4. The parties or their heirs, family and friends shall not make any call or
send messages through any social media platform to each other.

5. The parties or their heirs, family and friends shall delete, remove and at
any time will not post or publish in any social media platform anything

 that is in anyway connected, related or have anything to do with either of
them.

6. The parties or their heirs, family and friends will not institute or initiate
any criminal, civil or administrative proceeding, suit or action before any
court, agency or tribunal against each other or against each parties’ heirs,
family or friends.

GENERAL PROVISIONS
1. The information exchanged between the Parties during the preparation
and execution of this “Compromise Agreement” is regarded as confidential
information. This information shall not be construed as an admission of
guilt on the part of either party.

2. The parties shall maintain the confidentiality of all information. No

information contained in this “Compromise Agreement” shall be disclosed
to any third parties without the written consent of both parties.

3. This “Compromise Agreement” was executed freely and voluntarily and in

accordance with law and not contrary to morals, public policy and good
custom.

4. This “Compromise Agreement” shall be governed and construed in

accordance with the laws of the Republic of the Philippines and the parties
shall, in good faith, strictly abide by the terms hereof.

5. In case of breach of the terms and conditions of this “Compromise

Agreement” the aggrieved party may seek judicial relief against the erring
party and shall have the right to enforce the same. The erring party shall
bear the cost of litigation, attorney’s fees, interest and other expenses
incurred as a consequence of such breach.

The parties sign this agreement at the date and place of their notarial
acknowledgment hereof.
