of the Philippines in this case.
Counsel Lisondra: Your Honor, my name is Atty. Milcah Lisondra, and I am representing the
Accused in this case.

Prosecutor Favor: Yes, Your Honor. For the prosecution, we are ready to present our witness,
SPO2 MARECOR GABUYA, one of the arresting officers, Your Honor.

Interpreter: May I call on the witness stand, SPO2 Marecor Gabuya. (Swear in the witness) Raise
your right hand. Do you swear to tell the truth the whole truth and nothing but the truth?

SPO2 Gabuya: I do. (witness goes to the stand and sits down)

Interpreter: Please state your name, age and other personal circumstances.

SPO2 Gabuya: My name is Marecor Gabuya. I live in Piapi, Dumaguete City, Negros Oriental. I
finished Bachelor in Criminology. I am presently working as a police officer stationed in Dumaguete
City, Negros Oriental.

Interpreter: Your witness, Fiscal.

Prosecutor Favor: Your Honor, we are offering the testimony of this witness to prove the
genuineness and due execution of the seizure receipt; to identify the accused in this case and
likewise to identify some documents to this case and to testify on such other matters as may be
relevant, Your Honor. With the permission of the Honorable Court, may we proceed your Honor?
Judge: Yes, you may proceed.
Prosecutor Favor: Madam witness, as mentioned in your Judicial Affidavit, you are one of the
arresting officers who arrested the accused in the person of Jonathan Lubrido Sr., is that correct?
SPO2 Gabuya: Yes, Ma’am.
Prosecutor Favor: Do you personally know the accused, Mr. Jonathan Lubdrio Sr.?
SPO2 Gabuya: Yes, Ma’am.
Prosecutor Favor: Can you tell us why you personally know Mr. Lubrido?
SPO2 Gabuya: I am the one who personally arrested him during the buy-bust operation, Ma’am.
Prosecutor Favor: Is he here right now in this courtroom?
SPO2 Gabuya: Yes, Ma’am.
Prosecutor Favor: Can you point him?
SPO2 Gabuya: Yes, Ma’am, there he is right there. (pointing to Jonathan)
Prosecutor Favor: How did you know that Mr. Lubrido Sr. was involved in the selling of illegal drugs
locally known as “shabu”?
SPO2 Gabuya: Days prior to the operation, a concerned citizen personally appeared before our
office and reported to our Team Leader (PCPT MAGDALERA) regarding the involvement of the
subject in illegal drug activity.
Prosecutor Favor: What did you do upon receiving the said information?
SPO2 Gabuya: Our team leader directed one of our Intel Operatives to conduct a validation in order
to confirm the veracity of the information.
Prosecutor Favor: What was the result of the validation made by your Intel Operative?
SPO2 Gabuya: It was confirmed that the subject was indeed engaged in selling illegal drugs, further,
we got the subject’s identity and his way of selling illegal drugs.
Prosecutor Favor: When did you conducted the buy-bust operation?
SPO2 Gabuya: On July 20, 2020 at around 6:00pm, Ma’am.
Prosecutor Favor: Where did you conducted the buy-bust operation?
SPO2 Gabuya: In the residence of Mr. Lubrido Sr., Ma’am in Barangay Lo-oc, Dumaguete City.
Prosecutor Favor: During the buy-bust operation, did you personally see that Mr. Lubrido was
indeed selling dangerous drugs?
SPO2 Gabuya: Yes, Ma’am.
Prosecutor Favor: What dangerous drugs were you able to see during the buy-bust operation?
SPO2 Gabuya: It was a shabu, Ma’am.
Prosecutor Favor: How many items were confiscated during the buy-bust operation?
SPO2 Gabuya: We found two transparent heat-sealed sachets containing white crystalline granules,
Ma’am.
Prosecutor Favor: Do you have with you the chemistry report from the said operation proving that
you found two transparent heated sachets containing white crystalline substance?
SPO2 Gabuya: Yes, Ma’am, I got a copy from the Negros Oriental Crime Lab of the Chemistry
Report No. A-551-20, Ma’am.
Prosecutor Favor: Can you show us the chemistry report?
SPO2 Gabuya: Here it is, Ma’am.
Prosecutor Favor: Your Honor, may we request to mark the Chemistry Report No. A-551-20 as
exhibit H?

SPO2 Gabuya: (looks at the seizure receipt) yes, that is my signature, Ma’am.

Gabuya in this seizure receipt to confirm and affirm the genuineness and due execution of the seizure
order?

Counsel Lisondra: Is it made in the presence of the barangay chairman, the DOJ representative and
the media?

forensic chemist in the Negros Oriental Crime Laboratory, Your Honor.
Interpreter: May I call on the witness stand, Amzie Ashly Ong Ramas-Uypitching (Swear in the

Amzie Ong: I do. (witness goes to the stand and sits down)

Interpreter: Please state your name, age and other personal circumstances.

SPO2 Gabuya: My name is Amzie Ashly Ong Ramas-Uypitching. I live in Dumaguete City, Negros
Oriental. I finished Bachelor of Science in Chemistry. I am currently working as a forensic chemist in
Negros Oriental Provincial Crime Laboratory.

Interpreter: Your witness, Fiscal.

Prosecutor Favor: Your Honor We are offering the testimony of this witness to prove the authenticity
of the Chemistry Report, Your Honor. With the permission of the Honorable Court, may we proceed
your Honor?
Judge: Yes, you may proceed.
Prosecutor Favor: Madame witness, you said that you are working as a forensic chemist in the
Negros Oriental Crime Laboratory is that correct?
Amzie: Yes, Ma’am.
Prosecutor Favor: How long have you been working with the Negros Oriental Crime Laboratory as
Chemist?
Amzie: I’ve been working for almost 15 years already, Ma’am.
Prosecutor Favor: Did you receive a request from the PNP for Laboratory Examination or Chemical
Analysis and Drug Test on July 21, 2020?
Amzie: Yes, Ma’am.
Prosecutor Favor: On the day of your examination of the seized substance, what have you found?
Amzie: The specimen consists of two heat sealed transparent plastic sachet containing suspected
shabu marked as BB-ROD-7-21-2020 and PB-RRJ-7-21-2020, respectively.
Prosecutor Favor: Did the specimen yielded a positive result to the tests for Methamphetamine
Hydrochloride which is a dangerous drug under RA 9165?
Amzie: Yes, Ma’am.
Prosecutor Favor: I have here the Chemistry Report No. A-551-20 which was marked as Exhibit H.
Can you confirm if this is the one that you made showing a positive result for the specimen which was
seized from the accused during the buy-bust operation? (shows the chemistry report to Amzie)
Amzie. (looks at the chemistry report) Yes, that is the Chemistry Report that I made and handed over
to the PNP.
Prosecutor Favor: That would be all, Your Honor for the prosecution.
Judge: Counsel, do you wish to cross-examine the witness?
Counsel Lisondra: No, Your Honor, but I would like to present my witness, Your Honor.

Counsel Lisondra: For the accused, we are ready to present our witness, Honorable Courtney Love
Jorolan, the Barangay Captain of Barangay Lo-oc, Dumaguete City, Your Honor.
Interpreter: May I call on the witness stand, Honorable Courtney Love Jorolan. (Swear in the
witness) Raise your right hand. Do you swear to tell the truth the whole truth and nothing but the
truth?

Honorable Jorolan: I do. (witness goes to the stand and sits down)

Honorable Jorolan: My name is Courtney Love Jorolan. I live in Barangay Lo-oc, Dumaguete City,
Negros Oriental. I am currently the Barangay Captain of Barangay Lo-oc, Dumaguete City.

Interpreter: Your witness, Counsel.

Counsel Lisondra: Your Honor We are offering the testimony of this witness to prove whether or not
the witness was indeed able to witness the arrest and the making of the inventory of the seized illegal
drugs and to testify on such other matters as may be relevant, Your Honor. With the permission of the
Honorable Court, may we proceed your Honor?
Judge: Yes, you may proceed.
Counsel Lisondra: Honorable Jorolan, where were you on July 20, 2020 at around 6:00 pm?
Honorable Jorolan: I am staying in my house, Ma’am.
Counsel Lisondra: Did you know of any buy-bust operation to be conducted by the police in your
barangay?
Honorable Jorolan: Yes, Ma’am.
Counsel Lisondra: How did you know that there will be a buy-bust operation during that day?
Honorable Jorolan: Because I was informed by SPO2 Gabuya and I even attended the pre-
operation meeting together with the buy-bust team, the DOJ representative and a media
representative.
Counsel Lisondra: Did you personally see how Mr. Lubrido was arrested by the police officers?
Honorable Jorolan: No, Ma’am.
Counsel Lisondra: Why were you not able to see the arrest of Mr. Lubrido?
Honorable Jorolan: Because I was late and when I went to the Police Station, SPO2 Gabuya just
handed over to me the Inventory Report and asked me to sign it.
Counsel Lisondra: So, you mean, you signed the Inventory Report without witnessing the whole
operation?
Honorable Jorolan: Yes, Ma’am.
Counsel Lisondra: For the record, Honorable Courtney Love Jorolan signed the Inventory Report
without witnessing the whole operation. That would be all for this witness, Your Honor.

Judge: Alright, we call the testimonies of the witnesses. In today’s hearing, the prosecution
presented their witness SPO2 Gabuya and Forensic Chemist, Amzie Ashly Ong while the counsel for
the accused presented Honorable Courtney Love Jorolan, the Barangay Captain of Barangay Lo-oc
Dumaguete City. In the next scheduled hearing dated November 21, 2020, the counsel will present

Defendant.

Atty. Lubrido: (Standing). Yes, Your Honor.

herself, Courtney Love Jorolan.

Courtney: I am Courtney Love Jorolan. I live in Taclobo, Dumaguete City, Negros Oriental. I am a
senior law student of Foundation University currently working as a Certified Public Accountant at Lee
Plaza.

Interpreter: Your witness, Atty. Lubrido.

Atty. Lubrido: Your Honor, we are offering the testimony of this witness to prove the genuineness
and due execution of her judicial affidavit; to identify some documents and to testify on such matters
as may be relevant. With the permission of the Honorable Court, may we proceed your Honor?
Judge: Yes, you may proceed.

Atty. Lubrido: Madam Witness, I have here your judicial affidavit and according to your judicial
affidavit you are filing this case against Milcah Lisondra. Am I correct?

Courtney: Yes, Atty.

Atty. Lubrido: Did you execute this judicial affidavit without force, threat, influence or intimidation?

Courtney: Yes, Atty.

Atty. Lubrido: Can you tell to this honorable court why are you filing this action for damages against
the defendant?

Courtney: Yes, I can, Atty. I’m filing this case against the defendant because she was reckless in
driving her car. As a result, my bike and her car collided.

Atty. Lubrido: So, you mean that you and the defendant were engaged on a road accident?

Courtney: Yes, Atty.

Atty. Lubrido: Can you narrate to this Honorable Court what happened between you and the
defendant on a road accident?

On July 21, 2020 at around 5:15 pm, I was riding on a bicycle on my way to Foundation
University to attend my Practice Court class at 5:00 pm. While I was navigating at an
intersection at crossing Taclobo, a speeding red Suzuki Swift with plate number FGM 381
owned and driven by Milcah Inggo collided with my bicycle. As a result, I was thrown into the
sidewalk 6 meters away.

Atty. Lubrido: Can you still remember what happened next, Madam Witness?

Courtney: I was rushed to Silliman University Medical Center.

Atty. Lubrido: Can you still recall what Lisondra did?

Courtney: Yes, Atty.

Atty. Lubrido: What did she do?

Courtney: She went to the hospital immediately.

Atty. Lubrido: Can you still recall what did she do when she arrived at the hospital?

Courtney: No, Attorney. I was unconscious at that time.

Atty. Lubrido: Did she visit you while you were confined at the hospital.

Courtney: Yes, Attorney.


Attorney: How often did she visit you?

Courtney: Only once, Attorney.

Attorney: During her visit, did she tell you that she’s going to take care of all the expenses during
your hospitalization?

Courtney: Yes, Attorney.

Atty. Lubrido: Was she able to fulfill her promise?

Courtney: No, Atty.

Atty. Lubrido: How badly you were injured?

Courney: My right knee was fractured and it needed to be rehabilitated for another 3 months after
hospital confinement.

Atty. Lubrido: Did the defendant know about this?

Courtney: Yes, Atty. I informed her regarding this matter.

Atty. Lubrido: After informing her, what did she do?

Courtney: She promised me again and assured me that she’ll take care all my medical and hospital
bills.

Atty. Lubrido: Did she pay all the expenses?

Courtney: No, Atty.

Atty. Lubrido: Who paid your bills?

Courtney: Me, Atty.

Atty, Lubrido: Did you constantly call the defendant and ask for reimbursement?

hospital bills. It was stated that you incurred almost 1 million for hospitalization and rehabilitation
expenses. Is that correct, Madam Witness.

Courtney: Yes, Attorney.

Atty. Magdalera: A while ago, you mentioned that you’re about to go to Foundation University for
your Practice Court class when the collision took place. Am I correct, Madam Witness?

Courtney: Yes, Attorney.

Atty. Magdalera: What time was your class back then?

Courtney: At 5:00 PM, Attorney.

Atty. Magdalera: What time did the road accident took place?

Courtney: At around 5:15 PM, Attorney.

Atty. Magdalera: Since your class starts at 5:00 PM you were already late for your class. Am I
correct, Madam Witness?

Courtney: Yes, Attorney.

Atty. Magdalera: Does it mean that you were in a hurry going to school since you were a little bit late
for your class, Madam Witness?

Courtney: Yes, Attorney.

Atty. Magdalera: Your Honor, it is apparent in this case that when the collision took place, the
plaintiff was in a hurry going to school. As a result, she drove her bicycle speedily and failed to use
the brake to slow down while navigating the intersection along the National Highway at Crossing
Taclobo. Am I correct Madam Witness?

Atty. Lubrido: (Loud Voice). Objection. Your Honor, that is a misleading question.

Judge: Objection sustained.

Atty. Magdalera: That would be all, Your Honor. No further questions, Your Honor.

Atty. Lubrido: Yes, Your Honor. I would like to present Dra. Amzie Ong-Ramas-Uypitching, the
attending physician of the plaintiff, Your Honor.

Intepreter: May I call on the witness stand, Dra. Amzie Ong-Ramas-Uypitching. (Swear in the
Witness). Raise your right hand. Do you swear to tell the truth, the whole truth and nothing but the
truth?

Dra. Amzie: I do. (witness goes to the stand and sits down)

Dra. Amzie: I am Dra. Amzie Ong- Ramas-Uypitching. I live in Dumaguete City, Negros Oriental. I
am currently working as a physician at Silliman University Medical Center.
Interpreter: Your Witness, Attorney. (Looking at Atty. Lubrido)

Atty. Lubrido: Your honor, we are offering the testimony of this witness to testify as to the extent of
the injuries suffered by the plaintiff and to corroborate the contents of the medical documents.

Judge: You may proceed.

Atty. Lubrido: Madam Witness, you said that you are working as a physician at Silliman University
Medical Center, am I correct?

Dra. Amzie: Yes, Attorney.

Atty. Lubrido: How long have you been working as a physician in the said hospital?

Dra. Amzie: 10 years, Attorney.

Atty. Lubrido: Can you tell to this Honorable Court how the plaintiff became your patient?

Dra. Amzie: Yes, I can, Atty. She became my patient when she was rushed to the hospital because
of severe injuries she sustained from a road accident.
Atty. Lubrido: When was that?
Dra. Amzie: On July 21, 2020 at around 5:45 pm, Atty.
Atty. Lubrido: Am I correct Madam Witness that you mentioned earlier that Courtney Love got
severe injuries from a road accident?
Dra. Amzie: Yes, Atty.
Atty.Lubrido: Can you tell to this Honorable Court the condition of the plaintiff when she was rushed
to the hospital?
Dra. Amzie: She was badly injured. She suffered a fractured right knee due to the great impact of the
collision. Aside from that, she needed to be rehabilitated for three months after her confinement.
Atty. Lubrido: Did you still have a copy of medical records of the plaintiff?
Dra. Amzie: Yes, Atty.
Atty. Lubrido: I have in me the copy of the plaintiff’s medical records certified by Dra. Amzie Ong-
Ramas Uy-Pitching marked as exhibit C. Can you confirm if the signature in the lower right is your
signature? (Shows to her the medical certificate)
Dra. Amzie: (looks to the medical certificate) Yes, that is my signature, Attorney.
Atty. Lubrido: Your Honor, may we request to mark as exhibit C-1 the signature of Dra. Amzie Ong
Ramas-Uypitching in this medical certificate to confirm and affirm the genuineness and due execution
of the said medical certificate?
