Hospital, Parian, Calamba City, Laguna; and on April 28, 2011, Remedios Marudo Casalla died
intestate in Mary Mediatrix Medical Center, Lipa City, Batangas, and on February 11, 2002,
Edgardo Marudo Paña died intestate in St. Lukes Medical Center, E. Rodriguez Sr. Avenue,
Quezon City, leaving that certain parcels of land of which are more particularly described as

WHEREAS, the FIRST PARTY are the legitimate children and only heirs of the
deceased- the late, Jose Marudo and Maria Terrenal;
WHEREAS, the SECOND PARTY are the legitimate children and only heirs of the
deceased- the late, Remedios Marudo Casalla;

WHEREAS, the THIRD PARTY are the legitimate children and only heirs of the
deceased- the late, Edgardo Marudo Paña;

WHEREAS, the Decedents died without leaving any will and no intestate proceedings
have been instituted or the administration of their estates;

WHEREAS, the Decedents left no known debts, obligations, and other properties at the
time of death;

NOW THEREFORE, for and in consideration of the premises and invoking the
provision of Rule 74, Section 1, of the Rules of Court, the parties hereto do by these presents,
agree to divide and partition the entire estate above described, adjudicating as they do hereby
adjudicate the same to and among themselves in pro indiviso equal shares, subject to the
contingent liabilities in favor of heirs, creditors, and other persons who might be deprived of their
lawful participation in the estates of the Decedents for a period of two (2) years from and after the
settlement;
