We further state that, acoordingly Loan Agreement dated was executed by you and between PNB HFL as 2 Lender and You Ne. 1 & 2 as a Borrowers referred therein (hereinafter referred tolas the “eoid Agreement" for the sake of brevity), whereby You No. 1 & 2 have acknowledged the avallment of the said credit facility and also agreed and undertook to repay the same with interest as mentioned in the seid Agreement. We further state that, in consideration to the said credit facity granted to You No. 1 & 2 and had created equitable mortgage by way of deposit of original title deeds in respect ofthe said property and deposited all the original ttle deeds with an intention to secure the due repayment of the said credit fcily by executing Letter evidencing creation of mortgage. That accordingly as per instruction we have disbursed the said loan amount of Rs.20,84,000.00/- (Rupees ‘Twenty Lakhs Eighty-Four Thousand Only) in your favour which has been duly received by You. That we further state that, in consideration to the said credit facility granted to You No. 1 & 2 and you ie. addressee no-3 stood as Guarantor and, inter-alia, agreed and undertook to repay the said credit facility with interest, costs, charges etc. in case of default committed by You No. 1 & 2 by executing Guarantee ‘Agreement for which your liability is joint and several with the other addresses. Under the terms and conditions governing the said Loan Facility you were bound to repay the loan amount in equated monthly Installments. However, contrary to the terms and conditions governing the said Loan Facity, you were constantly defaulting in repayment and inspite of repeated requests, reminders and demands and several opportunities granted you failed, neglected and refused to regularize your captioned Loan account and/or to make payment ofthe outstanding amount /contractual dues. We are compelled by your financial indiscipline and indifferent attitude to exercise our rights under the Loan Agreement to terminate/cancel the said Loan Faciity and call upon you being addressees to pay the total outstanding dues, Housing 9. That we further state that, You No. 1 & 2 had availed and enjoyed the said credit facility granted by PNB HFL however you No. 1 & 2 have failed and neglected to repay the said credit facility despite umpteen requests and reminders by us and consequent thereto, loan account of You No. 1 & 2 has been classified ‘as a Non-performing Asset (NPA) as per Guidelines of Reserve Bank of India (RBI)NHB. Accordingly, we have initiated measures under the provisions of Securitisation And Reconstruction Of Financial Assets And Enforcement Of Security Interest Act, 2002 amended as on date for enforcement of security interest of Created upon the said property in favour of PNB HFL as a security for due repayment of the said credit facility and in the said process, it appears that, You Nos. 1, 2 and 3 have acted in collusion & connivance with sooner and defrauded to PNB HFL. As on 04/04/2018 (Date of current o/s amount), You No. 1 & 2 owes 2,943.75/- (Rupees Twenty-One Lakhs Twenty-Two Thousand Nine Hundred Forty-Three and Seventy-Five Paise Only) to us. You No. 3 being Guarantor of the said credit faclty, You No. 3 is also liable to make payment of the current outstanding amount mentioned hereinabove. So also, You No. 3 who is actual beneficiary of the said credit facility is also liable to make the payment of the said outstanding amount to us. 10. Please take a note of this fact that as per provisions of law, precedent of Hon'ble Supreme Courts and in terms of agreement of guarantee, the borrowers and guarantors are jointly and severally liable to re-pay the loan amount of the company. 14. This Notice is issued without prejudice to our other rights and remedies in the matter as per the terms and conditions of the Loan Agreement governing the said Loan Facllty and in accordance with law. In the facts and circumstances as mentioned above, we are compelled and constrained to recall the entire Loan and on such recall it is observed from statement of account dated 04/04/2018 an amount of Rs. 21,22,843,75/- is due, payable and outstanding by you and guarantors which includes interest and other contractual charges etc. together with other charges that will accrue due thereon til the date of payment by ‘you within 7 (Seven) days from the date of issue/receipt of this notice, falling which, we will be compelled and constrained to oxercise the rights and remedies available under the terms and conditions as mentioned in the Loan Agreement governing the said Loan Facility and also to initiate appropriate proceedings in accordance with law for recovery of the aforesaid amount and also to enforce the security interest at your costs end consequences which may please be noted.
