APPLICATION FOR CANCELLATION OF FORGE SALE DEED NO.

Most Respectfully Showeth:

That the sale deed Registration No.636, Addl.book no.I, Vol No. 1293, on
pages 45 to 49, dated 31/03/1980 which was executed at sub Registrar
Seelampur SR-IV, between:-

First Parties:-

1. Ramjilal S/O Jagbir Singh, 2. Smt. Saroopi Wd/O Sh. Niyader,

3.Braham Singh, 4.Kalyan Singh Sons of Sh. Niyader, 5.Chander S/O
Horam, 6. Chattar Singh, 7. Attar Singh, 8. Hemchand Sons of Sh.
Harban, 9. Gobind Sahai S/O Sultan

Second Party-

Sh. Ram Kisan S/O Late Sh. Shiv Raj

2. That the copy of the sale Deed is attached herewith as Annexure No.1
3. That the Khasra Number involved in the above mentioned sale Deed is
389/263/(12-02).
4. That the above mentioned land is situated at village Chilla Saroda
Bangar, Delhi-110091.
5. That Sh. Sarda Ram S/O Late Sh. Hari Chand had illegally
transferred the property/land of above mentioned in his favour by
producing false documents and doing Misrepresentation/Fraudlent.
6. That the above mentioned Sale Deed id Fraudlent Regestration as
because:-

a. That as per Sale Deed the name of Braham Singh is written as

“Brahm” but as per the records his original name was Braham
Singh. (Copy of Death Certificate of Braham Singh in Annexed
Herewith as Annexure 2)
b. That as per the sale Deed the name of Sh. Kalyan Singh is
mentioned as “Kalyan” but as per the records his original name
was Kalyan Singh. (Copy of Death Certificate of Kalyan Singh in
Annexed Herewith as Annexure 3)
c. That as per the Sale Deed the signature of Braham Singh is
mentioned as “Brahm” but as per the original/Genuine signature
 of “Braham Singh”, he used to write his full name i.e Braham
Singh in English.
d. That as per the Mutation M 306/NTD/80 date 06/06/1980, made
on behalf of the above mentioned Sale Deed, the names are
mentioned as Braham Singh and Kalyan Singh (Copy of Mutation
is annexed herewith as Annexure 4)
e. That the name of the kalian Singh is written as “Kalyan” in Sale
Deed but his signature is mentioned as “Kalyan Singh”
f. That as per the first page of the Sale Deed it is mentioned that the
Sale Deed is made 30/01/1980. But as per the back of First page
of Sale Deed the first date is mentioned as 30/01/1980 and second
date as 17/03/1980.
g. That as per the back of the last page of the Sale Deed it is
mentioned:- Date- 31/03/1980, Registration No. 636 ADD Book-I,
Vol No. page 45 to 49.
h. That as per the Mutation made on behalf of the bove mentioned
Sale Deed i.e Mutation M 306/NTD/80, the Registry No. 10069
date 28/01/1980.
i. That the Registration number is not matching as per the number
mentioned in the sale Deed and as per the Mutation.
j. That as per Sale Deed the signature of Chander in Hindi and one
signature in Urdu whose name is not mentioned along with. And
the thimb impressions of all other first parties are shown in the
Sale Deed along with the name specified/mentioned against thumb
impressions i.e. of whom impression they belong
k. That the Id proofs and photographs are not there of any person in
the Sale Deed.

7. That the original signatures/thumb impressions of the above

mentioned below:-

a. General Power of Attorney dated 19/03/1975, the signatures of

Sh.Chattar Singh and Sh. Ramjilal are in Hindi.(Annexure 5)

b. Irrevocable General Power of Attorney date 13/05/1974, the

signatures of Sh. Govind Sahai is in Hindi, Sh. Attar Singh in
 Hindi, Hemchand in Urdu, Sh. Chander in Hindi, Sh. Braham
Singh in English & Sh. Kalyan Singh in Hindi
(Annexure 6)

c. Original signatures/thumb impression of Sh Gobind Sahai can

also be verified from details of Bank Account No. 6393 of State
Bank of India, Branch- Himmat Puri, Delhi. (Annexure 7)

8. That the original/genuine signatures of Late Sh. Braham Singh and

Late Sh.Kalyan Singh can also be verified from the below mentioned:-
a. O4 Shumar No.24 SAFA No. 62 M 49/NTD/95-96 date 18/3/1996,
Name- Braham Singh S/O Niyadar.
b. O4 Shumar No.23 SAFA 62 Case No.1 & 2/RA SDM/RA Shahdara
date 26/08/1992, the name is mentioned as Kalyan Singh

9. That the original signature or thumb impression of the above

mentioned first parties can also be verified from the LAC
Departement, East Disrict, Delhi, as per payment of compensation in
Award No.s. – 87 B/72-73 ENM LAC No. 39/85, A/71-72, 87 A/72-
73, 52 B 71-72 and 52 E 71-72 of the land of Village Chilla Saroda
Bangar/ Khadar, Delhi-110091.
10. That the land in the above mentioned Sale Deed has already
been sold in which witness is father Ram kisan i.e Shiv raj @ Sheo Raj
S/O Rumaal vide Deed of Agreement to sell- Registration No.6591,
Addl. Book No. IV Vol No.553, on pages 78 to 78 on date
05/06/1979:- First Party :- Chattar Singh S/O Harbans, Ramjilal S/O
Sh. Jagbir Singh Second Party:- Sadakat Ali S/O Sahadat Ali Witness-
Shiv Raj @ Sheoraj S/O Rmaal.(Copy of Agreement to Sell-Annexure
8).
