(Constrained Land) zone, also known as 'Sugarloaf
Forestry', shown in orange below:
The historic subdivision of Sugarloaf Forestry is not an
urban or rural residential area, but is an area for forestry
and rural activity. You are able to use the land for Rural
purposes such as growing vegetables or keeping animals.
Can I Build in the Sugarloaf Forestry?
Any proposal to construct a building for any purpose on
a lot less than 20 hectares in the Sugarloaf Forestry
requires Planning approval prior to any Building approval
being issued for the structure (Refer to Table 5.55 of the
Southern Downs Planning Scheme). The construction of
any buildings other than rural sheds on lots less than 20
hectares is effectively prohibited (Refer to 6.25 Limited
development (constrained land) zone code of the
Southern Downs Planning Scheme).
Unless you have a lot of at least 20 hectares you cannot
construct a dwelling on the land or reside on the land. No
use of a building for residential purposes on either a
permanent, temporary or intermittent basis is allowed. It
is noted that use of land for camping and caravans are
also prohibited.
If you apply to Council for approval for a shed on an
allotment less than 20 ha, you will need to demonstrate
that the shed is required for rural purposes. You will need
to include details of what rural activities you will be
undertaking on the land.
Please note that Council does not support an application
for a 'shed' in the Sugarloaf Forestry if the proposed shed
has many of the facilities of a dwelling house.
How can I find out if my land is in the Limited
development (constrained land) zone?
You will need to utilise Council's online mapping system
to ascertain the zoning. In the Planning module, you can
identify the zoning using the key.
You can also check the planning maps at Council’s
Community Contact Centres during business hours.
The Southern Downs Planning Scheme is available on
Council's website. Printed copies are available to read or
purchase at Council’s Community Contact Centres during
business hours.
What additional approvals are required in the Limited
development (constrained land) zone to build a shed?
You will need approval for building works. Council's
website contains other relevant information sheets,
particularly the Building Application requirements for
Class 10 (Garages, Sheds and Carports) information
sheet.
The requirements of the planning scheme are
ADDITIONAL to the requirements of the Building Code of
Australia.
