1. Gorio sold a parcel of land to Ricardo Silverio with a

warranty in the deed of sale that the property is free from all liens and
encumbrances whatsoever. A notice of lis pendens was, however,
inscribed at back of the certificate of title but not at the owner’s copy.
Did Gregorio commit falsification of public document (deed of sale) by
making untruthful statements in a narration of facts? Explain.
2. Is there a complex crime of estafa through falsification of
private document? Explain.
3. Is there a complex crime of estafa through falsification of
official, public or commercial document? Explain.
4. Gigantoni used to be a PC CIS agent. He was suspended and
later on dismissed but has not received the dismissal order. Meanwhile,
he got employed during his suspension by a private company. Giganti
went to the office of the PAL to conduct verification of some travels
made by the PAL’s officials. However, he represented himself to the
PAL legal officer as a PC-CIS agent investigating a kidnapping case, and
requested that he be shown the PAL records particularly the passenger
manifests for Manila-Baguio-Manila flights covering the period February
1 to 3, 1981. Can Gigantoni be held liable for usurpation of authority?
Explain.
5. On April 4, 2021, Carlo, who resides in Pangasinan,
travelled to Zambales and at the checkpoint, presented a certificate of
residency purportedly issued by the punong barangay of Lucapon North,
Sta. Cruz, Zambales. When the punong barangay was asked if he issued
the said certificate of residency, the punong barangay denied having
issued the same. Can Carlo be charged with use of falsified document?
Explain.
6. Armanda maintained an illicit relation with complainant’s
husband which eventually begot them a child. When she applied in the
judiciary, she filled up the prescribed form (Civil Service form) and did
not disclose the existence of her daughter. May Armanda be held liable
for perjury? Explain.
