II. OFFER OF TESTIMONY

The joint testimony of the undersigned witness-defendants is being offered to

prove the fact that the witness-defendants have also the legal right as heirs equal to the
plaintiffs over the land allegedly owned by Abdon E. San Juan.

That as legitimate children of Joseph S. Eclarinal, who, on the other hand is a

legitimate child of Antonio Eclarinal and Maria San Juan, daughter of the spouses
Arnulfo and Consolacion San Juan and a sister of Abdon E. San Juan, both legitimate
children of the spouses Arnulfo and Consolacion San Juan.

III. JUDICIAL AFFIDAVIT PROPER

Q- Do you swear to tell the truth and nothing but the truth herein?

A- Yes Maam.

Q- Will you please state your name, age and other personal circumstances?

A- We are Julbert and Celino D Eclarinal. Our respective personal circumstances

are stated in Part I hereof, supra (See: “PRELIMINARY INFORMATION:
NAME AND OTHER PERSONAL CIRCUMSTANCES OF THE WITNESS”).

Q- Why are you here now?

A- To give our sworn statement by way of a judicial affidavit, the same to

constitute as our direct testimony in support of our special answer to the
complaint and counterclaim.

Q- For the record, please state the name and address of the lawyer who is now
conducting or supervising your examination and the place where the
examination is being held now?

A- Our Legal Counsel Atty Charidee Anne S Labrador is conducting and

supervising our examination now at her law office (AAM LAW OFFICE, Balili,
Palanginan, Iba, Zambales).

Q- In what language do you want your examination to be conducted?

A- In English, Maam.
 Q- Are you the same Julbert and Celino who are co-defendants in this case?

A- Yes, Maam.

Q- Is your address within the land subject of this action?

A. Yes, maam. Our house is within the subject property which was inherited by
Abdon E. San Juan and his sister Maria E. San Juan, our grandmother.

Q- How do you know of such a fact?

A- It is in my possession the birth certificates of our great grandparents Arnulfo

and Consolacion San Juan, our grandmother Maria E San Juan, our father
Joseph S Eclarinal, and our birth certificates.

Q- Do you have any other documents to prove you rights over the land?

A- Yes, maam. Upon the death of our father Joseph S Eclarinal, he left us a
Deed of Absolute Sale executed by him and the grandfather of the plaintiffs
Abdon E San Juan in favor of our father dated April 1, 1985. The subject of
which is the lot in dispute.

Q- Why did your father bought the land? Did your grandmother told your father
their right of share over the land?

A- No, Maam. He doesn’t know he have the right over the land.

Q- Is there anything you want to add?

A- Yes, Ma’am. On May 10, 2020 we made an inquiry with the Land Registration
Authority over the subject land and upon verification, we found out that our
father Joseph S Eclarinal has a pending application for transfer of certificate of
title.

Q- I have no more question to ask, do you want to add some more?

A- No more Ma’am.
