JUDICIAL AFFIDAVIT WITNESS FE NALA

I, Fe Nala, of legal age, married, Filipino citizen, with residence
address at Zone 9, Patag, Cagayan de Oro City 9000, Misamis Oriental, state
under oath as follows:

PRELIMINARY STATEMENT
The person examining me is Atty. Dexter Baquiano Precioso, with
address at Zone 3, Camp Evangelista, Patag, Cagayan de Oro City. The
examination is being held at Zone 3, Camp Evangelista, Patag, Cagayan de
Oro City. To the best of my personal knowledge, belief, basing on authentic
records available, I am answering his questions fully conscious that I do so
under oath and may face criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of Fe Nala is being offered to prove

the following that:
1.) Defendants persuaded the other employees of the plaintiff to
terminate their respective employment and file a labor case against
the plaintiff before the Department of Labor and Employment
(DOLE).
2.) Defendants spread false rumors about the plaintiff stating that the
latter illegally and unlawfully terminated one of her employees.
3.) She will authenticate her judicial affidavit.
4.) She will also testify on other matters that are relevant to this case.

1.) Q. Please state your name and other personal circumstances for the
record.

A. I am Fe Nala, of legal age, married, Filipino citizen, residing at

Zone 9, Patag, Cagayan de Oro City.

2.) Q. Are you willing to tell the truth, nothing but the truth in this case?

A. Yes sir.

3.) Q. Why are you executing this affidavit?

A. I am here to give a sworn statement by way of judicial affidavit,

the same to constitute as my direct testimony in the above-
captioned case.

4.) Q. Do you know herein plaintiff?

A. Yes sir. Oblenda C. Marcojos (“Oblenda” for brevity) is my close

friend.

5.) Q. Do you know herein defendants?

A. Yes sir. Reynaldo B. Cullamar (Reynaldo) and Annalie M.

Cullamar (Annalie) were employees at the business owned by the
plaintiff.

6.) Q. What is this business of the plaintiff that you are talking about?

A. It is the Darb’s Bakeshop, Bulaluan & Xerox Copier.

7.) Q. Where is it situated?

A. It is situated at Patag, Cagayan de Oro City.

8.) Q. What is you affiliation with the business of plaintiff Oblenda?

A. I am her adviser, she also consults me, whenever she encounter

problem in her business.

 9.) Q. Have you personally met defendants Annalie and Reynaldo at the
business place of the plaintiff?

A. Yes sir.

10.) Q. Was there anything that the said defendant/s talked to you
regarding the said business?

A. Yes sir.

11.) Q. What is it?

A. Annalie once approached me and said that all the employees of the
plaintiff were already on their side.

12.) Q. What does “on their side” mean?

A. She meant about the complaint that they planned to file against
Oblenda before the DOLE.

13.) Q. Why did she tell you regarding the same?

A. She told me so because she wants me to join them. She even

persuaded me to stop giving advices to the business of Oblenda.

14.) Q. Did you conform to the persuasion of Annalie?

A. No sir, because I did not have any problem with plaintiff Oblenda.

15.) Q. What are the other things that Annalie told you?

A. She also told me that Oblenda illegally terminated one of the

employees of the said business.

16.) Q. Who was this employee?

A. It was Esaganie Mercado (Esaganie).

17.) Q. Was Esaganie actually terminated?

 A. No sir, as I found out that the said statements of Annalie were not
true and just fabricated.

18.) Q. Do you have anything more to say?

A. None for the moment.

19.) Q. Are you willing to sign this judicial affidavit to convey your
concurrence?

A. Yes sir, I am willing.

citizen, with postal address at Zone 3, St. Therese, Camp Evangelista, Patag,
Cagayan de Oro City, Philippines, the examination is conducted at the said

at the abovementioned office address;

asked and the corresponding answer that the witness gave; and
