I have the honor to refer to refer to your Office, records of the investigation relative to the case of Vol. REPUBLIC ACT NO.
7659 TRANSPIRED on the March 5 2021 about 11:30 PM At Barobo Surigao Del Sur.

COMPLAINANT: PMAJ CHRISTIAN JAY GAVINO OIC of Barobo Surigao Del Sur.
ACCUSED : Juan Dela Cruz AND a legal ages and a resident of Sanfrancisco Agusan del Sur .

FACTS OF THE CASE:

On March 5, 2021 at around 11:30PM at Purok 5 Campbagang Barobo Surigao del Sur operation conducted by personnel of this
station led by. PMAJ CHRISTIAN JAY GAVINO together with BARANGAY CHAIRMAN Personnel of Barobo led by Cj Gavino
GUAM I confiscated 1 BOLO through hot pursuit operation.

Investigation conducted revealed that said with abandoned house were coming from Purok 2, Barobo Surigao Del Sur and upon
reaching at Barobo Surigao del Sur. A concerned citizen reported thru cellphone call in PNP Barobo Del Sur hotline the same
were traversing heading to Barobo Surigao Del Sur. Immediately, personnel of this station together with barangay Chairman
establish hot pursuit operation and intercepted the said abandoned house, and arrested Juan Dela Cruz 24 years old from of
Purok 4 Barobo Surigao del sur.

Further the arrested suspects revealed that he committed a crime for life needed and also to his family basic needed.

Confiscated 1 (BOLO) , through hot pursuit operation and the arrested suspects , was brought to Barobo MPS for proper
disposition.

CRIMINAL COMPLAINT

The undersigned Chief of Police of Barobo Municipal Police Station , Surigao del Sur , after having duly
sworn to oath Juan Dela Cruz for the crimes of VOL. OF REPUBLIC ACT NO. 7659, committed us follow;
On March 5, 2021 at around 11:30 pm at Purok 5–Cambagang Barobo Surigao Del Sur operation conducted by personnel of this
station led by. PMAJ LINCONE MARTINE together with Barangay Chairman Personnel of Barobo Led CJ Gavino confiscated 1
1 Bolo Through Hot Persuit Operation

Investigation conducted revealed that said with abandoned house were coming from Purok 2,Barobo Surigao Del Sur and upon
reaching at Barangay Campbagang Barobo Surigao del Sur. A concerned citizen reported thru cellphone call in PNP Barobo
Surigao Del Sur hotline the same were traversing heading to Barobo SDS . Immediately, personnel of this station together with
barangay Chairman establish hot pursuit operation and intercepted the said abandoned house, and Arrested Juan Dela Cruz 26
years old from of Purok 4-barangay 1 Barobo Surigao Del sur.

Ans: To Testify to Attempted Murder case against Juan Dela Cruz

Q5: When and where the incident happened?

Ans: On or about 2330hrs in the evening on March 5,2021 inside of our store at Purok 5 Campbagang
Barobo Surigao Del Sur.

Q6: What was your participation on the incident?

Ans: We Tagbina Family we Personally saw the incidents.

Q8: Please narrate what happened?

Ans: On or about 11:00PM On March 5,2021 Before the Incident happened we we out side our store to
get ready closing and that was sudden incident happened .

Q9: What next?

Ans: That was an incident so brutal that was suspect committed in crime and I fell nervous and quickly
contact police afterwards the suspect left that crime scene.

Q12: The investigator has nothing more to ask you, do you have anything to add or retract from young
statement?
Ans: Nothing for the Moment.

I, KENNETH LICAYAN, DEXTER COMMENDADOR, CHRISTIAN JAY GAVINO all of legal ages, members of

PHILIPPINES NATONAL POLICE (PNP) and presently assigned at BAROBO MPS , SURIGAO DEL SUR, after
duly sworn to in accordance with the law , hereby depose and state :

1. That we executing this instrument to support in filling of complaint against Juan Dela Cruz

For VIOLATION OF REPUBLIC ACT NO. 7659

2. On March 5, 2021 At around 11:30PM AT Purok 5 Campbagang Barobo Surigao Del Sur, Operation
conducted by personnel of this station led by. LINCONE MARTINEZ together with BARANGAY
CHAIRMAN personnel of Barobo Led by Kenneth Licayan confiscated 1 pistol caliber 45 unlicensed
firearms .

3. That we arrested Juan Dela Cruz

4. That Pcpi. Walaye Lam Mee informed the arrested suspects of their constitutional rights, MIRANDA
DOCTRINE and we then brought the arrested suspect in SIBAGAT MPS for proper disposition.

5. That we executed this affidavit freely and voluntarily.
