Norte, after duly sworn in accordance with law, hereby depose and state that:

1. I am a full time employee of Jose Rizal Memorial State University located at

Barangay Manaol Siocon Zamboanga Del Norte, working as a part time P.E.
instructor in the school mentioned above, under the supervision of the Dean
of the College of Arts and Sciences, Mr. Martin Maghanoy;

2. On August 2, 2017 at around 7 o’clock in the afternoon, after I finished

recording the quizzes of my students, I decided to go home;

3. I saw Ms. Icy Grace Colorito together with her cousin Ms. Faith Angel
Colorito, waiting outside the gate, I recognized the two because both of them
are under my P.E. class. They were talking at each other and I was just 2
meters away from them doing my time out;

4. Right where the cousins were standing, a black car with a red plate number
DIDI07 stopped in front of them and three men approach the two cousins,
they made them board the black car and went on their way;

5. I did not intervene because Ms. Icy Grace Colorito and Ms. Faith Angel
Colorito were known as rich kids so I assumed those were just their driver
and personal bodyguards and there were many instances that I saw them
being fetch by a black car;

1. That you have the right to remain silent and any information that you will
give can be used as evidence against you in any curt of the Philippines;
2. That you have a right to have a counsel preferable of your own choice, if
you cannot afford the services of the counsel, the Government of the
Philippines will give you one to assist you;
3. That you have the right to know why you are here in our office; and
4. That you have the right to be informed of all your Constitutional rights
enumerated above.

ANSWER - Yes ma’am

10. QUESTION - For the benefit of this investigation can you tell
what you saw in this rape case?
ANSWER - When I was about to go home, I saw the victims
waiting outside the gate when a black car stopped in
front of them and made them board on it.

11. QUESTION - Besides you, do you know other people who had
seen such incident?
ANSWER - No ma’am

12. QUESTION - What did you do after you witnessed the incident?
ANSWER - I didn’t do anything. I thought those men were just
their driver and personal bodyguard.

you have any statements to add or take away on this
affidavit?
ANSWER - I don’t have any ma’am.

14. QUESTION - Were you threatened, promised or bribed to do this

AFFIDAVIT OF ARREST

We, SPO2 Daisyleen Gamboa and SPO1 Arnel Cabig, both members of the
Philippine National Police, presently assigned at Siocon Zamboanga Del Norte,
Police Station, do hereby depose and state THAT:

01. That on or about 11 in the evening August 02, 2017, I, SPO2 Daisyleen
Gamboa received a report from Francisco A. Colorito the father and uncle of the
victims from Barangay Poblacion Siocon Zamoanga Del Norteand he reported that
his daughter and niece were raped.
02. That immediately after receiving the report, we proceeded to the
residence of Francisco Gamboa and thereat, we saw the victims Icy Grace Colorito
and Faith Angel Colorito.
03. That upon the interview of Icy Grace Colorito and Faith Angel Colorito,
they narrated everything that happen to them about the incident and alleges Rico
Cohena, Joffer Patalinghug and Khalid Maldiza of the crime rape, wherein they
molested victims.
04. That we invited Rico Cohena, Joffer Patalinghug and Khalid Maldiza to
go with us in the Police Station to clarify things which they really acceded.
05. That we informed Rico Cohena, Joffer Patalinghug and Khalid Maldiza
that they are being held for allegedly committing the crime of Rape and apprised
them of their Constitutional Rights as stated in the Miranda Doctrine. We then
brought and indorsed the case for proper investigation.
06. IN TRUTH TO THESE WE HERE UNTO affixed our signatures below
to the truthfulness of the foregoing.

CRIMINAL COMPLAINT AFFIDAVIT

I, Precy S. De Luna, the undersigned, of legal age, and a resident of

Barangay Poblacion Siocon Zamboanga Del Norte, Accuses Francis Jade G.
Alonzo, Franklline Jay G. Alonzo and Jose A. Bontigao of the crime Kidnapping,
committed as follows:

1. On the 7th day of October 2017 around 7:00 in the evening, I, Precy S. De
Luna just finished my night class in Physical Education, I am walking
moderately going to the gate of my school because my driver is waiting for
me;

2. Upon my arrival on the gate, my driver is not yet there so I take my seat near
the store. While waiting, I played on my cellphone so that I won’t get bored.
A minute after, a black car stopped in front of me, three men went out of it
and went to my direction.

3. A man wearing a blue cap, black leather jacket, and black shirt asked me
“Ikaw ba si Precy De Luna?” I answered “Oo, ngano man?” I didn’t get to
hear their reply because a handkerchief covered my nose, I felt dizzy and
everything went black.

4. I don’t know how long I am unconscious but slowly I am hearing voices of

men and they are arguing. I slowly opened my eyes and it took a moment for
me to realized that I’m in a room, both of my hands are tied and my mouth is
filled with a cloth. I still shouted to the top of my lungs and men came to see
me.

5. They removed the cloth in my mouth and asked them “Unsa diay inyung
gusto?” The man wearing blue tube mask and a green sweater answered me
directly “Kwarta!” and the other man wearing blue maong pants and a black
jacket added “Mag-cooperate nalang ka para dili ka masakitan”
 6. I stayed in that room for about a day or so I can’t tell it exactly because all
I’m thinking is what will happen to me. I’m scared and hungry at the same
time. I lost my faith not until I heard some noises like guns firing
everywhere.
7. A moment later, some men in uniform came to get me. I don’t know what to
think that time. All I know is that I’m saved. The men in uniform escorted
me safely, they brought me to their head quarter and there I saw my mama
Mrs. Florinda S. De Luna and my papa Mr. Francisco A. De Luna. There
were both crying, they hugged me and said that they were glad that I am
safe.

8. Later on, Police Lieutenant Colonel Arthur Magalso called my attention and
made me narrate everything that happened about the incident and that they
wanted me to choose who kidnapped me from those whom they caught.
They made me choose and I instantly identified them later on called as
Francis Jade G. Alonzo, Franklline Jay G. Alonzo and Jose A. Bontigao.

9. That the kidnappers knew that I am the daughter of Mrs. Florinda S. De luna
and Mr. Francisco A. De Luna the owner of the DL Company.

10. That all these stated herein are true and were stated freely without any force
or intimidation done against me.

11. To attest to the truthfulness of the foregoing, I, Precy S. De Luna,

I, Precy S. De Luna, of legal age, single and a resident of barangay

Poblacion Siocon Zamboanga Del Norte, after having duly sworn to in accordance
with law hereby depose and state:

1. I am the complaining victim for the crime kidnapping against Francis Jade
G. Alonzo, Franklline Jay G. Alonzo and Jose A. Bontigao in the case entitled
“People of the Philippines versus Francis Jade G. Alonzo, Franklline Jay G.
Alonzo and Jose A. Bontigao”, Criminal Case No.123457, Municipal Circuit Trial
Court, Municipality of Siocon.

2. After my thorough thinking of the incident, I have realized that because of

the sacredness that I experience during those times that I am being kidnapped, I
made a rush decision and immediately accused Francis Jade G. Alonzo, Franklline
Jay G. Alonzo and Jose A. Bontigao of the crime Kidnapping.

3. Since I have known their reason, I completely understand why they

kidnapped me and since they didn’t hurt or injured me, I am permanently
withdrawing my complaint against them. I clear them of whatever responsibility or
liability to me.

4. I hereby inform the Municipal Prosecutor of Siocon that I am withdrawing

my complaint for the crime of Kidnapping in Criminal Case No. 123457 “People
of the Philippines versus Francis Jade G. Alonzo, Franklline Jay G. Alonzo and
Jose A. Bontigao” Municipal Circuit Trial Court, Municipality of Siocon.

5. I likewise request the Municipal Circuit Trial Court, Municipality of

Siocon to dismiss with prejudice the said criminal case.

I, JOSEPH TANGON AVILA, of 21 years old, single and a resident of

Purok Pantukan Poblacion Siocon Zamboanga Del Norte. After having been duly
sworn to in accordance with law do hereby deposed and say:

That on or about 11:00 in the morning December 07, 2018, while my teacher
Miss. Jennika Montalbo was crossing across the street, she was busy texting using
her cellphone and didn’t notice the black motorcycle CB110 with a plate number
of DDTG07 is also crossing. Right there and then Miss. Jennika Montalbo got hit
by the motorcycle and she was already covered with blood. As I have seen, Miss.
Jennika Montalbo was not paying attention to her surroundings while she was
crossing because she was busy texting and that it was just an accident that the
driver of the motorcycle hit Miss. Jennika.

FACTS OF THE CASE:

Investigation disclosed that the victim and the suspect were in a relationship.
On September 20, 2016, around 7:00 in the evening, the two were having their
dinner together with the father of the deceased Ardi Park Lim and Sabtana Lim.
The victim and the suspect were having a quarrel about the victim having an affair
with her friend. A heated argument ensued and the suspect grabbed the kitchen
lying beside him, the victim defended herself and eventually stabbed by the
suspect. The victim was immediately brought to Siocon Memorial Hospital and
was pronounced Death on Arrival by the attending Doctor. The suspect was
arrested by the responding officers and was turned over to the office of the
investigation.

On the account of the foregoing, the suspect was placed under arrest and the
charge of HOMICIDE against him will be brought to the attention of an inquest
fiscal for proper disposition and recommendation.

This case will be brought to you by SPO2 Daisyleen Gamboa of this

command.

COMPLAINT-AFFIDAVIT

I, CECILLE TIGO, of legal age, student, and a resident of Purok Lower Log
pond, Barangay Poblacion Siocon Zamboanga Del Norte, after having been duly
sworn to according to law depose and say:

That Ronie Colorito has been showing his feelings to me since then. Giving
flowers, chocolates and other things during he is visiting. I did not ask for him to
do so, he just said that he wanted to do it because he wanted to court me.

On December 24, 2018 around 8:00 in the evening, Ronie visited me on my

boarding house located at Purok Camansi Barangay Poblacion Siocon Zamboanga
Del Norte. He brought cake and some foods to cook because he said he wanted to
celebrate Christmas Eve with me. Seconds before midnight, both of us are shouting
doing the countdown to welcome the Birthday of Jesus Christ.

Right there and then, Ronie asked to me become his girlfriend. I don’t know
what to do. I don’t know what to say. Honestly, I don’t really have that special
affection for him. I only see him as my friend and also I don’t have time for such
things because I wanted to finish my studies first. I told Ronie my reasons. I
thought he would understand but he got angry. He grabbed my wrist and pinned it
to the wall saying things that I don’t understand because I am shouting asking help.
He slapped me to keep my mouth shut but still I continued shouting then he
punched my stomach. I felt dizzy, but I can still feel that he is kissing me. And
everything went black.

When I woke up, it took a seconds for me to realized what happened. He

forced me. He molested me. I cried and shouted at them same time which result for
my boarding house neighbor China Mae Herbero to take a look at me. She
comforted me, gave me water and made me sure to give Ronie what he deserves.

That I am formally charging Ronie Colorito of the crime of Rape.
