I, DAIVE KENT O. LAXAMANA, Filipino 35 years old, Male, Married

and resident of Barangay Basak San Nicolas Villa Kalubihan, Cebu City.

After having been duly sworn to in accordance with the law, do hereby

depose and say:

1. that I am the respondent in the above entitled case;

2.That this judicial affidavit is taken upon examination of ATTY..PROS

LEN HEARTH A. PACALINGA at her law office at CEBU CITY

PROSECUTORS OFFICE at SKINA CALIFORNIA HALL OF

JUSTICE, 2nd floor, Macopa St., Cebu City, Philippines, 6000 where my

statements were taken;

3.That I am answering the the questions asked of me, fully conscious that I

am doing this under oath and that I may face criminal liability for false

testimony or perjury has been done in Visayan which language is

understood by me, and translated into English and explained to me.

A6: I’m in my house take rest because my body was tired of

cleaning all the mess in our house.

 A7:My wife was shouting me without any reasons and swearing me,

that why i answer her.

search warrant and give me and told me i am the one who point a gun

on her.

[A13:I let them in inside the house and had conversation and i

explain them about what happen between me and my wife.

[A14: When I discussed with my lawyer who translated to me, the

affidavit that was written in English. I would say substantially, those are

be followed of gun shout after my boss arguing.

TRIXIE LAXAMA holding a gun with a blood and laying down without

breathing.
